HomeMy WebLinkAboutCC RES 97-077i RESOLUTION NO. 97-77 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, REQUESTING THAT THE 3 ORANGE COUNTY DIVISION OF THE LEAGUE OF CALIFORNIA CITIES SPONSOR LEGISLATION TO 4 ADDRESS LOCAL GOVERNMENT PROVISIONS RELATING TO ABANDONED SHOPPING CART 5 RETRIEVAL 6 The City Council of the City of Tustin does hereby resolve as follows: 7 I. The City Council finds and determines as follows: 8 WHEREAS, sho ping cart retrieval legislation enacted in 1996 (Assembly Bill 317) impose~Po~nerous restrictions on cities including a three-day advance notice re uirement to cart owners prior to impounding abandoned shopping 9 carts; an~ 10 WHEREAS, neighborhood concerns regarding the number of abandoned or stolen sho ing carts and their contribution to blight has elevated with the 11 passage o~s~sembly Bill 317; and 12 WHEREAS, Assemblyman Pringle introduced legislation (AB 1427) on behalf of the Ci . of Anaheim to amend existing law dealing with the notice t 3 provisions and %cal government charges relating to cart retrieval that was 14 supported by the Grocers Association and the League of California Cities; and ' 15 WHEREAS, the League of California Cities has indicated an anal sis of fiscal 16 impact to dries would vary significan~y under' the provisions of ~ 1427 due to the subjectivity or voluntary nature of the legislation. 17 WHEREAS, since current state law has restricted cities and counties from 18 retrieving nuisance shopping carts at the local level, it would be appropriate for the Lea e of Ca]if6rnia Cities to sponsor legislation in 1998 to repeal or 19 amend app'~cable sections of existing law dealing with cart retrieval. 20 II.
