HomeMy WebLinkAboutCC RES 19-59RESOLUTION NO. 19-59 A RESOLUTION OF THE CITY OF TUSTIN SETTING FORTH THE LANGUAGE OF A BALLOT TITLE FOR A CITY CODE AMENDMENT REGARDING LIMITED COUNCIL COMPENSATION TO BE INCLUDED ON THE BALLOT FOR THE 2020 GENERAL ELECTION, DIRECTING CITY ATTORNEY TO PREPARE IMPARTIAL ANALYSIS, AND DIRECTING THE CITY CLERK TO ESTABLISH DEADLINES FOR THE SUBMISSION OF ARGUMENTS AND REBUTTALS. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF TUSTIN AS FOLLOWS: Section 1: By Resolutions 19-56 and 19-57, the City Council of the City of Tustin has called for its General Municipal Election to be held on November 3, 2020 and submitted to the voters a proposed amendment to the Tustin City Code. Section 2: The California Elections Code directs that the City of Tustin approve the form of the ballot question to be submitted to the voters and the City Council of the City of Tustin desires, on its own motion, to submit to the voters of the City a question relating to limited Council compensation, to be submitted to the voters at the General Municipal Election to be held on Tuesday, November 3, 2020. Section 3. The amendments called for in Resolution No. 19-57 shall be proposed as follows, with identification as determined in accordance with the California Elections Code: Measure : Limited Council Compensation Shall the Tustin City Code be amended to comply YES with the Council salary formula provided for by California Government Code Sections 36516 and 36516.5 to ensure that Council salaries are set and strictly limited by such Government Codes, commencing at $600 per month? NO Section 4: This Resolution shall take effect immediately upon its adoption by the City Council, and the City Clerk shall attest to and certify the vote adopting this Resolution. Section 5: The City Clerk is hereby authorized to transmit a copy of the measure, as set forth in Section 3 above to the City Attorney, who shall prepare an impartial analysis of the measure in accordance with Section 9280 of the Elections code. The impartial analysis shall include a statement indicating whether the measure was placed on the ballot by a petition signed by the requisite number of the voters or by the City Council. Resolution 19-59 Page 1 of 2 Section 6: The City Clerk is directed to fix a deadline for submission of arguments and rebuttals for or against the measure pursuant to 9285 of the Elections Code, the provisions of which are hereby adopted by the City Council.
