MINUTES OF THE SPECIAL CLOSED SESSION MEETING — 5:00 p.m.
CALL TO ORDER — 5.00 p.m.
ATTENDANCE —
Present- Mayor Dr. Allan Bernstein, Mayor Pro Tem Letitia Clark and Council
Members Charles E. Puckett, Barry W. Cooper and Austin Lumbard
Absent- None
City Clerk- Erica N. Yasuda, City Clerk
Others Present- David E. Kendig, City Attorney; Matthew S. West, City Manager
PUBLIC INPUT— None
CLOSED SESSION ITEMS - The Brown Act permits legislative bodies to discuss certain
matters without members of the public present. The City Council finds, based on advice
from the City Attorney, that discussion in open session of the following matters will prejudice
the position of the City in existing and anticipated litigation-
1. CONFERENCE WITH LEGAL COUNSEL — ANTICIPATED LITIGATION -
Significant exposure to litigation pursuant to Government Code § 54956.9(d)(2)- (2
cases)
2. CONFERENCE WITH LEGAL COUNSEL—ANTICIPATED LITIGATION - Initiation
of litigation pursuant to Government Code § 54956.9(d)(4)- (2 cases)
3. CONFERENCE WITH LEGAL COUNSEL — EXISTING LITIGATION pursuant to
Government Code § 54956.9(a)- (2 cases)

MINUTES OF THE SPECIAL MEETING OF THE CITY COUNCIL

CALL TO ORDER— 6:01 p.m.
PUBLIC INPUT— The City Council received one public comment from Daniel Lammie.
CLOSED SESSION REPORT — City Attorney David E. Kendig: The Council took no
reportable action.
COUNCIL BUSINESS
CLOSURE OF CITY PARKS IN RESPONSE TO COVID-19 PANDEMIC
Significant numbers of individuals continue to congregate and utilize City park facilities
notwithstanding guidance from state and local health officials urging individuals to remain
in their homes and to maintain social distancing protocols in the limited instances where
travel outside the home is warranted. To improve compliance with social distancing
directives and to protect the public health safety and welfare the immediate closure of all
City park facilities is recommended.
It was moved by Mayor Bernstein and seconded by Mayor Pro Tem Clark to approve the
following:
1. That the City Council, by minute order, direct the immediate closure of all City park
facilities including parking lots, playgrounds, recreational structures, picnic facilities, ball
fields, courts, exercise equipment, and play structures, and direct that City parks shall be
open solely for passive walking and bicycling provided social distancing is observed at all
times; and
2. Authorize the City Manager, in his capacity as Director of Emergency Services, to close
or reopen one or more City or private parks or portions thereof on a temporary or permanent
basis when warranted in his discretion; and
3. That nothing in this action is intended to restrict the City Manager's authority, as Director
of Emergency Services, to take additional emergency actions for the protection of the
public's health, safety and welfare.

COUNCILMEMBER COMMENTS AND REPORTS

Reminded the Tustin community to please continue to follow Orange County's orders as it
pertains to COVID-19; asked everyone to please take the current situation seriously and to
continue to practice social distancing.
Council Member Puckett
Reminded everyone to please continue to adhere to Orange County guidelines as it pertains
to COVID-19 and to continue to practice social distancing.
Mayor Pro Tem Clark
Observed a difference over the past few days with the Tustin community adhering to social
distancing; shared it has been a nice mental health break to go outside and enjoy the fresh
air; reiterated the importance of social distancing; asked staff to please place signs
regarding the importance of social distancing in city parks.
Mayor Bernstein
Announced that our society is currently experiencing a difficult time and understands
everyone is trying to balance social distancing; informed everyone the safety of the Tustin
community is top priority; thanked city staff for their continuous efforts in keeping the Tustin
community safe and for the wonderful work they continue to do; thanked Police Chief Stu
Greenberg and his department for everything they continue to do.
