The City Council finds, based on advice from the City Attorney, that discussion in open session of the following matters will prejudice the position of the City in existing and anticipated litigation: 1. CALL TO ORDER — Meeting #2457 at 7:11 p.m. PRESENTATION OF COLORS, INVOCATION AND PLEDGE OF ALLEGIANCE — American Legion PRESENTATIONS — Mayor Puckett presented a Certificate of Recognition to Nicholas D'Sa in honor of his participation in the 2019 Scripps National Spelling Bee. Supervisor Donald P. Wagner presented a Certificate of Recognition to Nicholas D'Sa in honor of his participation in the 2019 Scripps National Spelling Bee. Supervisor Donald P. Wagner presented a plaque to the Mayor and City Council in honor of the Tustin Branch Trail. Dr. Gurpreet Ahuja provided an update on the Orange County Human Relations 2017-2018 Annual Report and presented a Certifcate of Recognition to the City Council in honor of their support. Anayeli Garfias CONSENT CALENDAR ITEMS 1-5 It was moved by Mayor Pro Tem Bernstein and seconded by Council Member Clark to approve the Consent Calendar as recommended by staff. WAIVE READING IN FULL OF ALL ORDINANCES AND RESOLUTIONS ON THE AGENDA Motion: That the City Council waive reading in full of all ordinances and resolutions on the agenda and declare that said titles which appear on the public agenda shall be determined to have been read by title and further reading waived. 2. APPROVAL OF MINUTES — THE REGULAR MEETING OF THE CITY COUNCIL HELD ON JUNE 18, 2019. Motion: That the City Council approve the Action Minutes of the Regular Meeting of the City Council held on June 18, 2019. 3. RATIFICATION OF PAYROLL The City Council has approved the use of Government Code Section 37208 to expedite the payment of City of Tustin obligations that are in accordance with the approved budget or continued operations authorizations. Motion: It is recommended that the City Council approve Payroll in the amount of $851,733.19. 4. SET PUBLIC HEARING FOR WATER QUALITY REPORT ON PUBLIC HEALTH GOALS (PHGs) 2016-2018 The California Health and Safety Code requires that water utility agencies with more than 10,000 service connections prepare a report every three years and conduct a public hearing to provide information to consumers on levels of contaminants in the City's drinking water. Motion: It is recommended that the City Council set a public hearing for July 16, 2019 at 7:00 p.m. to receive and respond to public comments on the 2016-2018 Public Health Goal Report. 5. CANCELLATION OF THE AUGUST 6, 2019 CITY COUNCIL MEETING Due to a lack of quorum, staff recommends cancellation of the August 6, 2019 City Council meeting. Motion: Direct the City Clerk to post a Notice of Cancellation for the regularly scheduled Council meeting on August 6, 2019. The City Council hereby waives notice of said meeting as required by Government Code §54954. PUBLIC HEARING ITEM 6 6. SCHOOLSFIRST FEDERAL CREDIT UNION HEADQUARTERS CAMPUS PROJECT City Council July 2, 2019 Meeting Minutes Page 4 of 11 The project is a request to construct a new 180,000 square -foot headquarters office building for the SchoolsFirst Federal Credit Union and includes a separate 5,000 square -foot credit union branch building, a new parking structure and associated site improvements. The site is located within Planning areas 7, 9, 11 and 14 of the Pacific Center East Specific Plan and generally bounded by Edinger Avenue to the north, railroad right-of-way to the east, Valencia Avenue to the south, and Newport and Del Amo Avenues to the west. The proposed project requires approval of Development Agreement (DA) 2018-00001, Lot Line Adjustment (LLA) 2018-00003, Concept Plan (CP) 2018-00001, Design Review (DR) 2018-00023 and Conditional Use Permit (CUP) 2018-00015. On June 11, 2019, the Planning Commission adopted Resolution No. 4379 determining that the associated disposition of City property conforms to the Tustin General Plan, and adopted Resolution No. 4380 recommending that the City Council approve the proposed project. Public hearing opened at 8:07 p.m. Public hearing closed at 8:07 p.m. with no public comments. It was moved by Mayor Puckett and seconded by Mayor Pro Tem Bernstein to: 1. Introduce and have first reading by title only of Ordinance No. 1501 for DA - 2018 -00001 to facilitate the conveyance of an approximate 1.8 -acre site and development of an office headquarters campus. 2. Adopt Resolution No. 19-32 approving: a. Lot Line Adjustment (LLA) 2018-00003 to modify parcel lines to accommodate the proposed project. b. Concept Plan (CP) 2018-00001 for the overall concept of the office campus facility including building design, site layout and public and private improvements. c. Design Review (DR) 2018-00023 for the design and site layout of the 180,000 square feet office building, 5,000 square feet credit union branch building, parking structure and associated site improvements. d. Conditional Use Permit (CUP) 2018-00015 for the establishment of joint -use parking for shared parking. DISPOSITION AND DEVELOPMENT AGREEMENT (DDA) WITH SCHOOLSFIRST FEDERAL CREDIT UNION Request for authorization to approve the DDA between SchoolsFirst Federal Credit Union (SchoolsFirst) and the City for the development of an approximately 180,000 square foot, three-story office building, a 5,000 square foot credit union branch building and a four -level parking structure. The DDA specifies the terms and conditions under which approximately 1.8 acres of City -owned property will be conveyed and developed by SchoolsFirst in combination with the existing SchoolsFirst campus. It was moved by Mayor Pro Tem Bernstein and seconded by Council Member Clark to authorize the City Manager to execute the DDA between SchoolsFirst and the City subject to non -substantive modifications as may be deemed necessary and/or recommended by the City's special real estate counsel or the City Attorney. Motion carried: 5-0 8. DESIGNATION OF VOTING DELEGATES AND ALTERNATES — LEAGUE OF CALIFORNIA CITIES ANNUAL CONFERENCE SCHEDULED FOR OCTOBER 16- 18,2019 (LONG BEACH) City Council July 2, 2019 Meeting Minutes Page 6 of 11 In order to vote at the Annual Business Meeting, the City Council must designate a voting delegate and up to two alternate voting delegates, one of whom may vote in the event that the designated voting delegate is unable to serve in that capacity. Mayor Puckett nominated himself as the voting delegate and designated Mayor Pro Tem Bernstein as the first alternate delegate and Council Member Clark as the second alternate delegate It was moved by Mayor Pro Tem Bernstein and seconded by Council Member Lumbard to designate Mayor Puckett as the voting delegate and designated Mayor Pro Tem Bernstein as the first alternate delegate and Council Member Clark as the second alternate delegate. Motion carried: 5-0 9. LEGISLATIVE UPDATE Staff prepared a summary of state legislative activity. Management Analyst Ken Piguee provided an update. The City Council unanimously received and filed the updated legislative matrix. 10. SECOND READING AND ADOPTION OF ORDINANCE NO. 1502 Adoption of Ordinance No. 1502 amends sections 1513, 1539, 1553, and 1573 of Chapter 5 of Article 1 of the Tustin City Code regarding City Commissioner and Building Board of Appeals Member removal from office. It was moved by Mayor Pro Tem Bernstein and seconded by Council Member Clark to have second reading by title only and adoption of Ordinance No. 1502. Motion carried: 4-1 (Council Member Clark dissented) ORDINANCE NO. 1502 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, AMENDING SECTIONS 1513,1539, 1553, AND 1573 OF CHAPTER 5 OF ARTICLE 1 OF THE TUSTIN CITY CODE REGARDING CITY COMMISSIONER AND BUILDING BOARD OF APPEALS MEMBER REMOVAL FROM OFFICE OTHER BUSINESS/CITY MANAGER AND CITY ATTORNEY City Manager Matthew S. West o Congratulated staff on the SchoolsFirst project; staff has been extremely motivated and Council Members have been supportive of the project; excited to see such a City Council July 2, 2019 Meeting Minutes Page 7 of 11 unique project come to fruition. o Announced there will be a permit parking workshop scheduled in the near future; staff have been working tirelessly on the permit parking issues; once the date is set, staff will advertise the date and location for the workshop. o Wished everyone a happy and safe 4th of July. June 21 o Attended the American Legion Breakfast. o Attended a Commercial Property Development Symposium in Tustin. June 23 Attended the Tustin Lions Club Installation Dinner. June 26 Attended Concerts in the Park. June 28 o Attended the Tustin Hearing Center's 30th Anniversary Celebration held at the Tustin Sports Park; was a very well attended event. o Attended the Advanced Rehabilitation Center of Tustin Ribbon Cutting and Open House event. June 29 Attended Frostee Rucker's 2nd Annual Camp of Champions youth football camp; was a free football camp, at Tustin High School, for all those attending; looks forward to it every year. City Council July 2, 2019 Meeting Minutes Page 8 of 11 June 30 Attended the Raise Foundation 8th Annual Gala "A Midsummer Day's Dream" at the Oak Creek Golf Club in Irvine; congratulated Council Member Clark for receiving the 2019 Champion of Kids award at the event. Wished a very special Happy Birthday to his daughter Rocio. Council Member Lumbard June 20 Attended the 10th Annual World's Largest Swimming Lesson at Blue Buoy Swim School; was an important event to teach water safety; always have a designated pool monitor watching kids and swimmers in the pool. Reminded everyone to stay safe on the 4th of July. Wished his wife a very Happy Birthday. Council Member Clark June 29 Attended Frostee Rucker's 2nd Annual Camp of Champions youth football camp; was a free football camp at Tustin High School; had a very positive vibe throughout the camp; great to see a former resident and professional athlete such as Frostee Rucker giving back to the community he grew up in; congratulated him on a successful camp. June 30 Was honored to receive the 2019 Champion of Kids award from The Raise Foundation; thanked Council Member Cooper for attending the event; reminded everyone the Raise Foundation is dedicated to stopping the cycle of abuse through education, advocacy, community collaboration, and comprehensive services for families and children. Encouraged everyone to have a safe and fun 4th of July; hopes to see everyone at the Tustin Meadows 4th of July parade and at the Tustin 4th of July Fireworks Show at Tustin High School. Mayor Pro Tem Bernstein June 17-19 Attended the Orange County Sanitation District Advocacy trip in Washington D.C.; visited with over ten congress and senate representatives; was an honor to be a part of the trip. June 20 o Attended the 10th Annual World's Largest Swimming Lesson at Blue Buoy Swim School; thanked Blue Buoy Swim School owners Johnny and Cindy Johnson for putting on the event and for providing education on drowning prevention; congratulated former Tustin Mayor Elwyn A. Murray for his involvement in spreading drowning prevention awareness throughout Orange County. Congratulated Cris Cusac on becoming Commander of the Santa Ana American Legion Post 131. June 26 Attended the Orange County Sanitation District Board of Directors meeting; congratulated Board President James "Jim" Ferryman for his thirty (30) years of service with the Orange County Sanitation District Board. June 27 o Attended the Association of California Cities -Orange County Legislative meeting. o Attended the Association of California Cities -Orange County Summer Reception at the San Joaquin Marsh. o Attended the Tustin Chili Cook -Off and Street Fair committee wrap-up dinner. Invited everyone to attend Tustin Concerts in the Park every Wednesday evening through July 31St at Peppertree Park. Announced Broadway in the Park August 6th — 11 th at Peppertree Park, Westside Story will be performed. Encouraged everyone to have a safe and fun 4th of July; hopes to see everyone at the Tustin Meadows 4th of July Parade and at the Tustin 4th of July Fireworks Show at Tustin High School. Mayor Puckett Attended the 10th Annual World's Largest Swimming Lesson at Blue Buoy Swim School; had the opportunity to meet former United States Olympic swimmer Jason Lezak at the event.
