HomeMy WebLinkAboutCC RES 88-09010 11 14 15 16 17 18 19 20 ~4 RESOLUTION NO. 88- 90 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ADOPTING REGULATIONS FOR CANDIDATES FOR ELECTIVE OFFICE PERTAINING TO CANDIDATES STATEMENTS SUBMITTED TO THE VOTERS AT AN ELECTION. WHEREAS, Section 10012 of the Elections Code of the State of California provides that the governing body of any local agency adopt regulations pertaining to materials prepared by any candidate for a municipal election, including costs of the candidates statement; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, DOES HEREBY RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS- SECTION 1. GENERAL PROVISIONS. That pursuant to Section 10012 of the Elections Code of the State of California, each candidate for elective office to be voted for at an Election in the City of Tustin may prepare a candidate's statement on an' appropriate form provided by the City Clerk. The statement may include the name, age and occupation of the candidate and a brief description of no more than two hundred (200) words of the candidate's education and qualifications expressed by the candidate himself or herself. The statement shall not include party affiliation of the candidate, nor membership or activity in partisan political organizations. The statement shall be filed in the office of the City Clerk. at the time the candidate's nomination papers are filed, except that any candidate who has filed his or her nomination papers prior to adoption of this Resolution shall file such statement within seven (7) days following adoption of this Resolution. The statement may be withdrawn, but not changed, during the period for filing nomination papers and until 5:00 p.m. on the next working day after the close of the nomination period. SECTION 2. SPANISH LANGUAGE. The City Clerk shall have all candidate's statements translated and available upon request in the City Clerk's office. SECTION 3. ADDITIONAL MATERIALS. NO candidate will be permitted to include additional materials in the sample ballot package. SECTION 4. PAYMENT. The City Clerk shall estimate the total cost.:0f printing, handling, translating, and mailing the candid~ilte's statements filed pursuant to the Elections 8 10 11 12 15 14 15 18 19 20 21 ~4 ~5 Z6 Code, and require each candidate filing a statement %o pay in advance his or her pro rata share ag a condition of having his or her statement included in the voter's pamphlet. The City Clork shall bill each candidate for any Cost in exces~ of the deposit or shall refund within 30 days of the eloction any unused portion of the deposit. SECTION 5. The City Clerk shall cause and candidate statements to be printed and registered voter within the City of Tustin. sample ballots mailed to ~ach SECTION 6. The City Clerk shall provide each candidate or the candidate's representative a copy. of this Resolution at the time nominating petitions are issued and as to any candidate or' candidates' representative to whom nominating petitions have been issued prior to adoption of this Resolution, the City Clerk forthwith shall upon adoption of this Resolution provide a copy of this Resolution to each such candidate or candidate's representative. . SECTION 7. Ail provi$ion~ of previous resolutions establishing'Council policy on printing, payment and mailing of candidate's statements are repealed to the extent .they are inconsistent with this Resolution° SECTION 8.
