SUBJECT: EXTENDING THE TERM OF THE PROJECT POSITION OF BUILDING PERMIT
TECHNICIAN
SUMMARY
Adoption of the attached Resolution will extend the term of the project position of
Building Permit Technician by five (5) years.
RECOMMENDATION
Adopt Resolution No. 19-62 to extend the term of the project position of Building Permit
Technician by five (5) years.
FISCAL IMPACT
None. This position is included in the adopted budget for Fiscal Year 2019-20 and FY
2020-21.
BACKGROUND AND DISCUSSION
On November 18, 2014, the City Council adopted Resolution No. 14-75 to amend the
City's Classification and Compensation Plan to authorize the appointment of a project
employee in the classification of Building Permit Technician for a period of up to five (5)
years from the employee's hire date. Robert Chavez was hired to fill this project position
on December 29, 2014; therefore, under the terms of Resolution No. 14-75, his
employment will automatically end on December 29, 2019 unless the City Council takes
action to extend the term of the position.
A Building Permit Technician is a front -counter position that serves as the primary point
of contact with property owners, developers, contractors, and other members of the
public regarding requests pertaining to the building permit process and permit activity
for various residential, commercial, and industrial building activities. The City currently
employs two Building Permit Technicians, one in a regular position and one in the
limited term project position that is due to expire this year.

The City has a continued need for two Building Permit Technician positions and
requests the Council's permission to extend the term of the project position by an
additional five (5) years, through December 29, 2024. An employee hired into a project
position is employed at -will, meaning employment may be terminated at any time by the
City or the employee, which provides the City with the flexibility to terminate the
employee's employment prior to December 29, 2024 if a need no longer exists for the
services he provides or for any other reason. On the other hand, if the City determines
that a need for this position exists beyond the extended term, the project position can be
extended once again or the position can be converted to a regular full-time position.

RESOLUTION NO. 19-62
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TUSTIN, CALIFORNIA, EXTENDING THE TERM OF THE
PROJECT POSITION OF BUILDING PERMIT TECHNICIAN
WHEREAS, the City of Tustin (the "City") has implemented Personnel Rules,
Resolution No. 15-50, which authorize the City Council to establish "project" positions
for a prescribed period of time or for the duration of a specified project; and
WHEREAS, the City Council previously adopted Resolution No. 14-75
authorizing a project position of Building Permit Technician for a period of five (5) years
from the appointed employee's initial date of employment; and
WHEREAS, the five (5) year term of the employee appointed to the project
position of Building Permit Technician will expire on December 29, 2019; and
WHEREAS, the City has determined that there is a continued need for a project
position of Building Permit Technician.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Tustin authorizes staff to implement the provisions of this Resolution.
Section 1: Effective Dates
The effective date of each section is December 29, 2019, unless otherwise stated
herein.
Section 2: Term of Employment
The term of the project position of Building Permit Technician shall be extended by an
additional five (5) years from the effective date of this Resolution, through December 29,
2024. Extended terms of employment may be granted by the City Council as necessary
if a need for this project position exists beyond this extension. An employee appointed
to this position is employed at -will and employment may be terminated at any time by
either the City or the employee.
Section 3: Salary and Benefits
The salary range and employment benefits for the classification of Building Permit
Technician are as established in the Memorandum of Understanding with the Tustin
Municipal Employees Association.
