A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TUSTIN, CALIFORNIA, APPROVING PLANS
AND SPECIFICATIONS FOR FEDERAL AID PROJECT
HES-000S (241) AND AUTHORIZING ADVERTISEMENT
FOR BIDS
WHEREAS, it is the intention of the City Council of the City
of Tustin, California to construct certain signal improvements at
Newport Avenue and Irvine Boulevard, Newport Avenue and First
Street, Newport Avenue and E1 Camino Real, and Red Hill Avenue and
Bryan Avenue;
WHEREAS, the City Engineer has presente.d plans and
specifications for the construction of said work;
NOW THEREFORE., BE IT RESOLVED that the plans and specifi-
cations presented by the City Engineer be and are hereby approved
as the plans and specifications for:
Federal Aid Project HES-000S (241)
BE IT FURTHER RESOLVED that the City Clerk is hereby
authorized and directed to advertise as required by law for the
receipt of sealed bids or proposals for the doing of the work
specified in the aforesaid plans .and specifications.
PASSED AND ADOPTED by the City Council of the City of Tustin,
California, this 7th day of . December, 1987 ·

NOTICE TO CONTRACTORS
SEALED PROPOSALS will be received at the office of the City Clerk,
Tustin City Hall,.300 Centennial Way, Tustin, California 92680 until 11:oo
A.M. on the 7th day of January, 1988 at which time they will be
publicly opened and read, "for performing Work as follows:
Construction of' Federal Aid Project HES-O00S(241)
Bids are required for the entire work described herein:

The foregoing quantities are approximate only being given as a basis for
the comparison of bids, and the City of Tustin does not, expressly or by
implication, agree that the actual amount of work will correspond therewith, but
reserves the right to increase or decrease the amount of any class or F'~ortion of
the work or to omit portions of the work .as may be deemed necessary or advisable
by the Engineer.
Plans, specifications and proposal forms to be used for biddin.~.l on this
project can only be obtained by prospective bidders at the office of t. he City
Clerk, Tustin City Hall, 300 Centennial Way, Tustin, California 92680, upon
payment of $15.00 per set, or will be mailed out upon payment of $20°00 per set,
which amounts are not refundable.
In conformance with Section 37931 of the Government Code, all bids shall
be 'presented under sealed cover on the proposal form provided and accompanied by
bidder's security in the form of cash, cashier's check, certified check or bid
bond executed by an accredited surety.
The security shall be in an amount equal to at least ten percent (10%)
of the amount of the bid. A bid shall not be considered unless one of the forms
of bidder's security is enclosed therewith.
Each bidder shall submit the required DBE (Disadvantaged Business
Enterprise) 'information with his bid.
A Security Bond for payment of labor and materials will be required
in the amount of fifty percent (50%) of the estimated total contract price
and a Faithful Performance Bond in the amount of one hundred percent (100%)
of the estimated...~.otal ~ontract price in the form attached to the contract
documents. Said bonds shall be issued by a surety, company rated grade A or
better and Cla~s' IV or better by the latest' edition of Best's Key Rating
Gui de.
City of Tustin reserves the right to reject any or all bids, and/or
to waive any informality on a bid. No bidder may Withdraw his bid for a
period of thirty (30) days after the date set for the opening thereof. Prior
to bid opening, bidder may withdraw his bid. Bids received after the bid
opening time and date herein will be returned to bidder unopened.
Pursuant to California Government Code Section 4590, the contractor wil'l
be entitled to post approved securities with the City or.an approved
financial institution in order to have the City release funds retained by the
City to insure performance of the contract.
Federal requirements and Federal minimum wages shallI apply to this
project. Attention is directed to decision No. CA 87-2 & 3 of the Secretary
of Labor. Not less than said minimum wages shall be pai'd to workers employed
on this project.
Federal requirements for this project require that the Contractor shall
perform work with his own organization which equals not less than 30 percent
(30%) of the total contract price.
Minimum wage rates for'this .project as predetermined by the Secret'ary of
Labor are set forth in the special provisions° If there is a dif~."erence
between the minimum wage rates predetermined by the Secretary of Labor and
the prevailing wage rates determined by the State for similar classifications
of labor, the Contractor and his subcontractors shall pay not less than the
higher wage rates.
Pursu'ant to Section 1773 of the. Labor Code, the general prevailing rate
of wages in the County in which the work is to be done has been determined
and the department has listed these wage rates in the Department of
Transportation publication entitled Equipment Rental Rates and General
Prevailing Wage Rates, latest edition.
Each bidder'shall execute the Non-collusion Affidavit shown on Page B-8
of the Specifications and include it with his bid.
Prior to contract award, the successful bidder shall possess a valid
State of California contractor's license in the classification of C10.
