RESOLUTION NO. 05-55 MODIFYING CERTAIN FEES AND
SERVICE CHARGES BY THE PARKS AND RECREATION
DEPARTMENT
SUMMARY:
A revised fee schedule is proposed for the Parks and Recreation Department to recover
the cost of providing certain specified services. The revisions would be effective on July
1, 2005.
RECOMMENDATION
Adopt Resolution No. 05-55 modifying certain fees and service charges.
FISCAL IMPACT
The recovery of a majority of the costs incurred when providing special services or
facilitating the private use of public facilities.
BACKGROUND:
Staff has conducted an intensive study of fees charged for renting City buildings and
recreation facilities. This analysis has considered all costs for accommodating facility
renters including utilities, supplies, capital upkeep, insurance and personnel necessary
to manage a rental.
At the February 16, 2005 meeting, the Parks and Recreation Commission considered
the proposed fee revisions. At this meeting, the Commission voted unanimously to
recommend that the City Council approve the revisions.
DISCUSSION:
The Parks and Recreation Department's current fee schedule has been in effect since
1997.
Staff periodically reviews the existing fees for various specialized services provided
upon request. The attached resolution is the result of a recent review and mainly
contains housekeeping changes such as facility rental fees, etc.

In order to determine fees to be charged, as well as to determine building scheduling
priority, the following categories reflect our facility use policies:
INTER-GOVERNMENTAL AGENCY: This includes Parks and Recreation programs,
youth sponsored activities coordinated by our local school district, other governmental
agencies, such as the Sheriff's Department, Health Services Agency, Highway patrol,
League of California Cities, etc.
RESIDENT NON-PROFIT: This includes youth recreational activities open to the
public, initiated or sponsored by local non-profit organizations whose memberships
consist of at least 50% Tustin residents. It also includes adult recreational activities
sponsored by local non-profit organizations whose memberships consist of at least
50% Tustin residents.
RESIDENT PRIVATE: This includes resident youth and adult recreation activities
where registration is not open to the general public; for example, a resident's private
party.
NON-RESIDENT NON-PROFIT: These rates are determined by the use of our facilities
for non-resident recreational activities initiated or sponsored by non-profit organizations
whose memberships are less than 50% Tustin residents.
NON-RESIDENT PRIVATE: These rates are for recreational activities not open to the
general public in which they do not meet our residency requirement.
COMMERCIAL: This is for use by commercial businesses and those activities and
organizations that are profit-making. Individuals or organizations that cannot provide
proof of non-profit standing, and are organizing events at which fees are charged or
donations are solicited.
Fees are intended to offset the cost of maintaining facilities and proving staff. However,
the fee amounts for a number of services are significantly lower than the actual cost of
providing those services.
The hourly rates and fee increases range between $3 and $11 per hour. For example,
in the Private Resident category, the old hourly rate for the use of the Senior Center
Auditorium was $67 per hour; the new hourly rate is $74 per hour. The increase in the
categories affected averages 8%. Again, rates have not been adjusted since 1997.
It has been past practice, pursuant to City Council policy, that fee waivers be granted to
certain inter-governmental agencies, youth sports organizations and non-profit groups
for the use of City sports fields and facilities. For example, field use by youth sports
organizations is not charged the regular rental rate; lights and field usage are waived.
Since July 1, 2004, a total of $177,491.75 has been waived for park, building and senior
center rentals.

Rental rates were calculated on the following basis:

personnel to manage the rental;

SERVICE CHARGES FOR THE DEPARTMENT OF PARKS
AND RECREATION
I.
The City Council finds and determines
A.
There are a number of services provided by the City that are of primary
benefit to certain individuals.
B.
The costs of these services should be borne by the individuals receiving
benefit from such services.
C.
The City can account for actual costs of these services.
II. The following sections containing fees and service charges are hereby
established and supersede certain existing fees, and shall be applied uniformly except
where, in the discretion of the City Manager, reduced fees are justified by special
circumstances.
