HomeMy WebLinkAboutCC RES 97-0881 RESOLUTION NO. 97-88 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, CERTIFYING THAT THE PROPERTY 3 BEING ACQUIRED FOR THE TUSTIN COMMUTER RAIL STATION SITE DOES NOT EXCEED STATE AND FEDERAL HAZARDOUS 4 WASTE STANDARDS. 5 The City Council of the City of Tustin does hereby resolve as follows: 6 ~' WHEREAS, the City of Tustin has prepared an application 7 for Fiscal Year 1996-1997 Transit Capital Improvement Funds for the Tustin Commuter Rail Project; and 8 WHEREAS, the State has instituted a Uniform Transit 9 Application which requires certifications by the City for items as part of the application process; and 10 WHEREAS, the California TranSportation Commission 11 requires grant applicants to certify by formal resolution that all responsible steps have been completed to assure discovery 12 of hazardous waste during the acquisition of rail right of way. 13 NOW, THEREFORE, BE IT RESOLVED that the City Council of 14 the City of Tustin requests and certifies the following: 15 Section 1. That the City of Tustin required the preparation of a Phase I and Phase II Environmental Site 16 Assessment prior to the acquisition of the 3.6 acre Tustin Commuter. Rail Station site. 17 Section 2. That the results of the Phase I and Phase II 18 Assessment determined that further subsurface environmental investigation work is not warranted. 19 Section 3. That the City of Tustin will not seek state 20 funding for cleanup, damages or liability costs associated with subsequent discovery of hazardous waste. 21 PASSED AND ADOPTED at a regular meeting. of the Tustin 22 City Council, held on the 18th day of August, 1997. 24 - F YyTH0 s 25 MAYOR 28 .
