HUSTON, CITY MANAGER PUBLIC WORKS DEPARTMENT/FIELD SERVICES DIVISION SUBJECT: REJECTION OF BIDS, APPROVAL OF PLANS MODIFICATIONS AND AUTHORIZATION TO RE-ADVERTISE FOR BIDS FOR THE INSTAllATION OF A WICK IRRIGATION SYSTEM ON JAMBOREE ROAD - PHASE II (CIP NO. 1538) SUMMARY Reject all bid proposals received on this project, approve plans and specification modification, authorize, and direct the City Clerk to re-advertise for bids. All bid proposals received were considerably higher than the engineer's estimate and the available funds for this project. This project will install Phase II of a Wick Irrigation System on Jamboree Road. RECOMMENDATION It is recommended that the City Council: 1. Reject all bids received on August 23, 2005. 2. Approve plans and specification modification, authorize, and direct the City Clerk to re- advertise for bids. FISCAL IMPACT The FY 2004-2005 Capital Improvement Project budget for Jamboree Road Irrigation System Replacement (CIP No. 1538) provides adequate funds for this project. The engineer's estimate for this portion of work is $100,000. IRWD will reimburse the City 50% or $50,000 as their share of this joint project. BACKGROUND On June 20, 2005, the City Council adopted Resolution No. 05-30 approving the plans and specifications for this project. The project was subsequently advertised and three bids were received and opened on August 23, 2005. Those bids are summarized as follows: Belaire West landscape - Buena Park Diversified landscape Management, Inc. - Riverside Mega Way Enterprise - Pomona $112,220.00 $170,500.00 $187,500.00 Rejection of Bids, Approval of Plans Modification and Authorization to Re-Advertise for Bids for the Installation of a Wick Irrigation System on Jamboree Road - Phase II (CIP No. 1538) October 17, 2005 Page 2 Subsequent to the bid opening, the apparent low bidder "Belaire West Landscape (BWL)" called the City and informed City staff that they have made a clerical error in their bid. On August 29, 2005, staff received a fax letter from BWL requesting to withdraw their bid due to a clerical error in the amount of $30,000. The new bid amount of $142,220 is 42% above the engineer's estimate of $100,000. Staff believes these bids to be excessive and recommends rejection of this bid. Because of the claim of clerical error, under Contracts Code Section 5105, BWL will be prohibited from participating in future bidding on this project. In analyzing the unit costs for all bids received on this project, it was determined that minor modifications to the plans and specifications and re-bidding of the project could result in an overall project cost near or below the engineer's estimate. Therefore, the plans and specifications were modified accordingly and are ready for re-bid.
