TO ESTABLISH A MASTER SIGN PROGRAM THAT DEVIATES FROM THE SIGN CODE FOR THE TUSTIN CROSSINGS COMMERCIAL CENTER REQUEST: RECOMMENDATION That the Planning Commission approve Conditional Use Permit 05-029 by adopting Resolution No. 4001. BACKGROUND On March 21, 2005, the Zoning Administrator approved Design Review 04-030 for the remodeling and parking lot reconfiguration of the Tustin Crossings commercial center. Pursuant to Tustin City Code (TCC) Section 9403g, a master sign plan is required for multi-tenant centers. Master sign plans that comply with the provisions of the sign code are processed administratively. However, since the proposed master sign plan deviates Planning Commission Report CUP 05-029 October 24, 2005 Page 2 from the sign code, TCC Section 9403h2(e) requires that the Planning Commission review a conditional use permit for the proposed master sign plan. Site and Surrounding Properties The project site is located within the City's Retail Commercial (C1) Zoning District and Community Commercial General Plan land use designation. The center is north of Old Irvine Boulevard, south of a convenience store and multi-family residences, east of Newport Avenue and Lafayette Plaza, and west of a bowling alley (Attachment A - Location Map). Center Design/Architecture The center is oriented such that the buildings are setback from adjacent streets and the parking lot is in front of the buildings. The center is undergoing a remodel to reflect architecture having French and Spanish influences to blend in with the oil lube building adjacent to the site and Plaza Lafayette across Newport Avenue. The center redesign provides for a sign band that spans above an arcade covering the tenant spaces and faces onto Newport Avenue (Attachment B - Project Plans). DISCUSSION Wall Sign Design Guidelines/Requirements With the exception of the one (1) major tenant for the center, all tenant wall signs would have halo illumination behind black aluminum channel letters with minor exceptions possible through property owner authorization. The major tenant would not be limited to black letters and would be allowed to utilize internally illuminated channel letters behind Plexiglas. Various logos and type styles would be permitted for all tenant wall signs. Tenant signs would be allowed in up to two (2) lines, but the maximum sign height for non-major tenants would be one (1) and a half feet. The maximum sign length would not exceed 75 percent of any storefront length. All minor tenant signs would be required to be centered above their respective tenant spaces. The major tenant would be permitted to have two (2) signs with two (2) foot high letters, and the maximum sign length would not be permitted to exceed 75 percent of any storefront length. The Tustin Sign Code allows each tenant one primary on-building sign of up to 75 square feet and a secondary sign up to 25 square feet when the building faces two street or parking areas. However, the applicant is requesting two (2) on-building signs that are approximately 43 square feet each. As indicated in the findings section of the report, staff feels that the sign code exception is appropriate for the major tenant. Staff has provided Condition 2.3 to ensure that the major tenant signs could not exceed 75 square feet which is the maximum amount of wall sign area permitted by the sign code. Prohibited Signs The master sign program proposes prohibited signs for the center that coincide with the Tustin Sign Code. However, not all prohibited signs of the sign code are identified in the Planning Commission Report CUP 05-029 October 24, 2005 Page 3 master sign plan. Condition 2.4 would ensure that all prohibited signs of the sign code are also prohibited for the center. Monument Sign Specifications The proposed center identification and tenant directory combined monument sign is proposed in a landscape area adjacent to the Newport Avenue right-of-way and would consist of a five (5) foot high stone veneer base that supports a six (6) foot high area for four (4) individual minor tenant signs below a four (4) foot high major tenant sign. Overall the monument sign, including the base and decorative wood trim accessories, would be 17.5 feet tall and 10.5 feet wide. The sign code limits monument signs to six (6) feet tall unless otherwise approved by the Planning Commission through the conditional use permit process. Staff feels that the proposed sign height is appropriate for the center as stated in the findings section of this report. The total proposed sign area is 100 square feet and includes a 10 square foot center identification sign on the sign base, 54 square feet of sign area in the center for four (4) minor tenants, and 36 square feet on top for the major tenant. The signs would consist of backlit aluminum panels with pushed through text. The sign code limits tenant directory signs to 75 square feet of sign area unless otherwise approved by the Planning Commission through the conditional use permit process. Each individual minor tenant sign on the monument sign would be 13 and one-half square feet in area and the major tenant would be 36 square feet. The sign code limits each individual tenant to six (6) square feet of sign area. Staff feels that the proposed sign area and increased tenant sign area on the monument sign is appropriate for the center as stated in the findings section of this report. FINDINGS In determining whether to approve the Conditional Use Permit, staff has prepared the findings below that the Planning Commission may use to determine that the proposed master sign program will not be detrimental to the health, safety, morals, comfort, and general welfare of the persons residing in or working in the neighborhood, and that the master sign program will not be injurious or detrimental to property or improvements in the vicinity, or to the welfare of the City. Should the Planning Commission choose to deny the proposal or any aspects of the proposal, alternative findings would need to be provided which staff would need to return to the Planning Commission in a revised resolution at a later date. Staff recommends that the Planning Commission approve the request based upon the following findings: 1) Section 9403g and Section 9404b6 of the Tustin City Code provides for the adoption of master sign programs and allows for deviations from standards contained in the Tustin Sign Code provided that the project is located within a center with at least thirty thousand (30,000) square feet of building area. Gateway 5) 6) Planning Commission Report CUP 05-029 October 24, 2005 Page 4 Plaza meets the criteria in that it contains approximately 30,400 square feet for commercial uses and is located within a center. 2) The proposed secondary on-building wall sign for the major tenant which is over 25 square feet would be compatible with the scale of the buildings in that the sign will be of a size scalable to the tenant's building street frontage; the secondary sign faces a secondary arterial street; the sign will be located below the roof line; the sign is the only wall sign proposed that would not be consistent with the Tustin Sign Code; the sign would not detract from the building architecture; and, the tenant occupies 15,000 square feet of floor area which, if divided into two (2) spaces, could result in the same amount of sign area as requested except it would be for two (2) separate tenants. 3) The establishment of the 17.5 foot high monument sign is appropriate for the center given that it is the only tenant directory sign for the center; no monument sign is proposed to face Old Irvine Boulevard; the sign would be constructed of comparable colors and high quality materials that match the remodeled center; the sign would incorporate center identification on the sign base; the sign would not be located anywhere near a traffic visual obstruction area; the sign is close to the height of a sign recently approved by the Planning Commission for Lafayette Center across the street; and, the sign would replace a sign of comparable height that is currently utilized by the center but requires removal in association with a City-initiated Newport Avenue widening project. 4) The increased tenant sign area on the monument sign is appropriate in that the applicant is not proposing a sign for each tenant in the center on the sign which results in less sign clutter; provides greater visibility to major tenant signs to draw persons into the center and results in exposure to businesses not identified on the sign; and, provides for larger font sizes making identified tenants visible from a greater distance to vehicular customers. Sign size and placement restrictions of the Tustin Sign Code and the intent and purpose of the sign regulations for the, Retail Commercial Zone District are followed as closely as practicable in that the total area of on-building signs proposed does not exceed what is customary for a commercial center nor what could be allowed by the sign code were smaller tenant spaces proposed. The proposed monument sign is practicable given that the sign code allows for deviations to the code, only one monument sign is requested, and a sign for the commercial center across the street approximates the same height. There are special circumstances unique to the property to justify variations from the Tustin Sign Code in that the center sign would replace a sign of comparable height that is currently utilized by the center but requires removal in association with a City-initiated Newport Avenue widening project. Planning Commission Report CUP 05-029 October 24, 2005 Page 5 7) Granting of the permit will not have a negative impact on surrounding properties, would promote public health, safety, welfare and aesthetics of the community, and would meet the findings and intent of the Tustin Sign Code in that implementation of the Master Sign Plan will prevent the signage from becoming non-conforming or dilapidated in that, as conditioned, the master sign plan would ensure that the property owner carries out the necessary repairs and maintenance of the center's signs. Furthermore, the sign program promotes an orderly and efficient distribution of signs for the center while, at the same time, prevents the proliferation of unnecessary signs in the center. JOB NO. 05-5516 4-12-05 PG 1 : TUSTIN CROSSINGS SUBMITTALS & APPROVALS There is a formal process for the creation, review and approval ofTenant signs at Tustin Crossings. All Tenant signage is subject to the Owner's, or their managing agent (hereinafter referred to as "Owner"), written approval. Approval will be granted based on the following: 1. Design, fabrication and method of installation of all signs shall conform to this sign program. 2. Proposed signage is in harmony with adjacent signage conditions and conforms with the design standards for Tustin Crossings. A. SUBMITTAL TO OWNER: Tenant shall submit three (3) copies of detailed shop drawings to Owner for approval prior to permit submittal or sign fabrication. Sign drawings are to be prepared by a California licensed sign contractor. All signs must conform to the requirements of City of Tustin Planning Division. Submittals shall include the following: 1. STOREFRONT ELEVATION: Scaled elevation of Tenant's storefront depicting the proposed sign design and all the dimensions as they relate to the Tenant's storefront. 2. SHOP DRAWINGS: Fully dimensioned and scaled shop drawings specifying exact dimensions, copy layout, type styles, materials, colors, means of attachment, illumination, electrical specifications, and all other details of construction. Section through letter and/or sign panel showing the dimensioned projection ofthe face ofthe letter or sign panel and the illumination. 3. SAMPLE BOARD: Provide a sample board showing colors, materials, including building fascia, letter faces, trim cap, returns, and other details. If shop drawings are denied, Tenant must resubmit revised plans until Owner's approval is obtained. Request to implement signs that vary from the provisions of this sign program will be submitted to the Owner for approval and then submitted to City of Tustin Planning Division for approval. The Owner may approve signs that depart from the specific provisions and constraints of this sign program in order to: a. Encourage exceptional design. b. Accommodate imaginative, unique and tasteful signs that capture the spirit and intent of this sign program. c. Mitigate problems in the application of this sign program. B. SUBMITTAL TO County: A full set of plans must be approved and stamped by the Owner prior to permit application. Tenant or their Sign Contractor must submit to City of Tustin Planning Division, and will be responsible for all applicable applications, permit fees for the Planning Division. Tenant and their Sign Contractor will not be permitted to commence installation of the exterior sign unless all of the following conditions have been met: 1. A stamped set of final drawings reflecting the Owner's and City's approval shall be on file in the Owner's office. 2. All sign contractors must be fully insured and approved by Owner prior to installation. Owner must receive the Sign Contractor's Certificate of Insurance. 3. The Owner must be notified 48 hours in advance prior to sign installation. C. INSTALLATION: Tenant's Sign Contractor shall install required signage within 45 days after approval of shop drawings, but in no event later than 10 days after opening for business. If signage is not in place by that date, Owner may order sign fabrication and installation on Tenant's behalf and at the Tenant's expense. D. TENANT'S RESPONSIBILITY: The Owner may, at their sole discretion and at the Tenant's expense, correct, replace, or remove any sign that is installed without written approval and/or that is deemed unacceptable pertaining to this sign program. If the Tenant chooses to change their exterior sign at anytime during the term of their lease, then Tenant must comply with the requirements set forth herein and any future modifications, revisions or changes which have been made to this sign program for this center after the execution of their lease agreement. Tenant shall be ultimately responsible for the fulfillment of all requirements and specifications, including those of the Owner, City, Uland the Uniform Electrical Code. Tenant shall be responsible for the following expenses relating to signage for their store: -Design consultant fees (if applicable). -100% of permit processing cost and application fees. -100% of costs for sign fabrication and installation including review of shop drawings and patterns. - All costs relating to sign removal, including repair of any damage to the building. High quality halo illuminated channel letter signage, which reflects the integrityofthearchitecture, will be required. A. ILLUMINATION: - Halo illumination with neon or LED's. - Channel letters with neon or LED's. B. SIGN COLORS AND FINISHES: All Tenants' colors must be approved by the Owner prior to fabrication. To assist in achieving a harmonious blend of color throughout the center, the following guidelines are to be adhered to: -Sign colors should be selected to provide sufficient contrast against building background colors and be compatible with them. -Colors within each sign should be compatible. -Default return and face color to be black. Exception may be made by Owner for Tenants with sign standards that deviate from this specification. C. TYPE STYLES AND LOGOS: The use of logos and distinctive type styles is encouraged for all tenant signs. Tenants may utilize their logo graphics and type style, provided that they are compatible with the architecture and approved by the Owner. Animated, audible or moving signs: Signs which move, swing, rotate, flash, except as provided in this text. . Vehicle Signs: Signs affixed or on trucks, automobiles, trailers and other vehicles which advertise, identify or provide direction to a use or activity not related to its rightful use, are prohibited. . Off premise signs: (other than directional signs) installed for the purpose of advertising a project, event, person or subject not related to the premises upon which said sign is located. Such sign may be allowed upon City and Owner approval PG 3: TUSTIN CROSSINGS FABRICATION REQUIREMENTS FOR EXTERIOR TENANT SIGNS S¡(,,\^C¡ ~ The fabrication and installation of all signs shall be subject to the following restrictions: A. All signs to consist of individual halo illuminated channel letters fabricated from minimum 0.063 aluminum. Letter return depth to be 3 112 inches deep. All letters to have 3/16-inch thick clear Lexan back lenses and minimum two (2) 1/4-inch diameter weep holes drilled in bottom of each. Letters to be installed pin-mounted 1-1/2 inches off building fascia. Logo fabrication and illumination to match that of letters. B. All signs shall be fabricated and installed with UL approved components in compliance with all applicable building and electrical codes and permits. C. Sign manufacture shall supply a UL label, as required by local authorities, in an inconspicuous location. In no case shall any manufacture's label be visible from the street from normal viewing angles. D. Sign permit stickers shall be affixed to thetopedge of signs. E. Signs shall be made of durable rust inhibited materials that are appropriate and complementary to the building. F. All formed metal (i.e. letterforms) shall be fabricated using full weld construction. G. All signs shall be fabricated and installed with no visible screws, seams, rivets, or fastening devices. Finished surfaces shall be free from "oil canning"or warping. H. Separate all ferrous and non-ferrous metals. Threaded rods or anchor bolts shall be used to mount sign letters that are spaced off from the wall or background. Mounts consist of all thread post and spacer sleeves for consistency. Spacers painted to match building color. All bolts and mounting devices shall consist of porcelain finished iron, stainless steel, aluminum or carbon bearing steel with painted finish. No black iron will be permitted. Angle clips attached to letter sides will not be permitted. J. Paint colors and finishes must be reviewed and approved by the Owner. Color coatings shall match exactly the specified colors on the approved plans. K. All sign finishes shall be free of dust, orange peel, drips, and runs. Finishes should have uniform coverage and be of the highest quality (e.g., Matthews Paint Company (800) 323-6593). L. Neon tubing shall be 12-13mm, EGL or equal. Neon transformers shall be 30 MA. The master sign plan deviates from the Tustin Sign Code with a 17.5 foot tall, 100 square foot, center identification/tenant directory monument sign; four (4) minor tenant identification signs within the monument sign that are 13.5 square feet each; a 36 square foot major tenant identification sign within the monument sign; and, a secondary on- building sign over 25 square feet for the major tenant. B. That the proposed master sign plan is consistent with the Tustin General Plan in that the property is designated as "Community Commercial" and allows for commercial uses and their supporting signs. In addition, the project has been reviewed for consistency with the Air Quality Sub-Element of the City of Tustin General Plan and has been determined to be consistent with the Air Quality Sub-Element in that the addition of signs will not affect air quality. C. The project is located within the Retail Commercial "C1" zoning district where signs supporting permitted uses in centers are allowed with a master sign program. D. That a public hearing was duly called, noticed, and held for said application on October 24, 2005, by the Planning Commission. E. As conditioned, the proposed use will not be detrimental to the health, safety, morals, comfort, and general welfare of the persons residing in or working in the neighborhood in that: Resolution No. 4001 Page 2 Finding for Authorization to Approve the Master Sign Plan with Deviations from the Sign Code 1) Section 9403g and Section 9404b6 of the Tustin City Code provides for the adoption of master sign programs and allows for deviations from standards contained in the Tustin Sign Code provided that the project is located within a center with at least thirty thousand (30,000) square feet of building area. Gateway Plaza meets these criteria in that it contains approximately 30,400 square feet for commercial uses and is located within a center. The proposed signs are appropriate since Tustin Crossings is a large scale development with large building masses that will contain services for residents and businesses in and outside of the City of Tustin. Finding for Secondary On-building Sign over 25 Square Feet 2) The proposed secondary on-building wall sign for the major tenant which is over 25 square feet would be compatible with the scale of the buildings in that the sign will be of a size scalable to the tenant's building street frontage; the secondary sign faces a secondary arterial street; the sign will be located below the roof line; the sign is the only wall sign proposed that would not be consistent with the Tustin Sign Code; the sign would not detract from the building architecture; and, the tenant occupies 15,000 square feet of floor area which, if divided into two (2) spaces, could result in the same amount of sign area as requested except it would be for two (2) separate tenants. Monument Sign Findings 3) The establishment of eight foot high monument signs is appropriate for the center given that it is the only tenant directory sign for the center which faces onto primary and secondary arterial streets; the sign would be constructed of comparable colors and high quality materials that match the remodeled center, the sign would incorporate center identification on the sign base; the sign would not be located anywhere near a traffic visual obstruction area; the sign is close to the height of a sign recently approved by the Planning Commission for Lafayette Center across the street; and, the sign would replace a sign of comparable height that is currently utilized by the center but requires removal in association with a City-initiated Newport Avenue widening project. Resolution No. 4001 Page 3 4) 5) 6) 7) 8) The increased tenant sign area on the monument sign is appropriate in that the applicant is not proposing a sign for each tenant in the center on the sign which results in less sign clutter; provides greater visibility to major tenant signs to draw persons into the center and results in exposure to businesses not identified on the sign; and, provides for larger font sizes making identified tenants visible from a greater distance to vehicular customers. General Master Sign Plan Findings Sign size and placement restrictions of the Tustin Sign Code and the intent and purpose of the sign regulations for the Retail Commercial Zone District are followed as closely as practicable in that the total area of on-building signs proposed does not exceed what is customary for a commercial center nor what could be allowed by the sign code were smaller tenant spaces proposed. The proposed monument sign is practicable given that the sign code allows for deviations to the code, only one monument sign is requested for the 30,000 square foot center and a sign for the commercial center across the street approximates the same height. There are special circumstances unique. to the property to justify variations from the Tustin Sign Code in that the center sign would replace a sign of comparable height that is currently utilized by the center but requires removal in association with a City-initiated Newport Avenue widening project. Granting of the permit will not have a negative impact on surrounding properties in that the master sign plan serves as a property improvement and prevents the proliferation of signs in the center. The master sign program promotes the public health, safety, welfare and aesthetics of the community and that the granting of the permit meets the findings and intent of the Tustin Sign Code in that implementation of the Master Sign Plan will prevent the signage from becoming non-conforming or dilapidated in that, as conditioned, the master sign plan would ensure that the property owner carries out the necessary repairs and maintenance of the center's signs. Furthermore, the sign program promotes an orderly and efficient distribution of signs for the center while, at the same time, prevents the proliferation of unnecessary signs in the center. All proposed signs comply with visual clearance requirements of the Tustin City Code. Resolution No. 4001 Page 4 F. That this project is Categorically Exempt pursuant to Section 15304 (Class) of the California Environmental Quality Act. II. The applicant shall hold harmless and defend the City of Tustin from all claims and liabilities arising out of a challenge of the City's approval for this project. The applicant shall be responsible for costs associated with any necessary code enforcement action, including attorney fees, subject to the applicable notice, hearing, and appeal process as established by the City Council by ordinance. All signs within the center shall be maintained in good condition at all times. New or replacement signs shall conform to the Master Sign program and require sign permits from the City prior to sign installation. On-building signs, including secondary signs for the major tenant, may not exceed 75 square feet. The sign prohibitions of Tustin City Code Sections 9401 to 9413 shall apply to the subject commercial center in addition to any additional sign prohibitions proposed under the master sign program. Payment shall be required based upon those rates in effect at the time of payment and are subject to change. A. Building permit plan check and permit fees to the Community Development Department based on the most current schedule. Within forty-eight (48) hours of approval of the subject project, the applicant shall deliver to the Community Development Department, a cashier's check payable to the COUNTY CLERK in the amount of forty- three dollars ($43.00) to enable the City to file the appropriate environmental documentation for the project. If within such forty-eight (48) hour period that applicant has not delivered to the Community Development Department the above-noted check, the statute of limitations for any interested party to challenge the environmental determination under the provisions of the California Environmental Quality Act could be significantly lengthened.
