MEETING DATE: NOVEMBER 7, 2005 TO: WILLIAM A HUSTON, CITY MANAGER FROM: PUBLIC WORKS DEPARTMENT/ENGINEERING DIVISION SUBJECT: ACCEPTANCE OF PUBLIC IMPROVEMENTS AND AUTHORIZATION TO FILE THE NOTICE OF COMPLETION FOR THE PHASE V REGIONAL TRAIL PROJECT (CIP NO. 7085) SUMMARY Construction of the Phase V Regional Trail has been completed to the satisfaction of the City Engineer and is now ready for City Council acceptance. RECOMMENDATION It is recommended that the City Council adopt Resolution No. 05-108 accepting the Phase V Regional Trail (CIP No. 7085), and authorize the recordation of the Notice of Completion, and direct the City Clerk to: 1. Release the Labor and Materials Bond not sooner than one hundred eighty (180) days after the date of recordation of the Notice of Completion; and 2. Release the Faithful Performance Bond not sooner than one year after the date of recordation of the Notice of Completion; and Assuming no claims or stop payment notices are filed, it is further recommended that thirty-five (35) days after the date of recordation of the Notice of Completion, the City Council authorize payment of the final 10% retention in the amount of $16,770.88 to Environmental Construction, Inc. FISCAL IMPACT The total final construction contract cost for the project is $167,708.77. The project was funded by Re-Assessment District 95-1 Funds. The design and construction of the project did not increase the City's infrastructure assets because the improvements are owned by the County of Orange pursuant to the Orange County Regional Riding and Hiking Trail Agreement dated May 19,1992. Acceptance of Public Improvements and Authorization to File the Notice of Completion for Phase V Regional Trail Project (CIP No. 7085) November 7,2005 Page 2 BACKGROUND The project provided for the construction of the final segment of Orange County's Peters Canyon Regional Riding and Hiking Trail in East Tustin. The new trail consists of a 1,000 foot extension of the existing regional trail which includes a ten (10) foot wide asphalt paved bicycle trail and a ten (10) foot wide decomposed granite multi-purpose trail separated by a landscaped buffer. Pursuant to the Orange County Regional Riding and Hiking Trail Agreement dated May 19, 1992, the County of Orange will maintain the trail and the City of Tustin will maintain the landscaped areas along the trail. The Orange County Resources and Development Management Department Permits Division has also confirmed their acceptance of the work via signature approval on the county issued encroachment permit for the project. The project was completed on September 20, 2005. All of the work for this project has been completed to the satisfaction of the City Engineer, and is now ready for City Council acceptance. ~~~ Director of Public Works/City Engineer ~,t./~ Dana R. Kasdan Engineering Services Manager Attachments: Resolution No. 05-108 Location Exhibit S:ICity Councilltems\2005 CouncilltemslNOC Phase V Regional Trail No. 05-108.doc RESOLUTION NO. 05-108 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ACCEPTING THE WORKS OF IMPROVEMENT AND AUTHORIZING THE RECORDATION OF THE NOTICE OF COMPLETION FOR THE PHASE V REGIONAL TRAIL PROJECT (CIP NO. 7085) WHEREAS, Environmental Construction, Inc., having a contract with the City of Tustin to construct the hereinafter described public works and improvement; and WHEREAS, the City Engineer has duly certified to the construction and completion of said public improvement hereinafter mentioned in a manner satisfactory to the City Council of the City of Tustin; and WHEREAS, the City Council finds that said contractor has completed said public improvement hereinafter more particularly described in accordance with the provisions of the contract documents and the Notice of Completion, and acceptance of said public works and improvement should be filed and payment of the balance due said contract authorized in accordance with the contract documents; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Tustin that said public works and improvement is found to be complete, and the same is hereby accepted. Said public works and improvement is more particularly described as follows: Phase V Regional Trail Project (CIP No. 7085) BE IT FURTHER RESOLVED that the City Engineer of the City of Tustin is hereby authorized to execute and file a Notice of Completion for the acceptance of said public works and improvement described herein as required by law. PASSED AND ADOPTED at a regular meeting of the City Council of the City of Tustin held on the ih day of November 2005.
