STACK, DIRECTOR OF PUBLIC WORKS/CITY ENGINEER SUBJECT: ADOPT RESOLUTION NO. 19-64 TO ACCEPT IMPROVEMENTS FOR THE TUSTIN LEGACY LINEAR PARK SEGMENTS 3 & 4 IMPROVEMENTS (CIP NO. 20077) CONSTRUCTION PROJECT AND AUTHORIZE THE CITY ENGINEER TO FILE A NOTICE OF COMPLETION SUMMARY Construction of the Tustin Legacy Linear Park Segments 3 & 4 Improvements (CIP No. 20077) Construction Project, has been completed to the satisfaction of the City Engineer and is now ready for City Council acceptance. RECOMMENDATION It is recommended that the City Council take the following actions: Adopt Resolution No. 19-64 accepting the construction of the Tustin Legacy Linear Park Segments 3 & 4 Improvements (CIP No. 20077) Construction Project; and 2. Authorize the City Engineer to execute and file the Notice of Completion with the Orange County Recorder's Office. FISCAL IMPACT The final construction cost for the Tustin Legacy Linear Park Segments 3 & 4 Improvements (CIP No. 20077) Construction Project is $4,618,982.40, including authorized contract change orders in the total amount of $50,341.31. The contract change orders are comprised of the following: additional improvements to tie into Phase 1 existing infrastructure and for unforeseen conditions necessary to complete the work within the approved project scope and budget. Sufficient funds were budgeted and appropriated in the Capital Improvement Program. CORRELATION TO THE STRATEGIC PLAN The Tustin Legacy Linear Park Improvements contribute to the fulfillment of the City's Strategy Plan Goal A: Economic and Neighborhood Development. Specifically, the project implementation of Strategy 1, which among other items, is to develop critical phases of Tustin Legacy. DISCUSSION On December 18, 2018, the City Council authorized the award of construction contract to Marina Landscape, Inc. Segments 1 and 2 of Linear Park around the detention basin was completed and accepted on February 6, 2018. Construction of Segments 3 and 4 of Linear Park from the detention basin to Armstrong Avenue including the parking area consists of trails, landscape improvements, parking lot construction and restroom building installation. Location Map 5]City Council Itemsk2019 Council Items112-17-20191NOC - Tustin Legacy- Linear Park CIP 20077NOC staff report -Linear Park (CIP 20077) - Manna draft.docx ATTACHMENT 1 Resolution No. 19-64 RESOLUTION NO. 19-64 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ACCEPTING THE WORKS OF IMPROVEMENT AND AUTHORIZING THE RECORDATION OF THE NOTICE OF COMPLETION FOR THE TUSTIN LEGACY LINEAR PARK SEGMENTS 3 & 4 IMPROVEMENTS (CIP 20077) WHEREAS, Marina Landscape, Inc., having a contract with the City of Tustin to construct the hereinafter described public works and improvement; and WHEREAS, the City Engineer has duly certified to the construction and completion of said public improvement hereinafter mentioned in a manner satisfactory to the City Council of the City of Tustin; and WHEREAS, the City Council finds that said contractor has completed said public improvement hereinafter more particularly described in accordance with the provisions of the contract documents and the Notice of Completion, and acceptance of said public works and improvement should be filed and payment of the balance due said contract authorized in accordance with the contract documents; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Tustin that said public works and improvement is found to be complete, and the same is hereby accepted. Said public works and improvement is more particularly described as follows: Tustin Legacy Linear Park Segments 3 & 4 Improvements (CIP No. 20077) BE IT FURTHER RESOLVED that the City Engineer of the City of Tustin is hereby authorized to execute and file a Notice of Completion for the acceptance of said public works and improvement described herein as required by law.
