JORDAN, CHIEF OF POLICE TO: SUBJECT: JUSTICE ASSISTANCE GRANT (JAG) PROGRAM SUMMARY Congress established the Byrne Justice Assistance Grant (JAG) program in the 2005 Omnibus Appropriations Package. The JAG program blends the previous Edward Byrne Formula Grant (Byrne) and the local law Enforcement Block Grant (llEBG) programs into one new program, which is intended to provide agencies with the flexibility to prioritize and place justice funds where they are most needed. The Police Department proposes to use the 2005-2006 JAG funds to provide supplemental funding to the Proactive Methamphetamine Task Force (PROACT) and to purchase additional communications equipment, specifically hand-held radios. RECOMMENDATION 1. Open and close a Public Hearing. 2. Authorize usage of the funds as recommended by the Police Department. FISCAL IMPACT The grant award is in the amount of $25,984.00 and does require a matching amount of $389.78, for a total appropriation of $26,373.78. BACKGROUND In the late 1990's, the Proactive Methamphetamine Task Force (PROACT) was formed and is comprised of personnel from several municipal police agencies, agents from the State Bureau of Narcotics Enforcement, the Orange County Sheriff's Department, the Orange County Probation Department, and the Orange County District Attorney's office. This task force was funded by Byrne grant funds and allowed for reimbursement of an officer's time, equipment, and the clean-up of methamphetamine labs. These labs have extremely hazardous materials and require special handling not only for clean-up, but for prosecution of those responsible for operating the lab. . Mr. William A. Huston, City Manager Justice Assistance Grant (JAG) Program April 4, 2005 Page 2 While not every Orange County agency is represented on the PROACT task force, the Orange County Chiefs' of Police have agreed that the continued operation of the PROACT task force is a high priority that benefits all Orange County cities. The 2004-2005 funding for PROACT in Byrne funds was $1.2 million. As a result of the new process in combining Byrne funds and LLEBG funds to become the Byrne JAG program, this amount was reduced to $823,000.00 leaving a $377,000.00 shortfall. The Byrne JAG funds designated for the City of Tustin for 2005-2006 is $25,984.00, significantly less than in most past years. The majority of Orange County cities that are receiving Byrne JAG funding are designating 41 % of their funding to supplement the shortfall in funding for the PROACT task force. For Tustin, this represents a commitment of $10,654.00 of the total JAG funds available. This is a worthwhile expenditure to insure that methamphetamine labs in Orange County continue to be investigated and cleaned up at minimal costs to each city. The Police Department supports the commitment of these funds to the PROACT task force. The Police Department recommends that the balance of the JAG grant funds be used to purchase four (4) Motorola hand-held radios. It is the goal of the Police Department to eventually have enough hand-held radios to allow for each patrol officer to be assigned a designated radio and to provide for an available pool of radios for use by all other field and support personnel. We have received an estimate from our Motorola radio vendor for the purchase of these radios at a total cost of $15,719.78. The balance of the JAG funds available after funding the PROACT task force is $15,330.00. To complete the purchase of these radios will require the City of Tustin to provide a matching funding of $389.78. The Orange County Sheriff's Department has been designated as the lead agency for the JAG grant application. If the recommended funding is approved, a representative from the Sheriff's Department will contact the City Manager for the necessary signatures on the MOU for this grant.
