HomeMy WebLinkAboutCC RES 97-108 1 RESOLUTION NO. 97-108 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN FINDING THAT THE TIERED NEGATIVE DECLARATION 3 PREPARED FOR THE JAMBOREE PLAZA DISTRICT REGULATIONS IS ADEQUATE FOR ZONE CHANGE 97-002, 4 TENTATIVE PARCEL MAP 97-164 AND DESIGN REVIEW 97.- 016. APPLICABLE MITIGATION MEASURES HAVE BEEN 5 INCORPORATED AS REQUIRED BY THE CALIFORNIA ENVIRONMENTAL QUALITY ACT. 6 The City Council of the City of Tustin does hereby resolve as 7 follows: 8 I. The City Council finds and determines as follows: 9 A. That Zone Change 97-002, Tentative Parcel Map 97- 164 and Design Review 97-016 and respective 10 development plans are considered "projects" pursuant to the terms of the California 11 Environmental Quality Act; and, 12 B. That the projects are covered by a previously certified Negative Declaration for the Jamboree 13 Plaza District Regulations which serves as the basis for a Tiered Negative Declaration for the 14 proposed project. 15 II. The Jamboree Plaza District Regulations Negativ~ Declaration, previously certified on June 3, 199l, was 16 considered prior to approval of this project. The City Council hereby finds: that this project is similar in 17 scope to the Jamboree Plaza District Regulations previously approved; the effects of this project, 18 relating to grading, drainage, circulation, public services and utilities, were examined in the both the 19 June 1991 Negative Declaration and the Tiered Negative Declaration. The applicable mitigation measures and 20 .alternatives developed in the June 1991 Negative Declaration and. the Tiered Negative Declaration are 21 incorporated into this project. The Tiered Negative Declaration based on the previously certified Jamboree 22 Plaza District Regulations Negative Declaration is, therefore, determined to be adequate to serve as the 23 environmental documentation for this project. and satisfies all requirements of the California 24 Environmental Quality Act. 25 26 27 28 t Resolution No. 97-108 Page 2 2 Further, the City Council finds the project' involves no 3 pQtential for any adverse effect, either individually or cumulatively, on .wildlife resources; and, therefore, 4 makes a De Minimis Impact Finding related to Fish and Game Code Section 711.4. 5 Applicable mitigation measures identified in the Tiered 6 Negative Declaration have been incorporated into this project which mitigate potential significant 7 environmental effects thereof. The mitigation measures are identified as Conditions on Exhibit A of Planning 8 Commission Resolution No. 3556 r~commending approval of Tentative Parcel Map 97-164 and Exhibit A of Planning 9 Commission Resolution No. 3557 approving Design Review 97-014. 10 PASSED ANDADOPTED by the City CounCil of the City of Tustin, 11 at a regular meeting on the 3rd day of November, 1997.
