HomeMy WebLinkAboutZA Action Agenda 7-5-05 ACTION AGENDA ZONING ADMINISTRATOR MEETING JULY 5, 2005 CALL TO ORDER: 10:30 a.m. Community Development Department Conference Room ROLL CALL: Dana Ogdon, Acting Zoning Administrator Staff present: Minoo Ashabi, Associate Planner Justina Willkom, Senior Planner Eloise Harris, Recording Secretary PUBLIC CONCERNS: (Limited to 3 minutes per person for items not on the agenda) CONSENT CALENDAR: No Items on Consent Calendar PUBLIC HEARINGS: Conditional Use Permit 05-014 - Authorization to establish a 1,224 square foot medical office in a 14,644 square foot retail center. The project is located at 137 W. First Street, Suite B-2, within the First Street Specific Plan (FSSP), Commercial as primary land use designation zoning district. APPLICANT/: PROPERTY OWNER: Forum Capital LLC Attention: John Coelho RECOMMENDATION That the Zoning Administrator adopt Zoning Administrator Action 05-11 approving Conditional Use Permit 05-014. The Public Hearing opened at 10:32 a.m. The Acting Zoning Administrator introduced himself and the staff, asked the applicant to introduce himself, described the item, and asked the applicant if he had read the staff report and conditions of approval and whether or not the applicant had any questions or concerns. John Coelho, developer and applicant, replied that he understood the conditions of approval and had no questions or concerns. Zoning Administrator Agenda July 5, 2005 Page 2 The Acting Zoning Administrator referred to the parking demand analysis that concluded that for non-holiday months 61 or fewer parking spaces would be required; based on the parking analysis, the medical use would not have a significant impact on the center; during holiday months, there might be a slight impact but no more than would occur in any commercial retail center. The medical space must be confined to Unit B-2 and any future change of location would require this same process to re-establish there is not an impact. Mr. Coelho indicated that the tenant has a large investment for equipment in that space; therefore, the chance of the medical office moving is remote. The Acting Zoning Administrator approved Zoning Administrator Action 05-11 approving Conditional Use Permit 05-014. Mr. Coelho asked if plans could be submitted tomorrow. The Acting Zoning Administrator indicated to Mr. Coelho that there is a seven-day appeal period, but the applicant can proceed with that understanding. The Public Hearing closed at 10:37 a.m. Conditional Use Permit 05-008 - Authorization to temporarily install and operate a groundwater/vapor remediation system at an existing gas station to remove hydrocarbons from the soil for approximately two (2) years. The project is located at 14501 Red Hill Avenue within the Central Commercial (C2) zoning district. APPLICANT: Wayne Perry, Inc. Attention: Siem Ou PROPERTY OWNER: John & Lynne Yegenian RECOMMENDATION That the Zoning Administrator adopt Zoning Administrator Action 05-012 approving Conditional Use Permit 05-008. The Public Hearing re-opened at 10:40 a.m. The Acting Zoning Administrator introduced himself and the staff and asked the two others present to introduce themselves. Adam Laurin was in attendance representing the applicant. Matt Nisson introduced himself as an interested party. Zoning Administrator Agenda July 5, 2005 Page 3 The Acting Zoning Administrator reviewed the staff report and asked Mr. Laurin if he understood the report and all the conditions of approval. Mr. Laurin responded in the affirmative. Mr. Nisson stated he was in attendance because he felt this might be the last chance for him to suggest that corner has been a blight for a number of years and presented Polaroid photographs to support his claim. Mr. Nisson added that the new facility should be required by the City to include landscaping enhancements that would eliminate an unsightly area that has continued to deteriorate for a number of years. Justina Willkom provided background regarding this site and indicated that station ownership has changed and the plan is to restore the landscaping. Mr. Laurin indicated that he works for Chevron and is simply cleaning up the mess that was left behind; Vallero Gas will rebrand the station, redo the tanks and all the piping, and also be responsible for the landscaping. The Acting Zoning Administrator asked if the site is fenced. Mr. Willkom answered it is fenced on three sides with an opening on one side. Mr. Laurin indicated that access was for a mechanic that is still operational at the site. Mr. Nisson stated this is the first opportunity he has had to talk to someone about this site, because everything regarding the Chevron station has always been decided by the City without public input. The Acting Zoning Administrator informed Mr. Nisson that the gas station has been bought and will be remodeled and that will be the appropriate time for staff to require that landscaping to be provided. This application is for the removal of the groundwater contamination. Mr. Laurin added that a new company typically includes new landscaping and tenant improvements when they rebrand. The Acting Zoning Administrator assured Mr. Nisson that code enforcement can make sure that new landscaping is part of the process. Based on the findings in the staff report, the Acting Zoning Administrator approved Zoning Administrator Action 05-012 approving Conditional Use Permit 05-008 and asked Ms. Willkom to reach out to the new owners to make them aware of the concerns regarding landscaping, find out what they have planned, and share those plans with Mr. Nisson. Mr. Nisson asked if the operators will be the same people. Zoning Administrator Agenda July 5, 2005 Page 4 Ms. Willkom responded that Vallero is purchasing the lease. Mr. Nisson stated that he was told the property owners are the same. The Acting Zoning Administrator replied that the property owners are the same but the lessees will be different. Mr. Laurin asked about the Agreement of Conditions Imposed form and the Notice of Discretionary Permit. Ms. Willkom answered that those documents should be ready tomorrow. The Acting Zoning Administrator stated there is a seven-day appeal period, and Mr. Laurin would be informed of any appeal. Mr. Laurin asked if he should submit the check for $43.00 or wait seven days. Ms. Willkom indicated that a cashier's check should be submitted as soon as possible in order to begin the environmental. REGULAR BUSINESS: None ADJOU RNMENT: The Public Hearing closed and the meeting adjourned at 10:58 p.m. The date of the next meeting of the Zoning Administrator will be scheduled when items are set for hearing.
