HUSTON, CITY MANAGER PUBLIC WORKS DEPARTMENT/ENGINEERING DIVISION TO: SUBJECT: FREEWAY AGREEMENT NO. 12-0RA-55 KP 13.7/16.4 WITH THE STATE OF CALIFORNIA (CAl TRANS) INCORPORATING THE REALIGNED SR-55 NORTHBOUND EDINGER AVENUE ON AND OFF RAMPS PROPOSED BY THE NEWPORT AVENUE EXTENSION/SR-55 RAMP RECONFIGURATION PROJECT (CIP NO. 7130) INTO THE STATE HIGHWAY SYSTEM SUMMARY The Freeway Agreement between the City of Tustin and the State of California (Caltrans) pertains to State Route 55 (SR-55) from Warner Avenue to 0.3 kilometers north of McFadden Avenue. The current Freeway Agreement with Caltrans was executed on February 3, 1986. The subject Freeway Agreement supersedes the current Freeway Agreement and revises the map of the freeway system to include the realigned SR-55 northbound Edinger Avenue on and off ramps proposed by the Newport Avenue Extension/SR-55 Reconfiguration Ramp Project (CIP No. 7130). RECOMMENDATION It is recommended that the City Council approve Freeway Agreement No. 12-0RA-55 KP 13.7/16.4 with the State of California (Caltrans), and authorize the Mayor and City Clerk to execute the Agreement on behalf of the City. FISCAL IMPACT The Freeway Agreement acknowledges the realignment of the SR-55 northbound Edinger Avenue on and off ramps. Funds to accomplish the construction related to this realignment are funded within the current CIP No. 7130 budget in the amount of $11,041,838. This project is funded from a combination of Measure "M" Turnback funds, Measure "M" Competitive funds, Water Capital Improvement Program funds, Developer Bond funds, Developer Cash Payment funds, and Tustin Community Redevelopment Agency-South Central funds. BACKGROUND Freeway Agreement No. 12-0RA-55 KP 13.7/16.4 supersedes in its entirety the current Freeway Agreement between the City of Tustin and the State of California dated February 3, 1986. The subject Freeway Agreement provides for the realigned SR-55 northbound Edinger Avenue on and off ramps that are part of the Newport Avenue Extension/SR-55 Ramp Reconfiguration Project (CIP No. 7130) to be incorporated into the State Highway Freeway Agreement No. 12-0RA-55 KP 13.7/16.4 with the State of California (Caltrans) Incorporating the Realigned SR-55 Northbound Edinger Avenue Ramps Proposed by the Newport Avenue Extension/SR-55 Ramp Reconfiguration Project (CIP No. 7130) into the State Highway System May 2, 2005 Page 2 System. The subject Freeway Agreement outlines that the construction of CIP No. 7130 will be a locally funded project. Any future revisions to the SR-55 Freeway within the City of Tustin will be paid for by the State of California, including any right-of-way acquisition, unless the City agrees to financially participate in future revisions. This is the basic language contained in the current Freeway Agreement dated February 3, 1986. The City Attorney has reviewed the Freeway Agreement and has approved it as to form. ~-?~ fP~ Tim D. Attachment: Freeway Agreement 12-0RA-55 KP 13.7/16.4 (PM R8.5/1O.2) In the City of Tustin on Route 55 From Warner Avenue to 0.3 Ian north of McFadden Avenue FREEWAY AGREEMENT THIS AGREEMENT, made and entered into on this day of ,2005, by and between the STATE OF CALIFORNIA acting by and through the Department of Transportation (herein referred to as "STATE"), and the City of Tustin (herein referred to as "CITY"), WITNESSETH: WHEREAS, the highway described above has been declared to be a freeway by Resolution of the California Transportation Commission on March 17, 1954; and WHEREAS, STATE and CITY have entered into a Freeway Agreement, dated February 3, 1986, relating to that portion of Route 55 from KP R13.7 (Warner Avenue) to KP 16.4 (0.3 Ian north of McFadden Avenue); and WHEREAS, a revised plan map for such freeway has been prepared showing the proposed plan of the STATE as it affects streets ofthe CITY; and WHEREAS, it is the mutual desire of the parties hereto to enter into a new Freeway Agreement in accordance with the revised plan of said freeway; NOW, THEREFORE, IT IS AGREED: (I) This Agreement supersedes in its entirety said Freeway Agreement, dated February 3,1986. (2) CITY agrees and consents to the closing of CITY streets, relocation of CITY streets, construction of frontage roads and other local streets, and other construction affecting CITY streets, all as shown on the plan map attached hereto marked Exhibit A and made a part hereof by this reference. (3) Except as noted in the attached exhibit, STATE shall, in the construction of the freeway and at STATE's expense, make such changes affecting CITY streets in accordance with the plan map attached hereto marked Exhibit A, except as (4) (5) (6) (7) provided for in subsequent cooperative agreements with CITY specifying construction participation. Except as noted in the attached exhibit, STATE agrees to acquire all necessary right of way as may be required for construction, reconstruction, or alteration of CITY streets, frontage roads, and other local streets, and CITY hereby authorizes STATE to acquire in its behalf all such necessary right of way, except as provided for in cooperative agreements with CITY specifying right of way participation. It is understood between the parties that the right of way may be acquired in sections or units, and that both as to the acquisition of right of way and the construction of the freeway projects, the obligations of STATE hereunder shall be carried out at such time and for such unit or units of the projects as funds are budgeted and made lawfully available for such expenditures. CITY will accept control and maintenance over each of the relocated or reconstructed CITY streets, and the frontage roads, and other STATE constructed local streets on receipt of written notice to CITY from STATE that the work thereon has been completed, except for any portion which is adopted by STATE as a part of the freeway proper. CITY will accept title to the portions of such streets lying outside the freeway limits upon relinquishment by STATE. This Agreement may be modified at any time by the mutual consent of the parties hereto, as may become necessary for the best accomplishment, through STATE and CITY cooperation, of the whole freeway project for the benefit of the people of the STATE and of the CITY. 2 IN WITNESS WHEREOF, the parties hereto have caused this Agreement to be executed by their respective duly authorized officers.
