2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TUSTIN, CERTIFYING THE FINAL NEGATIVE DECLARATION
3 AS ADEQUATE FOR VESTING TENTATIVE PARCEL MAP 97-
117, CONDITIONAL USE PERMIT 97-005 AND DESIGN
4 REVIEW 97-009 INCLUDING REQUIRED FINDINGS PURSUANT
TO THE CALIFORNIA ENVIRONMENTAL QUALITY ACT.

The City Council of the City of Tustin does hereby resolve as
6 follows:
7 'The City Counckl finds and determines as follows:
8 A. The request to approve Vesting Tentative Parcel Map
97-117, Conditional Use Permit 97-005' and Design
9 Review 97-009 are considered "projects" pursuant
to the terms of the California Environmental
10 Quality Act.
11 B. A Negative Declaration has been prepared for this
project and has been distributed for public review.

C. Whereby, the City Council of the City of Tustin has
13 considered evidence presented by the Community
Development Director and other interested parties
14 with respect to the subject Negative Declaration.
15 D. The City Council has evaluated the proposed final
Negative ~Declaration and determined it to be
16 adequate and complete. ..
17 II. A Final Negative Declaration has been completed in
compliance with CEQA and state guidelines. The City
18 Council having final approval authority over Conditional
Use Permit 97-005, Design Review 97-009, and Vesting
19 Tentative Parcel Map 97-117, has received 'and considered
the information contained in the Negative Declaration,
20 prior to approving the proposed project, and found that
the Negative Declaration adequately discussed the
21 environmental effects of the proposed project. On the
basis of the initial study and comments received during
22 the public review process, the City Council has found
that although the proposed projects could have impacts,
23 there will not be a significant effect because mitigation
measures identified in the Negative Declaration have been
24 incorporated into the project which mitigate any
· potential significant environmental effects to a point
25 where clearly no significant effect would occur. The
mitigation measures are identified in Attachment A of the
26 Negative Declaration and Initial Study and are adopted as
findings and. conditions of City Council Resolution Nos.
27 97-115 and 97-116.
