RESOLUTION NO. 98-04 2 A RESOLUTION OF THE CITY COUNCIL OF THE' CITY OF 3 TUSTIN, CALIFORNIA, APPROVING FINAL TRACT MAP 15430 LOCATED AT THE NORTHWEST CORNER OF JAMBOREE AND 4 PIONEER ROADS. 5 6 The City Council'of the City of Tustin does hereby resolve as follows: 7 8 I. The City Council finds and determines as follows: 9 A. That Final Tract Map 15430 has been submitted by Catellus Residential Group ("the Subdivider"); !0 · B. That a public hearing was held by the Planning 11 Commission on February 24, 1997. At this hearing, the Planning Commission recommended that the City 12 Council approve Tentative Tract Map 14797. Subsequently, the City Council approved.Tentative 13 Tract Map 14797 on March 17, 1997; 14 C. That, pursuant to Section 66456.1 of the Subdivision Map Act, the Subdivider intends to file 15 multiple final maps in relation to approved Tentative Tract Map 14797. Final Tract Map 15430 16 is the fourth such final map; 17 D. Pursuant tO section 15268(b) (Ministerial Projects) of the California Environmental Quality Act (CEQA), i8 the Final Map is considered statutorily exempt from the requirements of CEQA. 19 E. That the proposed subdivision is in substantial 20 conformance with the Tustin General Plan, the Tustin Zoning Code and Subdivision Map Act; 21 F. The 1',2444 ·acres of parkland required for this 22 development was previously dedicated with recordation of Tract 13627; 23 G. That the City has reviewed the status of the School 24 Facilities Agreements between the Irvine Company and the Tustin Unified School District for the 25 impact of Tentative Tract 14797 on School District faclilities, and' changes in state law. Impacts 26 associated with this approval on School District facilities are adequately addressed; 27 28 Resolution No. 98-04 Page 2 1 2 3 H. That the site.is 'physically suitable for the type of development proposed; 4 I. That the site is physically suitable for the 5 proposed density of development; '6 J. That the design of the subdivision or the proposed improvements are not likely to cause substantial 7 environmental damage or substantially and avoidably injure fish~or wildlife in their habitat; 8 'K', That the design of the subdivision or the type of 9 improvements proposed will not conflict with easements acquired. by the public-at-large, for 10 access through or use of the property within the proposed subdivision; 11 L. That the design of the subdivision or the types of 12 improvements proposed are not likely to cause serious public health problems; and, 13 M. That the Final Map is in substantial conformance 14 with the Vesting. Tentative Tract'Map. 15 II. The City Council hereby approves Final Tract Map 15430, 16 subject to the posting of all required bonds and agreements pursuant to Exhibit A of Planning Commission 17 Resolution No. 3516 and final approval by the City Engineer and City Attorney. 18 19 PASSED AND ADOPTED a~ a regular meeting of the Tdstin City Council, held on the 5th day of January, 1998. 20 yyOR)y'F'.
