CONDITIONAL USE PERMIT (CUP) 2019-00024 APPLICANT: CAROL DEVIER-HEENEY DLA INSTALLATION MANAGEMENT FOR ENERGY, DM-FEE 8725 JOHN J. KINGMAN ROAD, SUITE 2941 (DESC- FQ) FORT BELVOIR, VA 22060-6222 PROPERTY OWNER: LAFAYETTE PLAZA, INVESTORS LP 24800 CHRISANTA DRIVE, #130 MISSION VIEJO, CA 92691 LOCATION: 13011-13051 NEWPORT AVENUE REQUEST: Authorization to install a soil remediation system and below ground conveyance piping associated with the contamination of the EI Toro Pipeline Release Project for up to five (5) years. ENVIRONMENTAL STATUS: This project is categorically exempt (Class 30) pursuant to Section 15330 of the California Environmental Quality Act. RECOMMENDATION: That the Zoning Administrator adopt Zoning Administrator Action (ZAA) No. 20-002 approving Conditional Use Permit (CUP) 2019-00024 to install a soil remediation system and below ground conveyance piping associated with the contamination of the EI Toro Pipeline Release clean-up project at 13011-13051 Newport Avenue. Zoning Administrator Action Minutes February 27, 2020 Page 2 It was noted there were no members of the public in attendance for this item. The applicant, Ms. Carol Devier-Heeney, and consultants, Ms. Imelda Morales, and Mr. Neil Irish, both with The Source Group Inc./Apex Co., LLC were in attendance representing the project. The Zoning Administrator stated he had reviewed the staff report and did not need a presentation. The Zoning Administrator asked the applicant if she had an opportunity to review ZAA 20-002, including the Conditions of Approval. The applicant and consultants stated they had reviewed the Conditions of Approval and they had no comments or concerns. The Zoning Administrator asked the applicant how often the findings are reported to Department of Toxic Substances Control since they were copied on some of the email correspondence. Per Ms. Devier-Heeney, the overseeing agency is the Water Quality Control Board and that it was a courtesy between the agencies. The Zoning Administrator closed the Public Comments Section at 10:03 a.m. The Zoning Administrator adopted ZAA 20-002. The Public Hearing was closed at 10:03 a.m. REGULAR BUSINESS: None ADJOURNMENT: The date of the next meeting of the Zoning Administrator will be scheduled when items are set for hearing. **Mr. Nathan Silva, representing the Tustin Brewery Company, entered the meeting after the meeting was officially adjourned. He questioned the impacts to the LaFayette Plaza parking lot. Staff and the applicant answered his questions and Mr. Silva was satisfied.
