HUSTON, CITY MANAGER FROM: PUBLIC WORKS DEPARTMENT/ENGINEERING DIVISION SUBJECT: CITY OF TUSTIN MEASURE M GROWTH MANAGEMENT PROGRAM AND CONGESTION MANAGEMENT PROGRAM ANNUAL COMPLIANCE, FISCAL YEAR 2005-2006 SUMMARY In order to maintain eligibility for the Measure M Growth Management Program, the City is required to annually submit a compliance package to the Orange County Transportation Authority (OCT A). For Fiscal Year 2005-2006, that package includes: (1) an updated Seven- Year Capital Improvement Program, (2) a Maintenance of Effort Certification, (3) a Pavement Management Program Certification, and (4) Congestion Management Program Monitoring Checklists. RECOMMENDATION In order to maintain eligibility for the Measure M Growth Management Program (GMP) and the Congestion Management Program (CMP), it is recommended that the City Council take the following actions in compliance with the Measure M GMP and CMP requirements: A. Adopt the attached draft Measure M Growth Management Program Seven-Year Capital Improvement Program (Fiscal Year 2005-2006 through Fiscal Year 2011- 2012). B. Authorize the Director of Public Works/City Engineer to submit the City of Tustin's Measure M GMP and CMP eligibility packages, including certification of the City's Maintenance of Effort (MOE), Pavement Management Program (PMP), and Congestion Management Program (CMP) Monitoring Checklists to the Orange County Transportation Authority. FISCAL IMPACT Compliance with Measure M requirements will ensure continued City eligibility for the Measure M local Turnback Program, the Measure M Competitive Programs, and the Congestion Management Program Gas Tax Subventions. City of Tustin Measure M Growth Management Program and Congestion Management Program Annual Compliance, Fiscal Year 2005-2006 June 20, 2005 Page 2 BACKGROUND In June 1990, the voters of the State of California approved Proposition 111, under Section 2150 of the Streets and Highway Code, establishing a gas tax for the purpose of funding statewide transportation improvements. This provided a mechanism for the County to establish a region-wide CMP highway system that would be eligible to receive statewide funding for roadway projects. In November 1990, the voters of Orange County approved Measure M, the revised Traffic Improvement and Growth Management Program (GMP), which established a one-half (1/2) cent sales tax over a twenty-year period for local and regional transportation improvements throughout Orange County. In order to receive revenue from these programs for facility improvements, the City of Tustin and other Orange County cities must continue to meet certain requirements. Tustin's Measure M eligibility package for Fiscal Year 2004-2005 was approved by OCT A last year. In order to maintain eligibility for these programs, the City is required to submit the following items for the Fiscal Year 2005-2006 compliance submittal: Seven-Year Capital Improvement Program (CIP) The draft Capital Improvement Program (CIP) is a seven-year projection of specific projects upon which Measure M funds may be expended. Adoption of the seven-year CIP is a requirement of the Measure M GMP and CMP. Included in the plan are projects that could be submitted to OCTA during future Measure M calls for projects and projects that have identified Gas Tax funding. The proposed CIP is currently in draft form until the formal adoption of the City's seven-year Capital Improvement Program as part of the Fiscal Year 2005-2006 budget process. The finalized seven-year CIP will be forwarded to OCTA when the budget has been adopted by the City Council. Maintenance of Effort (MOE) A Maintenance of Effort (MOE) Reporting Form, with a statement certifying that the City will meet its MOE expenditure in accordance with Measure M requirements for Fiscal Year 2005-2006, must be submitted with a copy of the City's draft budget sections showing these expenditures. Upon authorization, the certification of the MOE will be executed by the Director of Public Works/City Engineer and submitted to OCTA. City of Tustin Measure M Growth Management Program and Congestion Management Program Annual Compliance, Fiscal Year 2005-2006 June 20, 2005 Page 3 Pavement Management Plan (PMP) The City of Tustin has had a Pavement Management Plan (PMP) in place since July 1989. An updated five-year PMP was developed by Nichols Consulting Engineers in May 2005 and will be submitted to OCTA as part of the Measure M compliance package. To comply with Measure M requirements, the City has to maintain and update the plan every two years. Upon authorization, the certification of the PMP will be executed by the Director of Public Works/City Engineer and submitted to OCTA. Congestion Management Program (CMP) In compliance with the Congestion Management Program (CMP), the City is required to prepare a seven-year CIP and submit CMP Monitoring Checklists for the seven-year Capital Improvement Program, Deficiency Plans, Land Use Coordination, Level of Service, and Traffic Demand Management Ordinance. Upon authorization, the CMP Monitoring Checklists and seven-year CIP will be submitted to OCTA. Compliance with the Measure M GMP and CMP requirements will ensure the City's continued eligibility for the various Measure M funding programs and the Congestion Management Program. ~D.~ Tim D.
