That the Planning Commission continue consideration of the

It was moved by Pontious, seconded by Floyd, to continue Items 2,
3, and 4 to the February 24, 2005, Planning Commission meeting.

ACRES INTO TWENTY-FIVE (25) NUMBERED LOTS AND
SIX (6) LETTERED LOTS FOR THE PURPOSE OF
CONSTRUCTING TWENTY-FIVE (25) DETACHED
SINGLE-FAMILY DWELLINGS, COMMON AREA
LANDSCAPE LOTS, AND FUEL MODIFICATION LOT
WITHIN A GATED COMMUNITY MAINTAINED BY A
HOMEOWNERS ASSOCIATION. THIS PROJECT IS
LOCATED IN THE EAST TUSTIN SPECIFIC PLAN,
MEDIUM DENSITY RESIDENTIAL (1-18 DU/ACRE)
ZONING DISTRICT.
RECOMMENDATION:
That the Planning Commission:
1 . Adopt Resolution No. 3960 recommending that the City
Council find that the Negative Declaration for Tentative
Tract Map 16782 and Design Review 04-024 is
adequate for the project;
2. Adopt Resolution No. 3961 recommending that the City
Council approve Tentative Tract Map 16782 to
subdivide 5.33 acres into 25 numbered lots and 6

lettered lots for the purpose of developing 25 medium
density detached single-family dwellings and Design
Review 04-024 for the site layout and architectural
design of the project.

Added that conditions of approval and mitigation measures have
been included that would require architectural enhancements along
Rawlings Way and Tustin Ranch Road and any exterior walls that
are visible from those roadways; this requirement will be included
on future projects coming before the Planning Commission in
Tustin Legacy for any exterior visible from an arterial roadway.

Asked if this is a gated or guard-gated community.

Answered that it will be a gated community.

Asked if the driveway lengths will be sufficient for cars to be parked
in the driveways.

Stated the driveways average about 15 feet in length which would
be sufficient to accommodate two cars.

Asked why the applicant is not providing model homes.

Deferred the question to the applicant.

Indicated the applicant could address that issue when invited to the
lectern.

Asked why there are no enhancements on the right elevation;
suggested that perhaps something was missing; and, asked that
the applicant also be required to enhance the Ladera side.

Answered that staff would be able to investigate those concerns
during plan check.
Nielsen
Asked if the fire fuel hillside modification zone would undergo any
geologic or soil testing or monitoring and who would be responsible
for that hillside.

Indicated a soils study will be required at plan check.

Stated he is not sure about that; the proposal is to cut slightly into
the hillside which would require an analysis of the impact.
Noted an analysis would be important based upon what has been
happening with the recent rain storms and flooding; adding a
condition of approval may be necessary.
Added the City was involved in the hillside as it was originally
prepared to make sure it was done appropriately.
Stated the fuel modification area is the one for this map; the
upslope is not this developer's responsibility but the responsibility of
the Tustin Ranch Estates.
Invited the applicant to come forward.
Thanked staff for their help; agreed with all the conditions of
approval; stated the developer is committed to providing right-side
enhanced elevations; and, added that any side of a home facing
Tustin Ranch Road or Rawlings Way will be enhanced.
Asked if the enhancements would include those walls facing the
school.
Answered in the affirmative; and, added that the fuel modification
zone would include additional landscaping pursuant to the
requirements of the Orange County Fire Authority which would be
included in the soils report.
Asked why no models were included.
Stated there are only 25 home sites to be sold from an off-site
location; the sales are expected to be good and model homes
unnecessary .
Questioned whether or not the applicant was in agreement with the
modifications to be made to the conditions of approval.
Answered in the affirmative.
Invited other interested parties to come forward.
Stated this is a great project which the landowner supports; the
church could not be developed; this project is a good one for the
last parcel in the East Tustin Specific Plan; staff did a good job
working with the developer in resolving the ingress/egress issues
and the gated portion; the Irvine Company is supportive and is
releasing their CC&Rs in connection with this transaction.

Stated she is a member of the Parent-Teacher organization at
Ladera Elementary School; a primary concern is that the homes
that back up to the playground should be aware that there will be
noise issues; perhaps that issue could be included in the conditions
of approval.
Agreed that adding this information to the conditions of approval
would be a good idea
Suggested that, since the school is in existence, this should be self-
evident to the purchasers of these homes.
Asked if an additional fire escape exit is necessary in a gated
community.
Answered that the Fire Authority did a preliminary review of the
project and this was not a concern; the project is required to go
back before the Fire Authority during plan check.
Asked about the drainage on to Tustin Unified property.
Indicated the staff report indicates the project is proposing to add
more drainage water into a culvert on their property; there is a 20
foot wide drainage easement on the School District property that is
held by the Irvine Company; at plan check staff would work with the
developer and require proof they have the right to use that system
with the purchase of the hillside.
Asked if that is an open drainage area or underground.
Stated the culvert would be required to comply with current Water
Quality Management Practices as a condition of the project.
Asked the applican~ to return and address the concerns.
Suggested language to be added to the homebuyer notifications as
follows:
Condition 11.1.a: "A notice for potential roadway noise, airport
noise, and school and playground related noises...".
Stated that addition would be included in the CC&Rs.
The Public Hearing closed.
Stated his full support of the project.

Noted it is rather momentous to have the last project on the Ranch
approved; and, stated her support with the modifications noted.
Added his support of the project which is a fitting use for that piece
of land.
Thanked the applicant for a nice project and staff for their work; he
supports this project.
Agreed with his colleagues; and, asked for a motion.
It was moved by Pontious, seconded by Floyd, to adopt Resolution
Nos. 3960 and 3961, as modified. Motion carried 5-0.

AMENDMENT OF CONDITIONAL USE PERMIT 04-015, A
REQUEST TO AMEND THE PARTIAL MASTER SIGN
PROGRAM FOR THE DISTRICT AT TUSTIN LEGACY TO
INCLUDE CRITERIA FOR CENTER IDENTIFICATION
AND INDIVIDUAL TENANT WALL SIGNAGE TO EXCEED
SEVENTY-FIVE (75) SQUARE FEET FOR PRIMARY
SIGNS AND TWENTY-FIVE (25) SQUARE FEET FOR
SECONDARY SIGNS, AND CRITERIA FOR "LIFESTYLE
CENTER BLADE," "TENANT BLADE," "PEDESTRIAN
DIRECTIONAL," "LIFESTYLE SUPER GRAPHICS,"
"AWNING," AND "CANOPY" SIGNS THAT ARE
CURRENTLY UNDEFINED BY THE TUSTIN SIGN CODE,
AND OTHER RELATED AMENDMENTS. THIS PROJECT
IS LOCATED IN THE SP-1 SPECIFIC PLAN, PLANNING
AREAS 16, 17, AND 19 ZONING DISTRICT.
RECOMMENDATION
That the Planning Commission adopt Resolution No. 3959
approving an amendment to Conditional Use Permit 04-015
amending the partial master sign program and establishing
a complete master sign program for The District at Tustin
Legacy.
The Public Hearing opened.
Presented the staff report.
Asked if the palm wraps will be interchanged on a seasonal or
promotional basis.
Stated that her understanding is the wraps will be interchangeable
perhaps including lifestyle images.

Asked if there is anything in the conditions regarding the upkeep of
the signs.
Answered that a condition could be added.
Asked the applicant to come forward.
Thanked staff; and, indicated he, the Director of Construction David
Ristau, and the sign consultant would be available to answer any
questions.
Asked if the multiple tenant and single tenant pylons and
monument signs could be assigned by building so there can be no
future argument in that regard.
Answered that three of the signs on South Loop Road are designed
for the major tenants in that part of the project; three other signs are
available to other tenants within the project; the signs will be used
as a lure to the high-end restaurants or specialty tenants in the
lifestyle district; flexibility will be required in the negotiation of which
buildings and what types of tenants the latter three signs would go
to.
Stated her concern is that no additional signs be allowed, no matter
how many tenants may request them.
Indicated that should not be a problem; the applicant will work with
staff to identify the buildings the other three signs would be
associated with.
Asked what the construction of the palm wraps will be.
Stated the material will be a combination of durable products.
Added the wraps will be changed with the seasons and marketing
programs for the center.
Asked where there are palm wraps that he could equate with what
is drawn on the plans.
Indicated that such signs do not exist; the signs were inspired by
some work that exists in Culver City's downtown enhancement
program; the wraps are designed to create a link from the parking
areas into the core of the lifestyle center; the signs will be used for
non-advertising purposes that will add color to support the energy
and the spirit of the center; the signs will be changed out
seasonally.

Asked if the lifestyle graphics will also be interchangeable and
seasonal.
Answered in the affirmative.
Added the palm wrap idea linking the parking to the center is a nice
touch; and, noted the wraps will also screen the buildings that will
remain adjacent to the center.
The Public Hearing closed.
Asked if staff had language for the suggested modifications.
Suggested that the following language be added to the end of
section 1.1 on the Guidelines:
"All signs shall be maintained in good repair. The landlord shall be
responsible for timely removal and replacement of any sign
deemed by the City in need of repair."
Stated he supports the project; suggested the purple pylons that
exist along Jamboree are not kept up that well; wondered if the
proposed signage will provide sufficient advertising space for this
center to be successful; indicated the signs could perhaps be
bigger to accommodate more vendors to draw more people into the
center.
Suggested that staff has taken those issues into account and
knows what is workable; the applicant feels the proposed signs will
be adequate.
Stated the signs are well-proportioned; and, asked if tenants who
already exist in Tustin will be relocating or putting up a second
store.
Indicated the market is expected to be dense enough to handle
additional stores.
Stated he looks forward to this project getting underway.
It was moved by Pontious, seconded by Menard, to adopt
Resolution No. 3959, as modified. Motion carried 5-0.

The Community Development Department Activity - Year in
Review briefly describes the total number of discretionary
projects (i.e. Conditional Use Permits, Design Reviews,
Subdivision Maps, etc.), major accomplishments for various
functional areas within the Community Development
Department, and Building Division activity.
RECOMMENDATION:
That the Planning Commission receive and file.
STAFF CONCERNS
8.
REPORT OF ACTIONS TAKEN AT THE JANUARY 17,
2005, CITY COUNCIL MEETING.
The City Council approved the Final Tract Map for Tustin Gateway
Business Park, the project at 1123 Warner Avenue, a portion of the
old Steelcase site.
The City Council approved an agreement between the City of
Tustin and the South Orange County Community College District
regarding utilities at Tustin Legacy; this project does not come
before the Planning Commission for entitlement; the only
discretionary action the City has relates to grading permits and
encroachment permits; their launch site is referred to as the
Advanced Technology and Education Park (ATEP); the Planning
Commission will be updated as this moves along.
The CDBG meeting is tentatively scheduled for February 16, 2005;
this meeting would involve a representative from the Planning
Commission on the Committee, usually the Chairperson or the
Chairperson's designee.
COMMISSION CONCERNS
Thanked staff for making the job of the Planning Commission so
much easier than it might be in other jurisdictions.
Added his kudos to staff for the work they do.
Asked if the land use fact sheet was standard in all the staff reports.
Answered that this form was initiated after the St. Cecelia project.
Stated the format, with everything on one page, is excellent; and,
added he plans to use it in his office.

Thanked staff for the presentations; and, added that he is always
impressed by how the applicants say they enjoy dealing with the
City of Tustin.

Echoed the comments of Commissioners Lee, Menard, and Floyd;
and, indicated Tustin has always had a competent staff.

Added his thanks to the staff.
Stated he feels the palm wrap signs are a great idea, and\ he looks
forward to adding this term to his land use vernacular.
Floyd
Noted that he attended the inauguration, a lifetime experience he
recommended for everyone; he presented the new City pin to
Congressman Christopher Cox who asked Commissioner Floyd to
pass on his greetings to the City.
