CONDITIONAL USE PERMIT (CUP) 2020-00001 APPLICANT: PROPERTY OWNER: YAOLIN ZHANG CHIKASAWA MOMOYO TR BYPASS KETOCETO INC. 24800 CHRISANTA DRIVE, SUITE #130 15 WALDORF AVENUE MISSION VIEJO, CA 92691 IRVINE, CA 91612 LOCATION: 1052 WALNUT AVENUE REQUEST: To sell alcoholic beverages in conjunction with an existing restaurant. ENVIRONMENTAL STATUS: This project is categorically exempt (Class 1) pursuant to Section 15301 of the California Environmental Quality Act. RECOMMENDATION: That the Zoning Administrator adopt Zoning Administrator Action (ZAA) No. 20-003 approving Conditional Use Permit (CUP) 2020-00001 to authorize the sale of alcoholic beverages for on-site consumption in conjunction with an existing 2,850- square-foot restaurant establishment (Jo Gae Chang Go) located at 1052 Walnut Avenue. It was noted there were no members of the public in attendance for this item. The Zoning Administrator opened the Public Comments section at 10:05 a.m. The Zoning Administrator stated she had reviewed the staff report and did not need a presentation. ZA Action Minutes March 16, 2020 Page 2 The Zoning Administrator asked the applicant's agent representative, Mr. Nieves, if he had an opportunity to review ZAA 20-003, including the Conditions of Approval. Mr. Nieves stated he had reviewed the agenda report and Conditions of Approval and he was in agreement. There were no comments or concerns. The Zoning Administrator closed the Public Comments section at 10:07 a.m. The Zoning Administrator adopted ZAA 20-003. CONDITIONAL USE PERMIT (CUP) 2019-00013 APPLICANT: PROPERTY OWNER: ANDREA YOUNG THE DISTRICT AT TUSTIN LEGACY UNION MARKET TUSTIN VESTARXIMCO TUSTIN L.P. 2493 PARK AVENUE 2437 PARK AVENUE TUSTIN, CA 92782 TUSTIN, CA 92782 LOCATION: 2493 PARK AVENUE REQUEST: To allow on-site alcoholic beverage sales of beer, wine, and distilled spirits in conjunction with Union Market at The District shopping center. ENVIRONMENTAL: This project is categorically exempt (Class 1) pursuant to Section 15301 of the California Environmental Quality Act. RECOMMENDATION: That the Zoning Administrator adopt Zoning Administrator Action No. 20-004 approving CUP 2019-00013 to authorize the sale of alcoholic beverages for on-site consumption in conjunction with Union Market, an indoor marketplace establishment, located at 2493 Park Avenue. It was noted there were no members of the public in attendance for this item. The Zoning Administrator opened the Public Comments section at 10:12 a.m. The Zoning Administrator stated she had reviewed the staff report and did not need a presentation. The Zoning Administrator asked the applicant, Andrea Young, if she had an opportunity to review ZAA 20-004, including the Conditions of Approval. Ms. Young stated she had reviewed the agenda report and Conditions of Approval and was in agreement. Ms. Young did ask the Zoning Administrator if the permit being issued to her was for each individual tenant who already have a CUP if they decide to apply for an alcohol license. The Zoning Administrator stated that as long as the tenants fall under the "umbrella" of this CUP, otherwise, the CUP does not apply to them. Ms. Young also asked if this CUP would allow patrons to walk around with alcohol within each establishment. The Zoning Administrator asked if the applicant meant walking outside of the District area. Ms. Young further clarified that if patrons wanted to walk (with wine or beer) within the Union Market while shopping. The Zoning Administrator responded that patrons would not be able to walk around the Union Market with wine or beer; however, she would seek clarification from the Alcohol Beverage Control. Her understanding was that patrons are limited to where they ZA Action Minutes March 16, 2020 Page 4 purchased the alcohol. The Zoning Administrator referred Ms. Young to Condition No. 2.8 of the Conditions of Approval, to further answer her previous question. The Zoning Administrator closed the Public Comments section at 10:17 a.m. The Zoning Administrator adopted ZAA 20-004. The Public Hearing item was closed at 10:17 a.m. REGULAR BUSINESS: None ADJOURNMENT: The date of the next meeting of the Zoning Administrator will be scheduled when items are set for hearing.
