HomeMy WebLinkAboutCC RES 87-152 RESOLUTION NO. 87-152 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN APPROVING VESTING TENTATIVE MAP NO. 13106 The City Council of the City of Tusttn does hereby resolve as follows' I · The City Council finds and determines as follows' A That Vesting Tentative Map No. 13106 was submitted to Planning Commission by Hunsaker & Association on behalf of Fieldstone Company, for consideration. B That a public hearing was duly called, noticed and held for said map. C · D That the Planning Commissio.n forwarded to City recommendation to approve Vesting Tentative Tract Map by the adoption of Resolution No. 2459. Council a No. 13106 That an Environmental Impact Report {EIR 85-2 for the East Tustin Specific Plan) has been certified in conformance with the requirements of California Environmental Quality Act for the subject project area. E~ That the proposed subdivision ts in conformance with the Tustin Area General Plan, adopted East Tustin Specific Plan, Development Agreement and Subdivision Map Act as it pertains to the development of single family attached dwellings. The .924 acre parkland required of this project was dedicated with recordation of Tract 12763. previously G That the City has reviewed the status of the School Facilities Agreement between The Irvine Company and the Tustin Unified School District, the East Tustin Specific Plan, EIR 85-2, the impacts of Vesting Tentative Map 13106 on School District facilities, and reviewed changes in State law, and finds and determines that the impacts on School District facilities by approval of this map are adequately addressed through the reservation of a high school site and elementary site in conjunction wi th Tentative Tract Map 12763, and imposition of school facilities fees as a condition of approval of Vesting Tentative Map 13106. H · That the site is physically suitable for the type of development proposed. I · That the site is physically de ve 1 o pmen t. suitable for the proposed density of ., · Resolution No. 887-152 Page two H That the design of the subdivision or the proposed improvements are not likely to cause substantial environmental damage or substantially and avoidably injure fish or wildlife in their habitat. K That the design of the subdivision or the type of improvements proposed will not conflict wi th easements acquired by the public-at-large, for access through or use of the property wi thin the proposed subdi vi sion. L That the design of the subdivision or the types of improvements proposed are not likely to cause serious public health problems. II. The City Council hereby approves Vesting Tentative Map No. 13106 subject to the conditions attached in Exhibit A -of Planning Commission Resolution No. 2459 incorporated herein by reference.
