CLOSED SESSION REPORT - Nothing to report FIRST PUBLIC INPUT - Reverend Timothy MacCarthy requested that the City respond to a letter sent on February 2nd regarding a building permit for a new office/meeting hall at St. Cecilia's Church located at 1301 Sycamore. Lynn Davis, Vice-Chair of the Tustin Unified School Board District, addressed the Council on Agenda Item No.2 and indicated full support of project and recommended actions. PUBLIC HEARING 1. GENERAL PLAN AMENDMENT 04-001, PREZONE 04-001, AND SPECIFIC PLAN AMENDMENT/ZONE CHANGE 04-001 The applicant is requesting a General Plan Amendment and Prezone related to the proposed annexation of Marine Corps Air Station (MCAS) Tustin Disposition Parcel 36, and a Zone Change/Specific Plan Amendment to establish new site development standards for MCAS Tustin Disposition Parcel 36. On February 14, 2005, the Planning Commission recommended that the City Council aporove project. Applicant / Owner: Moffett Meadows Partners LLC Legal Notice published in the Tustin News on January 13, 2005 Community Development Director Elizabeth Binsack presented staff report. Public hearing opened at 7:35 p.m. There were no public speakers and the public hearing closed at 7:36 p.m. Motion: 1.a. It was moved by Mayor Pro Tem Davert, seconded by Councilmember Kawashima to adopt Resolution Nos. 05-42 and 05-43. Motion carried 5-0; and City Council Meeting Minutes February 22,2005 Page 2 of 15 RESOLUTION NO.O5-42 - A resolution of the City Council of the City of Tustin finding that the Final Environmental Impact Statement / Final Environmental Impact Report for the disposal and reuse of MCAS, Tustin ("FEIS/FEIR") is adequate to serve as the project EIS/EIR for General Plan Amendment 04- 001, Prezone 04-001, Zone Change (MCAS Tustin Specific Plan Amendment) 04-001, and Annexation No. 159 RESOLUTION NO.05-43 - A resolution of the City Council of the City of Tustin approving General Plan Amendment 04-001 to establish the General Plan designation of "MCAS Tustin Specific Plan" for the annexation of MCAS Tustin Specific Plan Disposition Parcel 36 1.b. It was moved by Mayor Pro Tem Davert, seconded by Councilmember Amante to Introduce and have first reading by title only of Ordinance Nos. 1294 and 1295. Motion carried. ORDINANCE NO. 1294 - An ordinance of the City Council of the City of Tustin, adopting Prezone 04-001 prezoning MCAS Tustin Specific Plan Disposition Parcel 36 from the City of Irvine "2.3 Medium Density Residential" Zoning District to the City of Tustin "MCAS Tustin Specific Plan" Zoning District (SP-1 Specific Plan) ORDINANCEN NO. 1295 - An ordinance of the City Council of the City of Tustin, adopting zone change (MCAS Tustin Specific Plan Amendment) 04- 001 to amend Sections 3.9.4 and 3.13.2 of the MCAS Tustin Specific Plan to establish new site development standards for MCAS Tustin Specific Plan Disposition Parcel 36 2. TENTATIVE TRACT MAP 16581 AND SPECIFIC PLAN AMENDMENT/ZONE CHANGE 04-003 The applicant is requesting approval of Tentative Tract Map 16581 for the subdivision of 105.5 acres for the purpose of developing 1,077 residential units. To allow for the development of Carriage Way residences and the development of a condominium project that does not meet the current ten-acre minimum development site requirement, the applicant is also requesting Specific Plan AmendmenUZone Change 04-003. On February 14, 2005, the Planning Commission approved Concept Plan 03-003, Design Review 04-006, and recommended approval of Specific Plan AmendmenUZone Change 04-003 to allow development of carriage way residential units in Planning Areas 4 and 5 and amend the ten-acre minimum development site requirement to allow development of a condominium project on an approximately 9-acre site in Planning Areas 4 and 5 and Tentative Tract Map 16581 (Reuse Disposal Parcel 23 and Parcel 24). Highlights of the presentation include: Columbus Grove & Columbus Square . Columbus Grove/Planning Area 21: A request for development of 465 residential units. The site is bounded by Moffett Avenue to the North, Harvard Avenue and City of Irvine Medium Density Residential Areas to the East, the Peters Canyon Flood Control Channel and Jamboree Road to the West, and Warner Avenue to the South. Columbus Square/Planning Areas 4 and 5: A request for development of 1,077 residential units. The site is bounded by Edinger Avenue to the North, Severyns Road and a park site to the West, West Connector Road to the East, and Valencia North Loop Road to the South. . Specific Plan AmendmenUZone Change . Carriage Way Units Definition: A type of single family detached product that is located on a minimum thirty-six (36) foot wide paved street with a ten (10) foot parkway, a garage located to the rear of the residence, and takes access from a rear two- way alley/private drive (24 feet wide) . Rear Yard Setback: A minimum of three (3) feet to the alley for garage area and a minimum of seven (7) feet for living areas. Guest Parking: On-street parking on streets with minimum paved width of thirty- six (36) feet. The alley loaded garages will provide a neo-traditional streetscape with the same density as Single Family Detached units. Minimum 10 acre development site for condominium projects in Planning Areas 4 and 21. Reduce the standard to allow development of triplex units in Planning Area 21 and senior housing in Planning Area 4. . Circulation Plan . Columbus Grove: The project requires installation of a traffic signal at the main entry from Harvard Avenue. A traffic signal is projected to be warranted in the future at Moffett Avenue. The project would also require modification to the existing traffic signal at Harvard and Moffett intersection. Columbus Square: Development of the site also includes: Design and construction of a new traffic signal at West Connector RoadNalencia North Loop Road as part of the Tustin Legacy Backbone Infrastructure, and Traffic signals at Valencia North Loop Road/Lot P and West Connector Road/Lot T. . Tentative Tract Map 16581 & Tentative Tract Map 16582 . Development of the sites would require on-site and off-site infrastructure. . As conditioned, the proposed subdivision will be in conformance with the Tustin City Council Meeting Minutes February 22, 2005 Page 4 of 15 Area General Plan, MCAS Tustin Specific Plan as proposed to be amended by Zone Change 04-002 and 04-003, State Subdivision Map Act, and the City's Subdivision Code. Affordable Housing Component Planning Area 21: Parcel 35: . 67 affordable units are required 0 20 units for Very Low Income families, including 12 Transitional units; 0 17 units for Low Income families; 0 30 units for Moderate Income families. . 8 Very Low Income units and 17 Low Income units are requested for transfer to Planning Area 5 Parcel 36: . 14 Transitional units to be provided on Parcel 37 in City of Irvine Planning Area 4: . 8 units for Very Low Income (moved 8 units to PA5) . 48 units for Low Income . 16 units for Moderate Income (moved 14 units to PA5) . Total: 72 units Planning Area 5: . 53 units for Very Low Income (37 units + 8 units from PA 4 + 8 units from PA21) . 77 units for Low Income (60 units + 17 from PA 21) . 64 units for Moderate Income (50 units + 14 from PA 4) . Total: 194 units Condition 2.4 of Resolution No. 05-40 requires that prior to recordation of the first final map the applicant shall enter into a Housing Agreement with the City to ensure implementation of the Affordable Housing requirements of the Specific Plan, the City's Density Bonus Ordinance, the City approved "Affordable Housing Plan, Density Bonus Application, and the City's Affordable Housing Policy. Density Bonus . Based on the MCAS Tustin Specific Plan (Table 3-2), a maximum number of 274 residential units are permitted in Planning Area 4 and maximum of 621 units are permitted in Planning Area 5. . Since the applicant is providing more than 20 percent target units (affordable units), in accordance with Tustin City Code Section 9121 a twenty-five (25) percent density bonus has been requested. The request can be summarized as follows: Planning Area 4: Maximum Allowed Density Bonus Total 274 units 63 units 337 units City Councii Meeting Minutes February 22, 2005 Page 5 of 15 Planning Area 5: Maximum Allowed Densitv Bonus Total 621 units 119 units 740 units The applicant is required to enter into a Housing Agreement with the City to ensure implementation of the Affordable Housing requirements of the Specific Plan Planning Commission Actions . On February 14, 2004, the Planning Commission approved design review and concept plan requests for Columbus Grove and Columbus Square and recommended approval of the zone change and the tentative tract maps. . The applicant raised several issues at the meeting and requested modifications to the conditions of approval. The applicant's request and staff response to the issues are included in the staff report. . The applicant also submitted a request on February 21, 2005, for modifications to conditions of approval related to: 0 Phasing of street improvements and the senior housing project; 0 Reimbursement of improvements that are part of Tustin Legacy Backbone Infrastructure; and, 0 Obtain full credit for Columbus Grove Park. Park Land Credit . Columbus Grove: 2.11 main park (includes private recreation areas)- eligible for 1.0 acre park credit. 2.71 linear park - eligible for 50% credit because of location, width, and access through private community. Parkland credit for Improvement Cost Eligible -0.76 acres Affordability Park Credit Eligible (42 units @0.0098 = 0.41 acres) Richard Knowland, Vice President of Lennar Communities made presentation to the Council on home designs t at Tustin Legacy. Also, he requested full credit for the 2.71 linear park at Columbus Grove. Council discussion ensued. Council granted full credit, but requested that developer work with City staff in addressing access and visibility of park. Public hearing closed at 8:45 p.m. Motion: 2.a. It was moved by Mayor Pro Tem Davert, seconded by Councilmember Amante to adopt Resolution No. 05-38. Motion carried 5-0. RESOLUTION NO. 05-38 - A resolution of the City of Tustin City Council finding that the Final Environmental Impact StatemenUFinal Environmental Impact Report for the disposal and reuse of MCAS Tustin ("FEIS/FEIR") is City Council Meeting Minutes February 22, 2005 Page 6 of 15 adequate to serve as the project EIS/EIR for Zone Change 04-003, Tentative Tract Map 16581, Concept Plan 03-003, Design Review 04-006, the Affordable Housing Plan and Density Bonus Application, and the request to transfer affordable housing units from Planning Areas 4 and 21 to Planning Area 5 and that all applicable mitigation measures will be incorporated into the project as required by the California Environmental Quality Act 2.b. It was moved by Mayor Pro Tem Davert, seconded by Councilmember Amante to introduce and have first reading by title only of Ordinance No. 1297. Motion carried 5-0. ORDINANCE NO. 1297- An ordinance of the City Council of the City of Tustin, adopting Zone Change 04-003 to permit the development of detached carriage way single family dwelling units in Planning Areas 4 and 5 and establish related development standards and amend the requirement for a 10- acre minimum development site for condominiums and multiple family dwellings in MCAS Tustin Planning Area 4 2.c. It was moved by Mayor Pro Tem Davert, seconded by Councilmember Amante to adopt Resolution No. 05-40. Motion carried 5-0. RESOLUTION NO. 05-40 - A resolution of the City Council of the City of Tustin approving Tentative Tract Map 16581 to subdivide 105.5 acres bounded by Edinger Avenue on the North, Valencia North Loop Road on the South, an Industrial Business Park and Severyns Road on the West, and West Connector Road on the East for the purpose of developing 1,077 residential units within Planning Area 4 and Planning Area 5 of the MCAS- Tustin Specific Plan (Reuse Plan Disposal Parcel 23 and Parcel 24) 3. TENTATIVE TRACT MAP 16582 AND SPECIFIC PLAN AMENDMENT/ZONE CHANGE 04-002 The applicant is requesting approval of Tentative Tract Map 16582 for the subdivision of 86.26 acres and the development of 386 numbered lots and 68 lettered lots for the purpose of developing 465 residential units including 211 single family detached units, 68 carriage way units, and 184 condominium units. To allow for the development of carriage way residences and the development of a condominium project that does not meet the current ten-acre minimum development site requirement, the applicant is also requesting Specific Plan AmendmenUZone Change 04-002. On February 14, 2005, the Planning Commission approved Concept Plan 03-004 and Design Review 04-004 for the project and recommended approval of Specific Plan AmendmenUZone Change 04-002 and Tentative Tract Map 16582. (Planning Area 21) (Reuse Disposal Parcel 35 and Parcel 36). RESOLUTION NO. 05-37 - A resolution of the City Council of the City of Tustin approving Tentative Tract Map 16582 to subdivide 86.26 acres for the purpose of developing 465 residential units within Planning Area 21 of the MCAS-Tustin Specific Plan (MCAS Tustin Reuse Plan Parcel 35 and Parcel 36) CONSENT CALENDAR - It was moved by Councilmember Hagen, seconded by Mayor Pro Tem Davert, to approve Consent Calendar items 4 through 16 as recommended by staff. Motion carried 5-0. 4. APPROVAL OF MINUTES - REGULAR MEETING OF FEBRUARY 7, 2005 Motion: Approve the Regular City Council Meeting Minutes of February 7,2005. 5. CONSIDERATION OF CLAIM OF LAWRENCE CLEVE WHEELOCK, CLAIM 05-05 Motion: That the City Council deny Claim No. 05-05, Lawrence Cleve Wheelock, and direct the Finance Director to send notice thereof to the Claimant. APPLICATION FOR WORKFORCE HOUSING INCENTIVE GRANT FUNDS FROM CALIFORNIA DEPARTMENT OF HOUSING AND COMMUNITY DEVELOPMENT Motion: 8.a. Adopt resolution; and RESOLUTION NO. 05-34 - A resolution of the Tustin City Council authorizing the City Manager to apply for Workforce Housing Reward Program Grant funds under the California Department of Housing and Community Development for construction of Very Low and Low-Income Housing units 8.b. If the application for funding is approved, authorize the City to use the funds for eligible activities under the grant program. CHANGE OF VENDOR AUTHORIZATION Motion: Authorize the substitution of Northstar Electronics to perform conversions of the four marked patrol units in an amount not to exceed $29,185.34. Adopt resolution; and RESOLUTION NO. 05-24 - A resolution of the City Council of the City of Tustin, California, accepting the works of improvement and authorizing the recordation of the Notice of Completion for the construction of the Jamboree Road Median Barrier Installation between Barranca Parkway and OCTAlSCRRA Bridge North of Edinger Ave (CIP No. 7162) 11.b. Authorize the recordation of the Notice of Completion; and direct the City Clerk to: 1. Release the Labor and Materials Bond no sooner than 180 days after the date of recordation of the Notice of completion; and 2. Release the Faithful Performance Bond no sooner than one year after the date of recordation of the Notice of Completion. APPROVAL OF PIPELINE LICENSE AGREEMENT NO. 04-26865 BETWEEN THE CITY OF TUSTIN AND THE BURLINGTON NORTHERN AND SANTA FE RAILWAY COMPANY (WARNER AVENUE) Motion: Approve Pipeline License Agreement No. 04-26865 between the City of Tustin and the Burlington Northern and Santa Fe Railway Company for the installation and maintenance of a domestic water line across the BNSF right-of-way on Warner Avenue, and authorize the Mayor and City Clerk to execute the document on behalf of the city. AWARD OF CONTRACT FOR THE CONSTRUCTION OF THE PHASE V REGIONAL TRAIL PROJECT (CIP NO. 7085) Motion: Award the construction contract for the Phase V Regional Trail Project (CIP No. 7085) to Environmental Construction, Inc. the lowest responsible bidder, in the amount of $148,582.00 and authorize the Mayor and the City Clerk to execute the contract documents on behalf of the City. CONSIDERATION OF CLAIM OF RICK HILL, CLAIM NO. 04-35 Motion: After investigation and review by the City Attorney's Office and by the City's Claims Administrator, it is recommended that the City Council deny the claim and direct the City Clerk to send notice thereof to the claimant and the claimant's attorneys. CONSIDERATION OF CLAIM OF AMY LEE HARCHOL, CLAIM NO. 05-02 Motion: After investigation and review by the City Attorney's Office, it is recommended that the City Council deny the claim to the extent that the claim alleges personal injuries which occurred after July 7, 2004, and property damage, and direct the City Attorney to send notice thereof to the claimant and the claimant's attorneys. 16. CONSIDERATION OF CLAIM OF ARTHER KAZUO MASAOKA, CLAIM NO. 05-01 Motion: After investigation and review by the City Attorney's Office, it is recommended that the City Council deny the claim to the extent that the claim alleges personal injuries which occurred after July 7, 2004, and property damage, and direct the City Attorney to send notice thereof to the claimant and the claimant's attorneys. CONVEYANCE OF TUSTIN PUBLIC FINANCING AUTHORITY (TPFA) PROPERTY AT TUSTIN LEGACY TO CITY OF TUSTIN Motion: It was moved by Councilmember Hagen, seconded by Mayor Pro Tem Davert to adopt item 17 as recommended by staff. Motion carried 5-0. 17.a. Adopt resolution; and RESOLUTION NO. 05-41 - A resolution of the City of Tustin recertifying the Final Environmental Impact Report for the reuse and disposal of the former MCAS Tustin as complete and adequate pursuant to the California Environmental Quality Act for the conveyance of property at the former MCAS Tustin 17.b. Authorize the City Manager, or his designee to execute any necessary Quitclaims of property at Tustin Legacy from the Tustin Public Financing Authority to the City of Tustin, as necessary to facilitate economic redevelopment in accordance with the MCAS Tustin Reuse Plan and Specific Plan and any subsequent Development and Disposition Agreements subject to approval of all quitclaim documents by the City Attorney and/or special counsel. ORDINANCE SECOND READING: TIME LIMIT EXTENSIONS FOR THE TOWN CENTER AND SOUTH CENTRAL REDEVELOPMENT PLANS Time limit extensions of the Redevelopment Plans effectiveness and the ability to collect tax increment for the Town Center and the South Central Redevelopment Project Areas. Motion: It was moved by Mayor Pro Tem Davert, seconded by Councilmember Amante have second reading by title only and adoption of Ordinance Nos. 1291 and 1290 (Roll call vote).. Motion carried 5-0. ORDINANCE NO. 1291 - An ordinance of the City Council of the City of Tustin, California, extending the time limit of the effectiveness of the Redevelopment Plan for the Town Center Redevelopment Plan; extending the time limit for payment of indebtedness and receipt of property taxes under the redevelopment plan for the Town Center Redevelopment Project Area and making other findings in connection therewith ORDINANCE NO. 1290 - An ordinance of the City Council of the City of Tustin, California, extending the time limit of the effectiveness of the Redevelopment Plan for the South Central Redevelopment Plan; extending the time limit for payment of indebtedness and receipt of property taxes under the Redevelopment Plan for the South Central Redevelopment Project Area; and making other findings in connection therewith 19. ORDINANCE NO. 1292, AMENDING SECTION 1538 OF THE TUSTIN CITY CODE REGARDING THE AUDIT COMMITTEE Proposed ordinance to modify the residency requirements for members of the Audit Committee. AND RECONVENED AT 9:07 P.M. 20. FISCAL YEAR 2004-2005 MID YEAR BUDGET REVIEW Keith Neves, Sr. Management Analyst presented a recap on the Fiscal Year 2004- 2005 Mid Year Budget. Highlights included: City Council Meeting Minutes February 22, 2005 Page 120f15 General Fund 15% reserve requirement met. Reserve includes monies accumulated in 2002-03 and 2003-04 through expenditure savings. . $1.0 million transferred out to capital improvement projects fund. . Status quo-no new programs or services. . When development fees are excluded, revenue growth is flat since 2002-03. Reflects impact of Propositions 57,58 and Proposition 1A. Recurring state deficits. . State ballot measures. . Governor's Proposal passed on the November ballot. . Constitutional revenue protection. Loss of $1.0 million in General Fund in 2004-05 and 2005-06 (also redevelopment funds). . Reimbursement of $1.2 million in 2006-07. Use of accumulated reserves to offset $2.0 million loss. Future concerns . President is proposing the elimination of the CDBG program and will combine these appropriations with other programs Motion: It was moved by Mayor Pro Tem Davert, seconded by Councilmember Amante to approve the following adjustments to the authorized FY 2004-05 Budget. Motion carried 5-0. 20.a. Approve a supplemental appropriation of $70,000 from the Unappropriated Reserve of the Capital Improvement Projects Fund for City Council Chambers Renovation, CIP Project 1039. The increase will cover the cost of additional construction work needed to complete the project. 20.b. Approve a supplemental appropriation of $122,438 from the Unappropriated Reserve of the Park Development Fund for Pioneer Road Park, CIP Project 2053. The increase will cover the cost of additional construction work needed to complete the project. 20.c. Approve a supplemental appropriation of $60,000 from the Unappropriated Reserve of the Park Development Fund for Centennial Park Renovation, CIP Project 2056. The increase will cover the cost of additional construction work needed to complete the project. 20.d. Approve a supplemental appropriation of $300,000 from the Unappropriated Reserve of the Gas Tax Fund for Irvine/Newport Intersection Enhancement, CIP Project 7118. The increase will cover the cost of additional construction work needed to complete the project. 20.e. Approve a supplemental appropriation of $100,000 from the Unappropriated Reserve of the Measure M Turnback Fund and approve a supplemental City Council Meeting Minutes February 22, 2005 Page130f15 appropriation of $100,000 from the Unappropriated Reserves of the Gas Tax Fund for Red Hill Widening at 1-5, CIP Project 7133. The increase will cover the cost of additional construction work needed to complete the project. 20J. Approve a supplemental appropriation of $150,000 from the Unappropriated Reserve of the Capital Improvement Fund and approve a supplemental appropriation of $150,000 from the Unappropriated Reserves of the Gas Tax Fund for Valencia N. Loop/Armstrong, CIP Project 7139. The increase will cover the cost of various construction related work needed to implement the project while awaiting reimbursement through agreements previously approved by the City Council (IRWD and Marble Mountain Partners). 20.g. Approve a supplemental appropriation of $35,000 from the Unappropriated Reserve of the Measure M Turnback Fund for Edinger Widening: SR55/Red Hill, CIP Project 7147. The increase will cover the cost of additional construction work needed to complete the project 20.h. Approve a supplemental appropriation of $1 ,000,000 from the unappropriated reserves of the General Fund to transfer to the Capital Projects Fund. SECOND PUBLIC INPUT - None OTHER BUSINESS / COMMITTEE REPORTS Councilmember Amante: Congratulated Mayor Bone for receiving "Local Legislator of the Year" award; Congratulated Janet Huston on her new position with Governor Schwarzenegger's administration; Thanked Councilmember Hagen for allowing him the opportunity to sit on the TCA board meeting where they discussed cellular towers along the toll roads; Addressed Tustin Chamber of Commerce at Mid-Year Meeting; noted that they play an active role in the community; Toured hangers at Tustin Legacy over President's Day; Congratulated Dave Kanoti on receiving the Employee of the Year award; and . Thanked staff for assistance in responding to questions and requests. Councilmember Kawashima: Filled in for Mayor at the Friday Night Live Program held at St Joseph Hospital; well attended and encourage residents to get involved in community; and Requested that the Grad Night Donation request be placed on the following Council Agenda. Council member Hagen: Invited all to attend the Miss Tustin Contest on March 5th that will be held at St. Jean's; Informed all that she will be attending a workshop for Orange County Fire Authority in which Medix will be discussed as well as staffing levels on fire engines; and City Councii Meeting Minutes February 22, 2005 Page 140f15 Congratulated Public Works Director Tim Serlet for work related to floods and road conditions after record-breaking rainfall. Mayor Pro Tem Davert: Echoed congratulations to Mayor Bone on receiving "Local Legislator of the Year" award; Received request from Assembly member Todd Spitzer to support of Crime Victim's Bill of Rights; and Informed all that the Orange County Transportation Authority has redefined Measure M to include Train Quiet Zones and asked staff to apply for funding assistance for Tustin Meadows. Mayor Bone: Thanked Mayor Pro Tem Davert and Council member Amante for appearance on CNN; and Congratulated City Manager's wife, Janet Huston on appointment by Governor Schwarzenegger's to Housing Department.
