A RESOLUTION OF THE CITY OF TUSTIN CITY COUNCIL
APPROVING FINAL PARCEL MAP 2004-256 TO MERGE
TWO PARCELS TO CREATE ONE PARCEL 29,733
SQUARE FEET IN AREA (0.68 ACRES) LOCATED AT
14001 AND 14011 NEWPORT AVENUE AND 770 EL
CAMINO REAL (APNS. 401-641-05 AND 401-641-07)
LOCATED AT THE SOUTHWEST CORNER OF EL
CAMINO REAL AND NEWPORT AVENUE
The City Council of the City of Tustin does hereby resolve as follows:
I.
The City Council finds and determines as follows:
A.
That a proper application for Final Parcel Map No. 2004-256 was submitted
by Makena Great American requesting approval to merge two existing
parcels to create a 29,733 square foot parcel (0.68 acres) located at the
southwest corner of EI Camino Real and Newport Avenue for development
of a 7,400 square foot single story retail building (assessor parcel numbers
401-641-05 and 401-641-07).
B.
That on November 22, 2004, the Planning Commission adopted
Resolution No. 3938 recommending that the City Council approve
Tentative Parcel Map 2004-256; and the City Council approved Tentative
Parcel Map 2004-256 on December 6, 2004, by adopting Resolution No.
04-97.
C.
That the proposed subdivision is in conformance with Tentative Parcel
Map 2004-256, the Tustin Area General Plan, Tustin Zoning Code, State
Subdivision Map Act, the City's Subdivision Code, and has been
determined to be consistent with the Air Quality Sub-Element.
D.
That the site is located within the Central Commercial (C-2) zoning district
and Cultural Resources and Parking Overlay Districts and is physically
suitable for the type of development and proposed density of
development.
E.
That the design of the subdivision or the proposed improvements are not
likely to cause substantial environmental damage, cause serious public
health problems, or substantially and avoidably injure fish or wildlife in
their habitat.
F.
That all necessary easements and dedications have been shown on the
map and associated improvements have been installed.

G.
That Final Parcel Map 2004-256 is Categorically Exempt (Class 15) from
the provisions of the California Environmental Quality Act pursuant to
Section 15315 of Title 14, Chapter 3 of the California Code of Regulations
(Guidelines for the California Environmental Quality Act).
II.
The City Council hereby approves Final Parcel Map 2004-256 to merge two
parcels to create one parcel 29,733 square feet in area (0.68 acres) located at the
southwest corner of EI Camino Real and Newport Avenue for development of a
7,400 square foot single story retail building, subject to final review and approval
by the City Engineer and the City Attorney prior to recordation.
PASSED AND ADOPTED at a regular meeting of the Tustin City Council held on
the 6th day of September, 2005.
