TO FILE THE NOTICE OF COMPLETION FOR THE JAMBOREE ROAD
MEDIAN BARRIER INSTALLATION BETWEEN BARRANCA PARKWAY
AND OCTAlSCRRA BRIDGE NORTH OF EDINGER AVENUE
(CIP NO. 7162)
SUMMARY
Construction of the Jamboree Road Median Barrier Installation between Barranca
Parkway and OCTAlSCRRA Bridge North of Edinger Avenue (CIP No. 7162) has been
completed to the satisfaction of the City Engineer and is now ready for City Council
acceptance.
RECOMMENDATION
It is recommended that the City Council adopt Resolution No. 05-24 accepting the
Jamboree Road Median Barrier Installation between Barranca Parkway and
OCTAlSCRRA Bridge North of Edinger Avenue (CIP No. 7162), and authorize the
recordation of the Notice of Completion, and direct the City Clerk to:
1. Release the Labor and Materials Bond not sooner than one hundred eighty
(180) days after the date of recordation of the Notice of Completion; and
2. Release the Faithful Performance Bond not sooner than one year after the
date of recordation of the Notice of Completion; and
Assuming no claims or stop payment notices are filed, it is further recommended that
thirty-five (35) days after the date of recordation of the Notice of Completion, the City
Council authorize payment of the final 10% retention in the amount of $74,958.58 to
Modern Alloys, Inc.
FISCAL IMPACT
The total final construction contract cost for the project is $749,585.75. The project was
funded by a combination of Gas Tax Funds in the amount of $342,800.00, fair share
participating funds from the City of Irvine in the amount of $129,200.00, and grant funds
from Caltrans in the amount of $360,000.00.

Project construction along with design and construction management has increased the
City's infrastructure assets by $666,715.00. That increased infrastructure valuation will be
added to the City's infrastructure inventory as required by Statement 34 of the
Governmental Accounting Standards Board (GASB 34). Detailed cost infomnation is
shown on the attached GASB 34 Infrastructure Inventory Valuation Form.
BACKGROUND
The project provided for the construction of a median barrier along Jamboree Road
between Barranca Parkway and the OCTAlSCRRA Bridge North of Edinger Avenue. A
portion of the project lies within the jurisdiction of the City of Irvine as shown in the
attached location exhibit. Pursuant to a Cooperative Agreement between the City of Irvine
and City of Tustin dated April 5, 2004, the City of Irvine agreed to pay a fair share
contribution towards project design and construction costs for the work within their
jurisdiction. It was also agreed that the City of Irvine would defer inspection responsibilities
on the subject project to the City of Tustin. Consequently, the City of Tustin is responsible
for determining when the project is complete and ready for filing of the Notice of
Completion.
The project was completed on December 10, 2004. All of the work for this project has
been completed to the satisfaction of the City Engineer, and is now ready for City Council
acceptance.

RESOLUTION NO. 05-24
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN,
CALIFORNIA, ACCEPTING THE WORKS OF IMPROVEMENT AND
AUTHORIZING THE RECORDATION OF THE NOTICE OF
COMPLETION FOR THE CONSTRUCTION OF THE JAMBOREE ROAD
MEDIAN BARRIER INSTALLATION BETWEEN BARRANCA PARKWAY
AND OCTAlSCRRA BRIDGE NORTH OF EDINGER AVE (CIP NO. 7162)
WHEREAS, Modern Alloys, Inc., having a contract with the City of Tustin to
construct the hereinafter described public works and improvement; and
WHEREAS, the City Engineer has duly certified to the construction and
completion of said public improvement hereinafter mentioned in a manner satisfactory
to the City Council of the City of Tustin; and
WHEREAS, the City Council finds that said contractor has completed said public
improvement hereinafter more particularly described in accordance with the provisions
of the contract documents and the Notice of Completion, and acceptance of said public
works and improvement should be filed and payment of the balance due said contract
authorized in accordance with the contract documents;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Tustin
that said public works and improvement is found to be complete, and the same is
hereby accepted. Said public works and improvement is more particularly described as
follows:

BE IT FURTHER RESOLVED that the City Engineer of the City of Tustin is
hereby authorized to execute and file a Notice of Completion for the acceptance of said
public works and improvement described herein as required by law.
PASSED AND ADOPTED at a regular meeting of the City Council of the City of
Tustin held on the 22nd day of February 2005.
