HUIZAR, CHIEF DEPUTY CITY CLERK TO: SUBJECT: CONFLICT OF INTEREST REVIEW - DESIGNATED POSITIONS SUMMARY: Recently the City has added positions that require to be added to the City's Conflict of Interest Code. RECOMMENDATION: Adopt Resolution No. 05-98 modifying the Appendix (Designated Positions) contained in the City's Conflict of Interest Code as follows: Additions: Contract Coordinator Maintenance Supervisor Principal Human Resources Analyst Plan Checker/ Senior Building Inspector Deletions: Accounting Supervisor Senior Human Resources Analyst FISCAL IMPACT: None BACKGROUND: The Appendix (Designated Positions) of the City's Conflict of Interest Code defines those officials and employees who are required to file Statements of Economic Interests (Form 700). Whenever significant changes in the City's Classification Plan occur, the Code should be modified to reflect changes that have occurred. Page 2 The Human Resources Department recently added a Principal Human Resources Analyst position as did Public Works with their Contract Coordinator position. Said positions require annual filings. Huizar Chief Deputy City Clerk Attachment Page 3 RESOLUTION NO. 05-98 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, MODIFYING THE DESIGNATED POSITIONS CONTAINED IN THE CONFLICT OF INTEREST CODE OF THE CITY OF TUSTIN The City Council of the City of Tustin does hereby resolve: A. That the Appendix of the Conflict of Interest Code of the City of Tustin, approved by the City Council with the adoption of Resolution No. 04-86, should be modified to reflect position title changes of Principal Human Resources Analyst, Contract Coordinator, and Maintenance Supervisor. B. That the revised Appendix, attached hereto, be approved and the Conflict of Interest Code be modified accordingly. C. That pursuant to Section 4 of the Conflict of Interest Code of the City of Tustin, the City Council, as the Code-reviewing body, hereby instructs all persons occupying a Designated Position to file with the City Clerk a Statement of Economic Interests as required: assuming position, annually, and leaving position. It consists of the model code set forth in Regulation 18730 of the Fair Political Practices Commission, incorporated herein by reference, together with the following Appendix: The City Council, City Manager, City Attorney, City Treasurer, and Planning Commissioners are required to file Statement of Economic Interests Form 700 pursuant to Government Code §87200 and are, therefore, not included as designated positions in this Appendix. If the City Manager determines that a particular consultant must comply with the above Page 7 disclosure requirements, the City Manager shall notify the consultant in writing. The written notification shall include a description of the consultant's duties and, based upon those duties, a statement of the extent of the disclosure requirements. The City Manager's notification is a public record and shall be retained for public inspection by the City Clerk in the same manner and location as this Conflict of Interest Code. DISCLOSURE CATEGORIES: The foregoing positions (Consultants excluded) will be assigned Disclosure Categories of I, II, and III. Category I: Category II: Category III: Investment and Real Property Disclosure. Personal Income Disclosure. Business Income, Commissions and Position Disclosure.
