2 A R ESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TUSTIN APPROVING TENTATIVE PARCEL MAP 97-164
3 LOCATED IN JAMBOREE PLAZA ON THE NORTHWEST CORNER
OF JAMBOREE ROAD AND EDINGER AVENUE.

The City Council of the City of Tustin does hereby resolve as
5 follows:
6 I. The City Council finds and determines as follows:
7 A. That Tentative Parcel Map 97-164 was submitted to
the City Council by California Pacific Equities for
g consideration;
9 B. That a public hearing was duly called, noticed and
held for said map on October 27, 1997 by the
10 Planning Commission and on November 3, 1997 by the
City Council;

C. That the Tiered Negative Declaration for the
12 Jamboree Plaza District Regulations, has been
certified in conformance with the requirements of
13 the California Environmental Quality Act for the
subject project;
14
D. That the proposed subdivision is in conformance
15 with the Tustin Area General Plan and Subdivision
Map Act as it pertains to the development of
16 commercial and industrial properties;
17 E. The impacts associated with this approval on School
District facilities are adequately addressed.

F. That the site is physically suitable for the-type
19 of development proposed;
20 G. That the site is physically suitable for the
proposed density of development;
21
H. That the design of the subdivision or the proposed
22 improvements are not likely to cause substantial
environmental damage or substantially and avoidably
23 injure fish or wildlife in their habitat;
24 I. That the design of the subdivision or the type of
improvements proposed will not conflict with
25 easements acquired by the public, for access
through or use of the property within the proposed
26 subdivision;
27 J. That. the design of the subdivision or the types of
improvements proposed are not likely to cause
28 serious public health problems;

3 K. The proposed project has been reviewed for conformity
with the provisions of the Orange County Congestion
4 Management Program, and it has been determined. that
the additional traffic generated by the proposed
5 project onto the CMP Highway System does not cause the
system to exceed established level of service
6 standards (ELS); and,
7 L. That the project has been reviewed for consistency
with the Air Quality Sub-Element of the City of Tustin
8 General Plan and has been determined to be consistent
or has been conditioned to be consistent with the Air
9 Quality Sub-Element.
10 II. The City Council hereby approves Tentative Parcel Map No.
97-164, subject to the conditions contained in Exhibit A of
11 Planning Commission Resolution No. 3556, incorporated
herein by reference.

PASSED AND ADOPTED at a regular meeting of the Tustin City
13 Council, held on the 3rd day of November, 1997.

Council of the City of Tustin, California, do hereby certify
22 that the whole number of the members of the City Council of the
City of Tustin is five; that the above and foregoing Resolution
23 No. 97-109 was duly passed and adopted at a regular meeting of
the Tustin City Council, held on the 3rd day of November, 1997,
24 by the following vote:
