Kendig, City Attorney MINUTES OF THE EMERGENCY MEETING OF THE CITY COUNCIL 3:00 P.M. CALL TO ORDER at 3:00 p.m. ROLL CALL — City Clerk Erica N. Yasuda announced that the record will reflect that all members were in attendance. PUBLIC INPUT— None CLOSED SESSION UPDATE — City Attorney David E. Kendig: The Council will convene to discuss Items 1-2 on the Closed Session Agenda. CLOSED SESSION ITEMS - The Brown Act permits legislative bodies to discuss certain matters without members of the public present. The City Council finds, based on advice from the City Attorney, that discussion in open session of the following matters will prejudice the position of the City in existing and anticipated litigation: 1. THREAT TO PUBLIC SERVICES OR FACILITIES (Government Code Section 54957): Consultation with Police Chief and City Attorney 2. CONFERENCE WITH LEGAL COUNSEL — ANTICIPATED LITIGATION: Significant Exposure to Litigation (Government Code Section 54956.9): One case RECONVENE TO THE EMERGENCY MEETING OF THE CITY COUNCIL Reconvened at 4:31 p.m. COUNCIL BUSINESS 1. VERBAL UPDATE FROM STAFF AND DIRECTION FROM THE CITY COUNCIL CONCERNING ACCESS TO PUBLIC FACILITIES AND CITY MEASURES TO PROTECT PUBLIC SAFETY IN RESPONSE TO THE NOVEL CORONAVIRUS (COVID-19) City Council March 13, 2020 Meeting Minutes Page 1 of 2 DocuSign Envelope ID:C45BC72D-7955-46B6-89A0-68ADAD4584E8 It was moved by Council Member Puckett and seconded by Mayor Pro Tem Clark to find that an "Emergency Situation" exists in Tustin such that immediate action is required so that it is necessary to convene this emergency meeting. The motion passed unanimously. Mayor Bernstein reported the following action from Closed Session: Tonight our city council met and unanimously approved a number of preventative measures to preserve the health, safety and well-being of our diverse community. While these preventative measures may cause a temporary inconvenience, the City Council and City Staff are first and foremost prioritizing the overall health and well-being of our residents, businesses and visitors. The following preventive measures will be taken through the end of March: • Senior center—effective immediately, will be closed. Meals on Wheels service will continue on a modified basis. Current food clients will be updated. • Public events and classes at City facilities: Effective immediately, all events and classes (other than outdoor after-school programs, weather permitting) sponsored by the City or scheduled at City facilities (such as community fundraisers, citizens' academy and sports leagues) will be postponed to dates to be determined. • Private events at City facilities: Effective immediately, all events scheduled at City facilities (such as parties, weddings, nonprofit events, and sports leagues) will be Cancelled or postponed to dates to be determined. • City Public Counter Services: Beginning Monday, March 16, all City Public Counter services will be performed by City staff online, or by telephone. Access to City facilities will be limited to in-person meetings by appointment only, as necessary. • Use of Preventative Measures: Everyone is encouraged to continue complying with preventative measures identified by Federal, State and County health officials. • City Council and Commission Meetings: The Council strongly encourages the public to participate in Council and Commission meetings remotely, by streaming meetings and submitting comments to the City Clerk via email. • Meetings of City Staff — City staff will postpone non-essential meetings and, whenever feasible, conduct meetings via phone conference rather than in person.
