(PROJECT NO. 2056) RESOLUTION NO. 05-27 ACCEPTANCE OF
PUBLIC IMPROVEMENTS AND AUTHORIZATION TO FILE NOTICE OF
COMPLETION
SUMMARY
The Centennial Park Restroom and Tot Lot Renovation (Project No. 2056) is ready for
acceptance and filing of the Notice of Completion
RECOMMENDATION
It is recommended that the City Council adopt Resolution No. 05-27, accepting said
work as complete; authorize the recordation of the Notice of Completion; and direct the
City Clerk to:
1. Release the Labor and Materials Bond no sooner than 35 days after the date of
recordation of the Notice of completion; and
2. Release the Faithful Performance Bond no sooner than one year after the date of
recordation of the Notice of Completion.
FISCAL IMPACT
The final cost of the construction contract for the Centennial Park Restroom and Tot Lot
Renovation project was $573,058.00. The project was funded through an appropriation
from Park Development Funds.
BACKGROUND
The scope of the work included improvement to the park security lighting, irrigation
control valves, restroom building, hardscape court areas, and new ADA and National
Playground Safety Standard compliant Tot Lot.
The project was substantially complete as of December 23, 2004. The City is retaining
10% of the contract amount, which will be disbursed no sooner than 35 days after the

recordation of the Notice of Completion. Please be advised that the City is also
retaining Liquidated Damages due to the delay in the Contractor's completing the
project; a total of 23 construction days.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN,
CALIFORNIA, ACCEPTING WORKS OF IMPROVEMENT AND
AUTHORIZING RECORDATION OF NOTICE OF COMPLETION FOR
CENTENNIAL PARK RESTROOM AND TOT LOT RENOVATION
(PROJECT NO. 2056).

6 The City Council of the City of Tustin does hereby resolve as follows:
WHEREAS, Dinalli Construction, Inc., having a contract with the City of Tustin
to construct the hereinafter described public works and improvements; and

WHEREAS, the City Engineer has duly certified to the construction and
completion of said public improvements hereinafter mentioned in a manner
satisfactory to the City Council of the City ofTustin; and '

WHEREAS, the City Council finds that said contractor has completed said
public improvement hereinafter more particularly described in accordance with the
provisions of the contract documents and the Notice of Completion, and acceptance of
said public work and improvement should be filed and payment of the balance due
said contractor authorized in accordance with the contract documents;

14 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Tustin that said public work and improvement be accepted, and the same is hereby
15 accepted. Said public work and improvement is more particularly described as
16 follows:
