HomeMy WebLinkAboutCC RES 97-104 1 RESOLUTION NO. 97-104 2 3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN FINDING THAT THE FINAL ENVIRONMENTAL IMPACT 4 REPORT (EIR) PREPARED FOR THE EAST TUSTIN SPECIFIC PLAN (FINAL EIR 85-2, AS MODIFIED BY SUBSEQUENTLY 5 ADOPTED SUPPLEMENTS AND ADDENDA) IS ADEQUATE TO SERVE AS THE PROGRAM EIR FOR ZONE CHANGE 97-003, 6 VESTING TENTATIVE TRACT MAP 15420 AND DESIGN REVIEW 96-057. APPLICABLE MITIGATION MEASURES HAVE BEEN 7 INCORPORATED AS REQUIRED BY THE CALIFORNIA ENVIRONMENTAL QUALITY ACT. 8 The City Council of the City of Tustin does· hereby resolve as 9 follows: 10 The City Council finds and determines'as follows: tl A. That Zone-Change 97-003, Vesting Tentative Tract 12 Map 15420 and Design Review ·96-057 and respective development plans are considered "projects" 13 pursuant to the terms of the California 'Environmental Quality Act; and, 14 B. That the projects are covered by. a previously 15 certified Final Environmental Impact Report 85-2, as amended, for the East Tustin Specific Plan which 16 serves as a Program EIR for the proposed project. 17 II. The East Tustin Specific Plan Final Environmental Impact Report (85-2), previously certified on March 17, 1986, 18 as modified by subsequently adopted supplements and addenda, was considered prior to approval of this 19 project. The City Council hereby finds: that this project is within the scope of the East Tustin Specific 20 Plan previously approVed; the effects of this project, relating to grading, drainage, circulation, public 21 ·services and utilities, wereexamined in the Program EIR. The applicable mitigation.!~measures and alternatives 22 developed in the Program EIRare incorporated into this project. The Final EIR is/therefore, determined to be 23 adequate to serve as a Program EIR for this project and . satisfies all requirements of the California 24 Environmental Quality Act. 25 . 26 27 Resolution No. 97-104 Page 2 1 2 3 Further, the City Council finds the project involves no potential for any adverse effect, either individually or 4 cumulatively, on wildlife resources; and therefore, makes a De Minimus Impact Finding related to Fish and Game Code 5 Section 711.4. 6 Applicable mitigation measures identified'in the Final EIR have been incorporated into this project which 7 mitigate potential 'significant environmental effects thereof.
