RESOLUTION NO. 89-37
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN,
CALIFORNIA, RECOMMENDING THAT A JOINT POWERS AGREEMENT
OR MEMORANDUM OF UNDERSTANDING CONCERNING TRANSPOR-
TATION PLANNING BE EXECUTED IN LIEU OF CONSOLIDATING THE
ORANGE COUNTY TRANSPORTATION COMMISSION AND ORANGE
COUNTY TRANSIT DISTRICT
The City Council of the City of Tustin does hereby resolve as
follows:
WHEREAS., the League of California cities, Orange County
Division, the Orange County Transportation Commission (OCTC), the
Orange County Transit District (OCTD) and the Board of Supervisors
have been discussing whether OCTC and OCTD should be consolidated;
and
WHEREAS, the proponents of consolidation have represented that
consolidation will cause transportation planning and public
transportation services to be provided in a more efficient and
effective manner; and
WHEREAS, there are no studies which substantiate that
consolidation of OCTC and OCTD will result in more efficient and
effective transportation planning and public transportation
services or that planned major street and freeway projects will be
completed in a more timely manner; and
WHEREAS, through the efforts of the League of California
Cities, Orange County Division, and OCTC, the cities and the County
of Orange have spent considerable time and effort in preparing
reports on needed transportation improvements, including the
League's "Super Committee" report and the OCTC 20-Year Master Plan
of Transportation Improvements; and
WHEREAS, through these efforts, it has been clearly
demonstrated that existing public agencies are committed to and
capable of proceeding with plans and projects to improve all
aspects of transportation systems serving Orange County; and
WHEREAS, close coordination among the agencies responsible for
planning, funding and carrying out transportation projects and
improvements will need to continue in order to successfully deal
with the'transportation needs of Orange County.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the
City of Tustin recommends that a Joint Powers Agreement (JPA) or
Memorandum of Understanding (MOU) be executed that would include,
but not be limited to, OCTC, OCTD, the League of California Cities,
Orange County Division, and the Board of Supervisors;

BE IT FURTHER RESOLVED that the purpose of a JPA or MOU would
be to build upon the effectiveness of existing agencies responsible
for transportation planning, services and projects through formal
acknowledgement of the cooperative efforts that exist and need to
continue into the future;
BE IT FURTHER RESOLVED that OCTC and OCTD should retain their
current status but should formally continue their cooperative
efforts through a JPA or MOU~ thereby assuring the public that
public transportation planning and services will be planned and
provided through a coordinated effort;
BE IT FURTHER RESOLVED that the League of California Cities,
Orange County Division, and the Board of Supervisors participation
]] in the JPA or MOU will assure that agencies responsible for the
construction and maintenance of transportation projects will be
participants in developing regional transportation policies and
programs that benefit all citizens of Orange County;
BE IT FURTHER RESOLVED that the League of California Cities,
Orange County Division, the Board of Supervisors, OCTC and OCTD
should proceed as quickly as possible to draft a JPA or MOU that
represents the interests of all agencies involved in transportation
and formally continues the existing efforts of these agencies to
cooperatively resolve the transportation problems of Orange County.
PASSED AND ADOPTED at a regular mee'ting of the City Council
of the City of Tustin, held on the 6th day of March, 1989.
