PUBLIC INPUT CLOSED SESSION - Councilmember Doyle announced that the City Council would convene in closed session to confer with the City Attorney about pending litigation to which the. City was a party: (1) Garcia v. City of Tustin, Case Number 01CC02149 (state court matter); (2) Santa Ana Unified School District, et al. v. City of Tustin, et al., Case Number 01CC02595 (state court matter); and (3) Santa Ana Unified School District, et al. v. City of Tustin, et al., Case Number CV-01-3426 W JR (CTX) (federal court matter); and to confer with the City Attorney regarding significant exposure to litigation pursuant to Government Code Section 54956.9(b), claim of Jim Herold. A copy of the claim can be reviewed in the City Clerk's Office. ADJOURNMENT- Councilmember Doyle adjourned the meeting at 4:03 p.m. The next regular meeting of the City Council was scheduled for July 16 2001, at 7:00 p.m., in the Council Chamber, 300 Centennial Way. The interviews were open to the public. Employee Showcase Pat Sanchez, Director of Parks and Recreation, introduced Diane VVillumson, Recreation Services Assistant, as the first employee recognized by the Employee Showcase Program. File of Life Program Pat Sanchez, Director of Parks and Recreation, explained the File of Life Program and stated it would be available in the City the week of August 20, 2001. 3. Outfall Study Lisa Lawson, Orange County Sanitation presentation on Ocean Water Releases. District, gave a PUBLIC INPUT Questioned when a skate park would be constructed; remarked on drivers using cell phones; and thanked staff for installing new stop signs. The following members of the audience reported on the coyote problem in Laurelwood, Tustin Meadows and 'Peppertree: Dan Fox, Pest Management Guido Borges, 2182 Dogwood, Tustin Marilyn Vaughan, 14402 Pinewood, Tustin Michael Jarvis, 14752 Birchwood Place, Tustin Angel Ratone, California Department of Fish & Game representative, responded to speaker concerns and recommended pets remain inside residences during nighttime hours; pet food should not be left outside; reported methods to discourage coyotes coming too close to homes; and recommended overgrown fields at the Marine Corps Air ' Station, Tustin be trimmed. Spoke on graffiti and gang problems in Old Town. Remarked on El Toro and John Wayne airport issues. Councilmember Bone requested a presentation be made to Council by Charles Griffin and Bob McGowan. Voiced his displeasure of redevelopment on his street. APPEAL OF PLANNING COMMISSION DENIAL OF USE DETERMINATION NOS. 00-001 AND 01-002 (14511 AND 145.12 CARFAX DRIVE) It was moved by Doyle, seconded by Kawashima, to continue the Public Hearing to October 15, 2001. Motion carried 4-0, Thomas absent. , CODE AMENDMENT 00-001 RELATED TO DEVELOPMENT STANDARDS FOR DRIVEWAYS FOR RESIDENTIAL, COMMERCIAL, AND INDUSTRIAL PROPERTIES. Recommendation: Ratify the Planning Commission Action Agenda of July 9, 2001. 13. AWARD OF BID FOR NEW RIDING LAWNMOWER Recommendation: Award the bid for the purchase of one riding lawnmower to Bob Hicks Turf Equipment as recommended by Public Works Department/Field Services Division. 14. APPROPRIATION LIMIT FOR FISCAL YEAR 2001/2002 Recommendation by the Finance Director: 1) Select the change in the California per Capita Personal Income as the price factor for adjusting the 2001/2002 appropriation limit; and 2) adopt the following Resolution No. 01-76 setting the appropriation limit for Fiscal Year 2001/2002 at $45,650,362: RESOLUTION NO. 01-76- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, DETERMINING AND ADOPTING AN APPROPRIATION LIMIT FOR THE FISCAL YEAR 2001-2002 IN ACCORDANCE WITH ARTICLE XIIIB OF THE CONSTITUTION OF THE STATE OF CALIFORNIA, AND SECTION 7910 OF THE GOVERNMENT CODE 15. 800 MHZ COMMUNICATIONS SYSTEM Recommendation: Authorize the Mayor to send a letter to the Orange County Grand Jury which responds to recommendations set forth in a Grand Jury Report regarding the 800 MHz law enforcement communications system as recommended by the City Manager. RESOLUTION NO. 01-75 ADOPTING THE CITY BUDGET AND WATER ENTERPRISE BUDGET FOR THE FISCAL YEAR 2001/2002 It was moved by Bone, seconded by Kawashma, to approve the following Resolution No. 01-75, adopting the City budget and Minutes- City Council July 16, 2001 -Page 6 appropriating from the anticipated revenues' of the City for the fiscal year 2001-2002: RESOLUTION NO. 01-75 ADOPTING THE CITY BUDGET AND WATER ENTERPRISE BUDGET FOR THE FISCAL YEAR 2001 ~2002 Motion carried 4-0, Thomas absent. APPOINTMENT OF CULTRUAL RESOURCES ADVISORY COMMITTEE MEMBERS Ballots were cast by Council to appoint members of the Cultural Resources Advisory Committee, as follows: Worley: Thomas: Kawashima: Bone: Doyle: Burch, Lilly, Smith Absent Burch, Lilly, Smith Lewis, Lilly, Smith Hurtado, Lilly, Smith Curt Lilly, Gary Smith and Lucille Burch were appointed to the Cultural Resources Advisory Committee, term ending July 18, 2005. None PUBLIC INPUT OTHER BUSINESS SPORTS PARK Councilmember Bone thanked staff for clearing weeds at the Sports Parks. ANGELS IN TUSTIN Councilmember Bone announced rescheduled to August 31, 2001. that Angels in Tustin program had been TDK 5TM ANNIVERSARY Councilmember Bone remarked that he and Councilmember Kawashima had attended the 5th anniversary of TDK and noted the company had doubled their sales in the last five years. Councilmember Kawashima mentioned TDK's 5th anniversary celebration and noted an outreach program to businesses was being developed by he and Councilmember Bone along with the Economic Development Council. Minutes- City Council July 16, 2001 - Page 7 REDISTRICTING Councilmember Bone reported that although Council had supported Proposal 5, the Redistricting Committee recommended Proposal 3C to the Board of Supervisors; however, he stated he would represent the City at the Board's meeting on July 17, 2001, in support of Proposal 5. EMPLOYEE RECOGNITION Councilmember Kawashima congratulated Diane Willumson or~ employee recognized in the Employee Showcase program. being the first FOURTH OF JULY Councilmember Kawashima stated the 4th of July parade and fireworks show were wonderful events. Mayor Worley remarked that this year's 4th of July fireworks show was the best ever. SOUTHERN CALIFORNIA EDISON Councilmember Doyle commented on his reduction of power by 1/3 and the increase in his electric bill. CONCERTS IN THE PARK Mayor Worley reminded everyone that Concerts in the Park was underway on Wednesdays and invited everyone to attend. COMMITTEE REPORTS WATER ADVISORY COUNCIL OF ORANGE COUNTY (WACO) Councilmember Bone commented that WACO had announced that through May, Orange County water usage had been reduced.
