HomeMy WebLinkAboutCC RES 05-101 RESOLUTION NO. 05-101 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN APPROVING GENERAL PLAN AMENDMENT 02- 001 AMENDING THE GENERAL PLAN LAND USE DESIGNATIONS FROM A MIXTURE OF LAND USE DESIGNATIONS TO PUBLIC/INSTITUTIONAL TO ACCOMMODATE THE CONSTRUCTION OF A NEW LIBRARY AT 345 E. MAIN STREET. The City Council does hereby resolve as follows: I. The City Council finds and determines as follows: A. That a public hearing was duly called, noticed, and held on said application on September 12, 2005, by the Planning Commission and the Planning Commission adopted Resolution No. 3997 recommending that the City Council approve General Plan Amendment 02-001. C. That a public hearing was duly called, noticed, and held on said application on September 19, 2005, by the City Council. D. That General Plan Amendment 02-001 is consistent with and implements the following Land Use Element goals and policies of the General Plan: Resolution No. 05-101 Page 1 of 5 2) 3) 4) E. 1) Goal 1: Provide for a well balanced land use pattern that accommodates existing and future needs for community facility and services. Policy 8.1: Encourages a wide range of accessible public facilities and community services including educational, cultural, and recreational opportunities and other governmental and municipal services. Policy 1.5: Encourage compatible and complementary infill of previously by-passed parcels in areas already predominantly developed. Policy 2.2: Maintain consistency between the Land Use Element, Zoning Ordinances, and other City ordinances, regulations and standards. That the proposed amendments to the land use designation are in the best interest of the public and ensure consistency between the General Plan and the Zoning Ordinance. F. That a Final Negative Declaration was prepared and adopted on May 6, 2002, in accordance with the provisions of the California Environmental Quality Act (CEQA). G. That pursuant to Section 15162 of the Guidelines for the California Environmental Quality Act ("CEQA"), (1 ) (2) (3) Resolution No. 05-101 Page20f5 No substantial changes are proposed in the project which will require major revisions to the previous Final Negative Declaration due to the involvement of new significant environmental effects or a substantial increase in the severity of a previously identified environmental effect; No substantial changes have occurred with respect to the circumstances under which the project is undertaken which will major revisions to the previous Final Negative Declaration due to the involvement of new significant environmental effects or a substantial increase in the severity of a previously identified environmental effect; and, No new information of substantial importance, which was not known and could not have been known with the exercise of reasonable diligence at the time the prior Final Negative Declaration was adopted shows (a) the project will have one or more effects not discussed in the previous Final Negative Declaration; (b) significant effects previously examined will be substantially more severe that shown in the previous Final Negative Declaration; (c) mitigation measures or alternative previously found not be feasible would in fact be feasible and would substantially reduce one or more significant effects, but the City declines to adopt such measures or alternatives; or (d) mitigation measures or alternatives which are considerably different from those analyzed in the previous Final Negative Declaration would substantially reduce a significant effect, but the City declines to adopt the measure or alternative. II. The City Council hereby approve General Plan Amendment 02-001 amending the General Plan Land Use Designation of the project site from a mixture of land use designations to "Public/lnstitutional," as identified in Exhibit A attached hereto.
