STACK, DIRECTOR OF PUBLIC WORKS/CITY ENGINEER SUBJECT: AUTHORIZE CONSULTANT SERVICES AGREEMENT FOR THE PREFERENTIAL PERMIT PARKING PROGRAM ON PUBLIC STREETS UPDATE SUMMARY Authorization is requested to execute a Consultant Services Agreement (CSA) with Dixon Resources Unlimited for professional consulting services to update the City's Preferential Permit Parking Program on Public Streets. In July 2019, the City of Tustin solicited proposals from four (4) qualified firms to update the Preferential Permit Parking Program ("project") including policies, procedures and implementation plan to provide neighborhoods with options to help address parking needs on public streets. RECOMMENDATION It is recommended that the City Council: 1. Authorize staff to execute a Consultant Services Agreement with Dixon Resources Unlimited, Inc. in an amount not to exceed $56,775 to cover professional consulting services, and 2. Appropriate $56,775 from the General Fund (Fund 100) for this work. FISCAL IMPACT Staff is requesting the City Council appropriate $56,775 from General Fund Reserves. CORRELATION TO THE STRATEGIC PLAN Fulfillment of the City's Strategic Plan Goal A: Economic and Neighborhood Development. Specifically, strategy #9 to create and implement a plan to address parking problems in neighborhood; and Goal B: Public Safety and Protection of Assets, ensuring Tustin is an attractive, safe and well-maintained community in which people feel pride. BACKGROUND Currently, Tustin has two permit parking policies, one for Old Town and the other for the remainder of the city. The latter policy was enacted in 2008 and the former in 2018. Both policies were amended in February 2019 to allow each eligible residence on a designated permit parking street to obtain at least one permit. This action was the result of the policies' full -utilization of off-street parking requirement that was met with resistance by some residences. The goal for the project is to consolidate these two (2) programs into one (1) program. Award of Contract — Dixon Resources Unlimited October 1, 2019 Page 2 On July 19, 2019, Public Works sent a Request for Proposals (RFP) for professional services for the project to four (4) qualified firms and received three (3) proposals on August 8, 2019. A review board was established of seven individuals comprised of at least one representative from each department associated with permit parking, Public Works, Community Development, Police, and the City Attorney's Office. The evaluation criteria were based on the consultant's ability to perform the specific tasks outlined in the RFP, qualified staff, time commitment towards the project, and previous experience. Fees were provided under separate cover by each firm and opened after final tabulation of scores. Two (2) firms were interviewed, and staff determined the most responsible and qualified firm to provide the Permit Parking Program update was Dixon Resources Unlimited. The proposed fee for this work has been deemed fair and reasonable. As mentioned in the February 2019 staff report and City Council meeting, citywide parking issues will be the subject of future coordinated public workshops, a task that will be led by Dixon. Staff anticipates returning to the City Council with recommendations to update the Preferential Permit Parking Program on Public Streets by mid -2020. Staff is recommending the City Council authorize staff to execute the Consultant Services Agreement with Dixon Resources Unlimited for professional consulting services to update the City's Preferential Permit Parking Program on Public Streets in the amount of $56,775. Saldivar, Dixon Resources Unlimited (DIXON) is pleased to submit this Proposal to the City of Tustin (City) to provide parking consultant services to evaluate the City's current parking permit program and provide recommendations for updated policies, procedures, and implementation strategies, Having collaborated extensively with local municipalities such as Newport Beach, Anaheim, and Seal Beach to transform their parking programs, our firm 'is uniquely qualified to support the implementation of recommendations contained .within this Request for Proposals (RFP). We intend to bridge our knowledge of neighboring parking operations with excellent customer service in order to deliver a cost-effective, and sustainable solution for the City of Tustin, We can easily build upon the work that we have completed in Newport Beach and Anaheim to offer a comparative analysis of permit fees, and similar technology, such as the use of Turbo Data Systems, Inc. for citation processing. In addition, our operations and implementation experience will provide Tustin with reliable recommendations for streamlining permit management procedures. Each of our projects in Newport Beach, Anaheim, and Seal Beach have involved robust. changes to existing municipal codes and permit management systems, including residential permit: parking components. We take pride in our hands-on approach that goes above and beyond a one -size -fits -all solution. Our firm brings the regional expertise from helping to transform the parking experience in Southern California. Beyond the projects listed above, we have worked extensively with the cities of Laguna Beach, Riverside, Oceanside, and. National City, in addition to some of the largest parking programs in the country, including Los Angeles and San Francisco. Our team will take a personal interest in the project, and I will directly oversee community outreach, stakeholder engagement, City Council presentations, and high-level interaction with City staff. We are accustomed to working with tourist -impacted communities where the influx of seasonal visitors further drives peak parking demand, and our project references highlight the range of programs that have benefited from our services, including several projects that have been coordinated through Police Departments. I started my career as a parking enforcement officer with the Santa Barbara County Sheriff's Department. IMITED Section 2. Project Approach DIXON has developed the following workplan to address the technical approach, methodology, and specific tasks that will be performed as part of the Scope of Work detailed in the Request for Proposals (RFP). Below is a summary of the deliverables associated with each task, however, it should be noted that the DIXON team is adaptive and flexible to the City's needs. We will work with the City and, based upon the evolution of the Project, we will adjust our deliverables to ensure ongoing alignment with project goals and overall project plan priorities. Upon Contract Award by Council, we can proceed immediately with the project kickoff meeting. and scheduling of the Operational Needs Assessment (Task 1). The current project is scoped for three to four months from the Notice to Proceed, though the robustness of the community outreach plan and level of stakeholder Involvement will dictate the City's ability to finalize updates to the permit parking program. DIXON will work at the City's direction to adjust our schedule, and we will dedicate the required resources and staff to adhere to any internal deadlines and achieve the City's goals. Task 1, On -Site Operational Needs Assessment The primary goal of the Operational Needs Assessment will be to identify the immediate policies, procedures, and1mplementation plan necessary to develop and finalize the City's permit parking program updates. An initial project kickoff meeting will allow DIXON to prioritize objectives and tasks, finalize the schedule, and request background data from the City. During this phase, DIXON will achieve: a thorough understanding of site context in order to clarify the City's short, medium, and long-term planning horizons. The kick-off meeting will introduce key internal stakeholders to the DIXON team, allowing each member's role to be thoroughly communicated to all parties. DIXON will prepare and distribute an agenda and minutes for the kick-off meeting. In coordination with City staff, DIXON will work to obtain all relevant data to assist with the project including, but not limited to, parking counts, staffing reports, City Council agenda reports, and existing parking management strategies. We will examine all relevant material, current vendor agreements, and/or strategic planning documents in order to prepare for the on-site assessment, Based on our understanding of the project, we do not envision that additional data collection, beyond what can be provided by the City, will be necessary. During a two-day on-site assessment, our team will meet with internal stakeholders and representatives from the Police Department, Finance Division, Community Development, Public Works, and/or the City Manager's Office to discuss potential challenges to overhauling the current program and ,planning for the long-range redevelopment of the marine base. Our team will examine existing vendor contract details and discuss recommendations for revamping the permit parking program. We will evaluate the City's existing permit parking program with an emphasis on the residential streets and areas of Old Town affected by permit - Dixon Resources Unlimited I Proposal for Professional Consulting Services 3 DIX-ON € Fr ;t1JRt:; UNIt 1MITCD only parking. The assessment will include a comparative review addressing technology, staffing, and organizational requirements across core functional areas such as finance, asset management, operations, maintenance, and workforce management, with the understanding that the City's policies and rates will need to be modified to optimize the parking system and improve the public's perception of the permit parking program. Our process will support an open and. transparent relationship with internal stakeholders that ensures collaboration with the City. We will discuss recent policy changes, such as the Council's decision to allow for the issuance of one permit with no regard for full utilization of on-site parking, and how this may inform the process for gathering additional resident feedback. We will solicit comment from the City to coordinate strategies and identify internal resources that will be: needed to support the implementation of any proposed program updates. While on site during the operational assessment; DIXON will begin the public outreach process by engaging community stakeholders and scheduling workshops and/or meetings, as described in the Community Outreach Plan (Task 3). DIXON will schedule bi-weekly project update conference calls with designated staff to provide status .updates and work through any issues. that may arise throughout the course of the project. Furthermore, we envision that the results from the Operational Needs Assessment can serve as the basis for additional recommendations in the future, should the City decide to expand the scope of its long-range parking program. Task 2. Draft Permit Parking Program Updates Upon completion of the Operational Needs Assessment (Task 1), and in coordination with the Community Outreach process (Task 3), DIXON will identify and evaluate parking recommendations that will constitute the City's "draft:' permit parking program updates. Project deliverables for this task will include municipal code updates, financial analysis of permit fees, the preparation of permit program maps, and the development of general recommendations, as described below. Wherever possible, these recommendations will account for both short-term and long-term priorities based on projected parking demand over the next ten years, parking and transportation. trends, and community willingness, DIXON will identify steps that the City may undertake to ' future -proof its parking system and plan for the overall public benefit. These recommendations will include the following: • Recommendations to streamline the "parking zone" approval process and allow it to be more administrative at the City staff level, rather than requiring City Council approval • Recommendations for permit administration, issuance and renewal, associated costs, and options for implementation; • Recommendations for ordinance and municipal code updates that are consistent with California law. DIXON will work with City legal staff to conduct a thorough municipal ordinance review to determine adjustments/red-line edits that will "future -proof' code language to prepare the City for the implementation and management of a revamped permit program. Our extensive experience working with California cities will allow us to identify potential issues and address gaps in the existing code. Drawing from previous Dixon Resources Unlimited ( Proposal for Professional Consulting Services 4 DI XON RESOURCES UNLIMITED experience in the City of Seal Beach and other nearby municipalities, we will compile all relevant code sections and provide a revised version for consideration. This will include Instances where the City may be able to simplify municipal language to improve program efficiency or establish zones and hours of operation for future zone -based parking management opportunities; • Recommendations based on lessons learned from other cities in the region. We have included local project references from Newport Beach and Anaheim to emphasize our familiarity with parking programs in Orange County. Using these cities, as well as other Southern California municipalities of similar size, demographics, and mixed-use downtowns, we will identify comparable permit rates; • Recommendations based on parking time prohibitions and related issues/challenges, as determined from the Operational Needs Assessment; • Recommendations for potential parking partnerships with private and/or public entities. We have extensive experience structuring shared parking agreements, and we understand the practical and political realities of negotiating a community of diverse stakeholders. In the City of San Leandro, DIXON is currently leveraging shared parking agreements to improve parking management, part of an array of services that helped the City earn the title of 2018 Public Parking Program of the Year by the California Public Parking Program (CPPA); • Recommendations for improving the petition submittal process including, but not limited to, determining who submits a petition, required coordination/management attempts prior to submission, outreach, signature requirements, and any associated processing fees; • Recommendations for the permit parking process including, but not Limited to, determining procedures for required surveys, survey methods, number and frequency of surveys, number of permits -per property, renewal review, and associated costs; • Recommendations for enforcement including fines, towing, and administration. Duringthe Operational Needs Assessment, DIXON will discuss options for enforcement with Internal stakeholders, including pros, cons, and methods of cost recovery. We have extensive experience working with municipalities that use Turbo Data Systems, Inc. for citation processing services (Anaheim) and for both citation and permit processing services (Newport Beach); • Recommendations for providing parking infrastructure and parking assessment districts;. • Detailed maps that illustrate trends or patterns of parking within the City relating to existing developments, permit parking areas, and land uses, based upon existing data; • Financial analysis of the City's existing and proposed residential permit parking program and determination of applicable permit fees; and, • Recommendations for how to move forward with streets currently subject to permit parking and how to implement transition strategies. Task 3. Community Outreach Plan (Public Meetings & Workshops) Ongoing community input will be an essential part of this project. DIXONwill assume a leadership role in coordinating a public involvement strategy to ensure inclusion and transparency with a broad range of stakeholders, including external groups and those residents who have a stake in Dixon Resources Unlimited I Proposal for Professional Consulting Services 5 the future of the City's permit parking program. By opening up the dialogue to a range of community groups, the City has the opportunity to achieve buy -in and enable stakeholders to become advocates of the preferred solution. We envision this process occurring in a total of three site visits, the first of which may be combined with the on-site engagement during the Operational Needs Assessment (Task 1). During the first site visit, DIXON will meet with various external stakeholders during workshop meetings with interested parties. Workshop meetings will provide an opportunity for stakeholder groups to focus on the specific parking needs and challenges that impact them. Focus groups could include, but are not limited to, residents, business owners, apartment association representatives, and property developers. The City may also assemble a core group with representative community members to form a Parking Steering Committee for a collaborative discussion with DIXON about parking in Tustin. If desired by the City, DIXON will issue an online survey, advertised through social media, in order to maximize stakeholder participation. DIXON will develop online survey questions that inquire about community demographics,, parking perceptions, parking needs, and solicit feedback for incorporation into the overall recommendations. Online survey results will be summarized and included in future stakeholder outreach presentationsfor reference. Following completion of the first round of internal and external stakeholder engagement, DIXON will return for a second site visit to present any findings to various stakeholder workshop groups, including an overview of parking management options and ideas based upon feedback and findings from the initial site visit. At the conclusion of the process, DIXON will return for a third site visit to present the findings and recommendations to various stakeholder workshop groups and internal City staff. DIXON intends to share any recommendations/municipal code changes with stakeholders in advance of the meeting to provide ample time for circulation and review prior to finalization. If appropriate to the, schedule, DIXON will coordinate at least one public workshop to coincide with a City Council meeting/presentation. ACORD 25 (201401) The ACORD name and logo are registered marks of ACORD ATTACHMENT 2 Consultant Services Agreement (Sample) CONSULTANT SERVICES AGREEMENT THIS AGREEMENT FOR CONSULTANT SERVICES, is made and entered into this day of 20 , by and between the CITY OF TUSTIN, a municipal corporation, hereafter referred to as "City", and Dixon Resources Unlimited, a California corporation, hereinafter referred to as "Consultant". RECITALS WHEREAS, City requires the services of a consultant to furnish the necessary Consultant Engineering Services for a comprehensive Citywide Permit Parking Program on Public Streets including policy, procedures and implementation plan hereinafter referred to as "Project"; and WHEREAS, City requires this service in the Public Works Department in order to update the Citywide Permit Parking Program; and WHEREAS, Consultant has submitted to the City a proposal dated August 8, 2019, a copy of which is attached hereto, marked as Exhibit "A" and is by this reference incorporated into this Agreement; and WHEREAS, Consultant is qualified to provide the necessary services for the Project and desires to provide said services to City; and WHEREAS, City desires to retain the services of Consultant for said Project. NOW, THEREFORE, for the consideration and upon the terms and conditions hereinafter set forth, the parties agree as follows: AGREEMENT Section 1: Scope of Consultant's Services Consultant shall perform all work necessary to complete in a manner satisfactory to City, the services set forth in Exhibit "A" in accordance with the terms and conditions of this Agreement. Section 2: Order of Precedence In the event of a conflict between or among any of the documents comprising this Agreement, the following order of precedence shall govern the provision in question: 1. This Agreement 2. Consultant's Proposal (Exhibit "A") Section 3: Time for Completion The time for completion of the work to be performed by Consultant is an essential condition of this Agreement. Consultant shall prosecute regularly and diligently the work of this Agreement according to the reasonable schedule mutually established between the City and the Consultant for various items described and as outlined within Consultant's proposal. Consultant shall not be accountable for delays in the progress of its work caused by any condition beyond its control and without the fault or negligence of Consultant. Section 4: Compensation A. The compensation to be paid under this Agreement shall be as set forth in Exhibit "A", which shall not exceed a total cost of $56,775. B. Consultant shall submit detailed invoices, based upon the actual work performed accompanied by backup documentation as requested by the City. C. Progress payments for work completed shall be paid by City as the work progresses, within thirty (30) days of the date of Consultant's invoice. D. Consultant shall provide City with a monthly itemization of all work performed, and the fees accrued thereon, in complete and sufficient detail to fully apprise City thereof. Section 5: Independent Contractor Consultant's relationship to City in the performance of this Agreement is that of an independent contractor. Consultant's personnel performing services under this Agreement shall at all times be under Consultant's exclusive direction and control and shall be employees of Consultant and not employees of City. Consultant shall pay all wages, salaries and other amounts due its employees in connection with this Agreement and shall be responsible for all reports and obligations respecting them, such as social 2 security, income tax withholding, unemployment compensation, worker's compensation and similar matters. Section 6: Indemnification Consultant agrees to indemnify, defend and hold City, its officers, agents, employees, successors and assigns harmless from any loss, damage, injury, sickness, death, or other claim made by any person and from all costs, expenses and charges including attorney's fees caused by or arising out of Consultant's, its officers', agents', subcontractors', or employees' negligent acts, negligent errors, or negligent omissions or willful misconduct, or conduct for which the law imposes strict liability on Consultant in the performance or failure to perform this Agreement. Section 7: Insurance A. Consultant shall maintain in full force and effect during the term of this Agreement policies of commercial general liability and automobile liability insurance (each of which shall include property damage and bodily injury) and each with limits of at least $1,000,000 combined single limit coverage per occurrence. B. Consultant shall maintain in full force and effect during the term of this Agreement a policy of professional liability insurance coverage with limits of at least $1,000,000 combined single limit coverage per claim or per occurrence. If Consultant provides claims made professional liability insurance, Consultant shall also agree in writing either (1) to purchase tail insurance in the amount required by this Agreement or to cover claims made within five (5) years of the completion of Consultant's service under this Agreement, or (2) to maintain professional liability insurance coverage with the same carrier, or with an equivalent carrier in the amount required by this Agreement for at least five (5) years after completion of Consultant's services under this Agreement. Consultant shall also provide evidence to the City of the purchase of the required tail insurance or continuation of the professional liability policy by executing the attached Letter Agreement on Consultant's letterhead. C. Consultant shall carry and pay for such workers' compensation insurance as is required to fully protect Consultant and its employees under California Worker's Compensation Insurance Law. The insurance company shall agree to waive all rights of subrogation against the City for losses paid under the policy, which losses arose from the work performed by the named insured. D. Other applicable insurance requirements are: (1) Name the City, its officials and employees as additional insured on the commercial general liability and automobile liability insurance policies. (2) The insurance shall be issued by a company authorized by the Insurance Department of the State of California and 3 rated A, VII (seven) or better (if an admitted carrier) or A-, X (ten) or better (if offered by a surplus line broker), by the latest edition of Best's Key Rating Guide, except that the City will accept workers' compensation insurance rated B-, VII (seven) or better, or from the State Compensation fund. (3) The insurance shall not be cancelled, except after thirty (30) days written prior notice to the City; and (4) The commercial general liability and automobile liability insurance shall each be primary as respects the City, and any other insurance maintained by the City shall be in excess of this insurance and not contribute to it. E. Upon execution of this Agreement, Consultant shall provide to City certificates of insurance and insurer endorsements evidencing the required insurance. Insurer endorsements (or a copy of the policy binder if applicable) shall be provided as evidence of meeting the requirements of Subsections (1)(3) and (4) of Section 7D above and the waiver of subrogation requirement in Section 7C above. If self- insured for worker's compensation, Consultant shall submit to City a copy of its certification of self-insurance issued by the Department of Industrial Relations. Section 8: Termination of Agreement A. City and Consultant shall each have the right to terminate any or all of the services covered by this Agreement at any time or any reason by giving ten (10) business days written advance notice to the other party. B. Upon termination of this Agreement, Consultant shall be paid for services rendered by the effective date of the termination. C. Upon termination of this Agreement or completion of the Project, all documents relating to the Project shall become the sole property of City. Should City terminate this Agreement pursuant to subparagraph A. of this Section, Consultant shall within ten (10) business days of receipt of notice of termination, provide City with all documents within Consultant's possession relating to this Agreement and the Project, including but not limited to all completed documents and all drafts of uncompleted documents. Section 9: Notice Any notice allowed or required to be given shall be effective upon personal delivery thereof, or upon depositing thereof in the United States Postal Service, certified mail, upon receipt requested, postage prepaid, addressed as follows: 2 To City: City of Tustin Douglas S. Consultant shall proceed immediately and diligently to perform the services provided for in this Agreement upon receipt of notice from City to proceed therewith. B. No part of this Agreement may be assigned by Consultant without the prior written approval of City. C. This Agreement shall extend to and be binding upon and inure to the benefit of heirs, executors, administrators, successors and assigns of the respective parties hereto. D. Consultant shall perform all services required under this Agreement using that degree of care and skill ordinarily exercised under similar conditions in similar localities, and shall be responsible for all errors and omissions for services performed by Consultant under the terms of this Agreement. E. Consultant certifies that there shall be no discrimination against any employee who is employed in the work covered by this Agreement, or against any application for such employment, because of race, religion, color, sex, or national origin including but not limited to, the following: employment, upgrading, demotion or transfer, recruitment, or recruitment advertising, lay-off or termination, rate of pay or other forms of compensation, and selection for training, including apprenticeship. F. This Agreement shall be interpreted in accordance with California Law. The parties agree that the Orange County Superior Court is the .exclusive venue for any lawsuits by either party regarding this Agreement.
