1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 88-107 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, DECLARING ITS INTENTION TO VACATE AND ABANDON A PORTION OF SAN JUAN STREET BETWEEN ORANGE STREET AND CHARLOMA DRIVE WHEREAS, the California Department of Transportation is negotiating to acquire land from the Tustin High School site for widening the I-5 Freeway and relocating E1 Camino Real; and WHEREAS, the Tustin Unified School District has requested the City of Tustin to vacate a portion of San Juan Street in order to connect the former Lambert School site to the Tustin High School site, thus providing better site utilization; and WHEREAS, the City of Tustin Planning Commission adopted Resolution No. 2526 on September 12, 1988 finding that the proposed vacation is in conformance with the adopted general plan. NOW, THEREFORE, the City Council of the City of Tustin does hereby resolve as follows: 1. Declares its intention to vacate a portion of San Juan Street between Orange Street and Charloma Drive as shown on a map entitled EXHIBIT "A" attached hereto and by reference made a part hereof. ~~ 2. ~~ 3. That the entire area to be vacated shall be retained as an easement for public utility facilities per Section 8340 of the California Streets and Highways Code. That a public hearing is hereby set for Wednesday, October 19, 1988 at 7:00 P.M. in the Council Chambers of City Hall, 300 Centennial Way, Tustin, California 92680, for hearing all persons interested in the proposed vacation. 4. This resolution shall be published in the Tustin News, a newspaper of general circulation in the City of Tustin, for two successive weeks prior to the hearing. 5. That notice of vacation shall be posted along the street proposed to be vacated. The notices shall be not more than 300 feet apart, but at least three notices shall be posted. That these proceedings are being conducted under Chapter 3, Part 3, Division 9 (Section 8320, et.seq.) of the California Streets and Highways Code.
