3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TUSTIN, CALIFORNIA, APPROVING VESTING TENTATIVE
4 PARCEL MAP 97-117, A REQUEST TO SUBDIVIDE A 1.6-
ACRE COMMERCIAL PARCEL INTO TWO NUMBERED PARCELS ON
5 THE PROPERTY LOCATED AT 535 EAST MAIN STREET.
6 The City Council of the City of Tustin does hereby resolve as
follows:

I. The City Council finds and determines as follows:

A. That Vesting Tentative Parcel Map 97-117 was
9 submitted to the City Council by Greg Bennett
Architects on behalf of the property owners for
10 consideration;
11 B. That a public hearing was duly called, noticed and
held on said application on August 11, 1997 and
12 continued to September 22, 1997 and subsequently
renoticed for hearing on November 10, 1997 by the
13 Planning Commission. The Planning Commission
adopted Resolution No. 3535 recommending City
14 Council approval of Vesting Tentative Parcel Map
97-117.

C. That a public hearing was duly noticed, called and
16 held on said application by the City Council on
December 1, 1997.

D. That a Negative Declaration has been prepared and
18 certified for this project in accordance with the'
provisions of the California Environmental Quality
19 Act (CEQA);
20 E. That the proposed subdivision is in conformance
with the Tustin Area General Plan, Subdivision Map
21 Act and Tustin City Codes as it pertains to
development of commercial development;

F. That the site is physically suitable for the type
23 of development proposed;
24 G. That the site is physically suitable for the'
proposed density of'development;

H. That the design of the'subdivision is not likely to
3 cause substantial environmental damage or
substantially and un-avoidably injure fish or
4 wildlife in their habitat;
5 I. That the design of the.subdivision or. the type of
improvements proposed will not conflict with
6 easement acquired by the public at large, for
access through or use of the property within the
7 proposed subdivision;
8 J. That the design of the subdivision is not likely to
cause serious public health problems~'

K. The proposed project has been reviewed for
10 conformity with the provisions of the Orange County
Congestion Management Program, and it has been
11 determined that the additional traffic generated by
the proposed project onto the CMP Highway System
12 does not cause the system to exceed the established
level of service standards; and, ~

L. The proposed project has been reviewed for
14 conformity with the provisions Of the Measure
M/Growth Management Program, and it has been
15 determined that the proposed project is exempt from
the provisions of Measure "M" in that the estimated
16 project generated traffic does not cause the
roadway system. to exceed the established level of
17 service standards.
18 M. That the project has been reviewed for compliance
with the Americans with Disabilities Act of 1990
19 and it has been determined that dedications of
right-of-way at the corner and all radius type
20 driveways are necessary for Compliance with the
requirements of ADA.

II. The City Council herebyapproves Vesting Tentative Parcel
3 Map 97-117, to subdivide a 1.6-acrescommercial site into
two numbered parcels on the property located at 535 East
4 Main Street, subject to conditions contained in Exhibit
A of Planning Commission Resolution No. 3535,
5 incorporated herein by reference.
6 PASSED Ai~D kDOPTED at a regular meeting of the Tustin City
Council held on the 1st day of December, 1997.
