SUBJECT: AWARD OF CONTRACT FOR CONSTRUCTION OF THE ANNUAL MAJOR
MAINTENANCE PROJECT, FY 2004-2005 (CIP NO. 7001), AND ANNUAL
SIDEWALK REPAIR PROJECT, FY 2004-2005 (PROJECT NO. 402-6235)
SUMMARY
Bids for the combined Annual Major Maintenance Project, FY 2004-2005 (CIP No. 7001),
and Annual Sidewalk Repair Project, FY 2004-2005 (Project No. 402-6235), have been
received and a construction contract is ready to be awarded.
RECOMMENDATION
It is recommended that the City Council award the construction contract for the Annual Major
Maintenance Project, FY 2004-2005 (CIP No. 7001), and Annual Sidewalk Repair Project, FY
2004-2005 (Project No. 402-6235), to Hardy & Harper, Inc., the lowest responsible bidder in the
amount of $462,858.07, and authorize the Mayor and the City Clerk to execute the contract
documents on behalf of the City.
FISCAL IMPACT
The FY 2004-2005 Capital Improvement Program (CIP) Budget provides $630,000 for all of
the various components in the Annual Major Maintenance Project (CIP No. 7001), including
design, construction and contract administration. The bid amount for this portion of work is
$360,536.11. The Public Works DepartmenUEngineering Division Operating Budget for FY
2004-2005 provides $200,000 to cover all of the costs associated with the Annual Sidewalk
Repair Project (Project No. 402-6235). The bid amount for this portion of work is $102,321.96.
Both of these projects are part of the City's on-going Maintenance of Effort (MOE) requirement
to maintain eligibility for Measure M funding. The total bid amount for both projects is
$462,858.07.
BACKGROUND
The Annual Major Maintenance Project, FY 2004-2005 (CIP No. 7001), and Annual Sidewalk
Repair Project, FY 2004-2005 (Project No. 402-6235) were again bid as one project to simplify
the contract administration process and to reduce duplication of effort in coordination of the two
projects. Combining the two projects will reduce disruption in the areas where both projects
have construction impacts and will facilitate contract administration efforts by City staff during
construction.

Bids were opened on January 25 2004. There were eight (8) bids received and the results are
summarized as follows:

The references and the contractor's State License for Hardy & Harper, Inc. have been checked
and are appropriate for the subject project. Their bid for the Annual Major Maintenance Project
(CIP No. 7001) .and for the Annual Sidewalk Repair Project (Project No. 402-6235) is about
11 % below the engineer's estimate of $523,000. The bid amount is lower than the engineer's
estimate due to lower than expected prices on asphalt as compared to prices received on
recent similar projects.
Work for the FY 2004-2005 Annual Major Maintenance Project generally consists of asphalt
resurfacing on southbound Jamboree Road north of Barranca Parkway and on Franklin
Avenue south of Walnut Avenue. Remedial asphalt repairs will also be performed on Main
Street between Prospect Avenue and Newport Avenue; on Warner Avenue between the SR 55
Freeway and Pullman Street; on Red Hill Avenue between Warner Avenue and Barranca
Parkway; and on Tustin Ranch Road between the 1-5 Freeway and Walnut Avenue.
Work for the FY 2004-2005 Annual Sidewalk Repair Project generally consists of removal and
replacement of sidewalk at 190 locations throughout the City. Some trees will be removed and
replaced with more appropriate species as part of this effort. Additionally, curb ramps will be
modified or installed in compliance with the federal Americans with Disabilities Act (ADA).
