SUMMARY:
In an effort to simplify the City's inventory of fees and charges, staff has consolidated
previously adopted resolutions into one Comprehensive Schedule of Fees. In reviewing
the schedule, the Police Department and Public Works have identified some fees that
have not been updated recently and propose an increase.
RECOMMENDATION:
That the City Council conduct a public hearing and adopt Resolution No. 05-99
establishing a Comprehensive Schedule of Fees and charges for City services.
FISCAL IMPACT:
None. No net increase to City revenue expected, as increased fees are offset by
increased City costs.
BACKGROUND:
The City provides a variety of services and programs to the community. Most of these
services such as law enforcement, park operations, street maintenance, public facility
operations, community events, city facility operations, etc. are for the benefit of the
public at-large. These services and programs are paid for by general revenues derived
from taxes and other revenue.
Other types of service provided by the City benefit a particular individual or entity as
opposed to the community at-large. These services include such things as the planning
and engineering division review, processing of applications for development, issuance
of building and grading permits, encroachment permits, building and engineering
inspection, community services programs and facility usage, and other miscellaneous
services and programs. These services are funded through fees charged to those
individuals and/or entities deriving benefit from the services. These charges are listed
by department using specific exhibits for each department in the attached resolution.
It has historically been the City Council's policy to avoid a general subsidization of the
cost to provide extemporaneous services to the public. The City has endeavored to

recover only the cost to provide these services, not to contribute to the net revenues of
the City. The fees included on the proposed fee resolution reflect fees that are currently
being charged that have been previously adopted, with the exception of the Police
Department and Public Works Department which propose to increase some of their
fees. Those increases are in bold in attached Exhibits C and D of Resolution No. 05-99.
Resolution No. 05-73 adopted on June 6, 2005 authorized the City to charge applicants
reasonable fees not to exceed the amount necessary to provide the service required for
processing of certain development and planning and permit applications. The Public
Works Department has attached Exhibit 2 in which these costs have been calculated to
substantiate the current amount being charged.
The Police Department is requesting that certain fees and service charges be increased
because they are well below the actual cost borne by the City. The last time the Police
Department proposed any increases was in 1986. The first step the Police Department
took in evaluating said fees was to identify all of their existing fees. To determine
whether a fee needed to be updated, staff considered three components: (1) The cost to
deliver the service, (2) Fees charged for the same service in the surrounding
communities; and (3) Application of a reasonability factor for these fees. Attached is
the Police Department's Time and Motion studies for proposed fee increases. In
addition, on September 6, 2005, the City Council introduced Ordinance No. 1302 in
which the Police Department modified the false alarm enforcement program and
proposed that the following fees be amended:

State Law has established the requirement that new or increased City fees may only be
modified via a public hearing process. Although most fees remain the same, the Police
and Public Works Departments are recommending some increases, thus a hearing is
warranted. In the future, an update of the City's fees and charges as a comprehensive
schedule will be brought forward as part of the City's budget process.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TUSTIN INCREASING OR OTHERWISE MODIFYING CERTAIN
POLICE DEPARTMENT AND PUBLIC WORKS DEPARTMENT
FEES AND CHARGES, AND ESTABLISHING A
COMPREHENSIVE SCHEDULE OF FEES AND REPEALING
RESOLUTION NOS. 87-138, 92-103, 92-110, 93-03, 95-43, 99-
53,01-111,02-57,04-26,05-55, AND 05-73
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF TUSTIN AS
FOLLOWS:
Section 1: The City Council hereby, finds, determines and declares as follows:

For the cbnvenience of the public it is desirable to gather in a single
document a comprehensive list of fees and service charges imposed
by the City for City services.
The document known as the "Comprehensive Schedule of Fees," is
attached to this resolution and is made a part hereof by this reference.
Each fee or service charge is identified under second column. New or
increased fees or charges are shown in bold.
In developing new or increased fees for the Comprehensive Schedule
of Fees, the Police Department and the Public Works Department
analyzed the cost to administer the various programs, activities and
applications for which the City proposes to charge new or increased
fees or service charges. The proposed new and increased fees or
charges do not exceed the estimated cost of service for which the fees
or charges are levied.
It is not its intention to repeal previously adopted fees and adopt new
fees of exactly the same amount, but is simply repeating these fees
with the Resolution so that the Fee Schedule can be a comprehensive
source of City fees and service charges.
Charges subject to Proposition 218 are adopted in a different manner
and are not part of this resolution.
Section 2: The Comprehensive Schedule of Fees is hereby adopted. Each
fee or service charge set forth in this Resolution and shall be levied until further
resolution of this Council.

Section 3: This Resolution supersedes all prior resolutions on the same
subjects including but not limited to City Council Resolution Nos. 87-138, 92-103, 92-
110,93-03,95-43,99-53,01-111,02-57,04-26,05-55, and 05-73.
Section 4: If any charge, fee, service charge, section, subsection, sentence,
clause, phrase or word of this Resolution is for any reason held to be invalid by a
court of competent jurisdiction, such decision shall not affect the validity of the
remaining portions of this Resolution. The City Council hereby declares that it would
have passed and adopted this Resolution, and each and all provisions hereof,
irrespective of the fact that one or more provisions may be declared invalid.
Section 5: That except as may be stated otherwise above, this Resolution
shall be operative from and after adoption of resolution.

COMMUNITY DEVELOPMENT
1.
BUSINESS LICENSE TAX FEES
Every person who engages in business within the City or Tustin and/or has an
established place of business within the City limits shall pay a license tax based upon
the gross receipts of business done within the City, unless otherwise specified in the
City Code (see enumerated business below). Gross receipts shall be based on the
prior years' receipts, or in the case of a new business, calculated on current year's
estimates.
Payment of business license fee and/or approval of business license does not waive
or preclude any other licenses or permits required by Tustin City Code. The license
tax period Is calendar year January 1 through December 31. Pro-rated fees for new
businesses are effective April 1, July I and October 1. For failure to pay the license tax
when due, a penalty will be added of twenty five percent (25%) of such license tax on
the last day of each month after the due date thereof, provided that the amount of
such penalty shall not exceed one hundred percent (100%) of the amount of the
license tax due.

CONDITIONAL USE PERMITS
MAJOR CUP:
New uses in combination with new construction or existing
development in excess of 5,000 square feet of floor area,
new auto services or repair related uses, and new apartment
or condominium projects in excess of 3 dwelling units,
condominium conversions.
MINOR CUP:
New uses in combination with new construction or existing
development with 5,000 square feet or less of floor area, new
uses within existing structures, expanded or modified existing
uses, signs, new apartment or condominium project with 3
dwelling units or less, second single family dwellings.
DESIGN REVIEW
MAJOR NEW:
New development in excess of 5,000 square feet of floor area
or building relocations.

PLEASE NOTE:

in existing floor area of 50% or less, and/or existing façade or
site modifications which constitute a change in 3 or less
major design elements which do not result in a complete
façade upgrade, single family homes not part of a
subdivision, residential room additions, and new or modified
accessory structures associated with existing development.
New development that deviates from a specific development
standard, all existing development which deviates from a
standard by more than 10%.
Existing development that deviates from a specific
development standard by less than 10%, new single family
homes not part of a subdivision, or projects where the site will
contain less than 3 new apartments or new condominiums.
Where there is a question as to what category a project
should be classified, the Director reserves the right to
determine the applicable category a project should fall within.

Determination, in accordance with AB 3158, as established by the California State Department of Fish and
Game. If additional fees are required, the applicant will be required to provide the City with a cashie~s check
for the additional fees, payable to the Orange County Clerk-Recorder within 48 hours of project approval.

Initial deposit fees are required at the time of application submittal. Actual staff costs will be subtracted from
the deposit and any additional staff costs incurred above the initial deposit will be due to the City.
Fees are intended to cover the cost of processing a standard application typically including but not more than
two (2) meetings with the applicant. Requests or requirements for additionai staff meetings, responses to
correspondence/e-mails, etc. are to be reimbursed at actual staff and City Attorney/Special Counsel costs.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TUSTIN, CALIFORNIA, ESTABLISHING A REVISED
SCHEDULE FOR PLANNING FEES AND SERVICE
CHARGES WITHIN THE PLANNING DIVISION OF THE
COMMUNITY DEVELOPMENT DEPARTMENT
The City Council of the City of Tustin does hereby resolve as follows:
I.
The City Council finds and determines as follows:
A.
The Community Development Department is responsible for processi~g
entitlements, which results in the Department incurring certain processing,
administrative, and production costs.
B.
The existing Planning Division fee schedule, as adopted by Resolutlpn
No. 04-26, is not commensurate with the actual cost of providing planning
and City Attorney/Special Counsel services, particularly for larger scale
residential, commercial, and industrial projects.
C.
The California Govemment Code allows the City to charge applicants
reasonable fees not to exceed the amount reasonably necessary 'to
provide the services required for processing of certain development and
planning and permit applications.
II. The City Council hereby establishes a revised fee schedule for Community
Development Department, as shown in the attached Exhibit A, incorporated herein by
reference. Said fee schedule shall supersede previously established Planning Divisibn
fees adopted by City Council Resolution 04-26 and shall be applied uniformly except
whElre, in the discretion of the City Manager, reduced fees are justified by speoial
circUmstances.
III. Pursuant to Govemment Code Section 66017, the revised Planning fees and
service charges shall not be effective until sixty (60) days after this Resolution is adopted.
PASSED AND ADOPTED at a regular meeting of the Tustin City Council, held
on the 6th day of June, 2005.

Resolution 86-1). This memo will reflect the results of the time and motion study for each
applicable fee.
For each time and motion study, specific costs are referenced. Those costs were derived from
