SUBJECT: LOCAL EARLY ACTION PLANNING (LEAP) GRANTS PROGRAM
SUMMARY:
In February, the City received letter notification from the California Department of
Housing and Community Development of approved funding in the amount of $310,000
associated with the SB 2 Planning Grants Program.
At this time the Community Development Department is proposing to submit a project
application for the 2020 Local Early Action Planning (LEAP) grants program (as part of
the Local Government Planning Support Grants Program). Said application will be
submitted to the State of California, Department of Housing and Community
Development, for the maximum amount of non-competitive funding allowed to the City
of Tustin ($300,000). The LEAP grants program is intended to provide funding to local
governments that assist in the preparation and adoption of planning documents and
process improvements that accelerate housing production and facilitate compliance to
implement the sixth cycle of the regional housing needs assessment (RHNA). The
City's application is anticipated to propose two projects that support the State's
program.
RECOMMENDATION:
That the City Council: Adopt Resolution No. 20-23 (Attachment A) authorizing and
directing the City to apply for and submit to the State of California, Department of Housing
and Community Development, the 2020 LEAP (as part of the Local Government Planning
Support Program) application in an amount of $300,000; authorize the Community
Development Director to enter into and execute an agreement with the State for said
funds, and, to manage the grant.
FISCAL IMPACT:
The grant provides reimbursement payments for all grant-related expenses. The City
must have adequate cash flow to pay all grant-related expenses prior to requesting
reimbursement from the State. Therefore, there may be a temporary fiscal impact to the
General Fund until reimbursement occurs.

BACKGROUND:
The LEAP is part of the broader Program formerly known as the Local Government
Planning Support Grants Program, which was established as part of the 2019-20 Budget
Act. The 2019-20 Budget Act provides a spectrum of support, incentives, resources and
accountability to meet California's housing goals. The Local Government Planning
Support Grants Program provides one-time grant funding to regions and jurisdictions for
technical assistance, preparation and adoption of planning documents, and process
improvements. The over-arching goals of the Program are to (1) accelerate housing
production; and (2) facilitate compliance to implement the sixth cycle of the RHNA.
Any projects that are anticipated to be pursued for use of the planning grant funding must
meet State identified eligible activities. At present, it is anticipated that the City's
application will focus on the following two potential projects:
• Preparation and adoption of the Housing Element, any associated General Plan
updates, and CEQA to accompany the effort; and
• Housing related Zoning Code video examples
Attachment B, Potential Project Information, identifies these two projects and also notes
additional projects that, should these two above referenced projects not be fully accepted
by the State HCD, would be drawn from to complete the application.
The City's application will be submitted prior to the State's due date of July 1, 2020.
The City should hear back from the State within two months of submittal and, thereafter,
enter into an agreement following approval of the application. The time associated with
projects under this Grant could commence as of this past January 27, 2020 and must
be completed by December 31, 2023. The City's Housing Element Update is required
to be submitted to the State HCD by October 15, 2021.
Staff recommends that the City Council adopt Resolution No. 20-23 authorizing staff to
submit the noted application and enter into said agreement.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TUSTIN, CALIFORNIA, AUTHORIZING APPLICATION FOR,
AND RECEIPT OF, LOCAL GOVERNMENT PLANNING
SUPPORT GRANT PROGRAM FUNDS
WHEREAS, pursuant to Health and Safety Code 50515 et. Seq, the Department of
Housing and Community Development (Department) is authorized to issue a Notice of Funding
Availability (NOFA) as part of the Local Government Planning Support Grants Program
(hereinafter referred to by the Department as the Local Early Action Planning Grants program or
LEAP); and
WHEREAS, the City Council of the City of Tustin desires to submit a LEAP grant
application package ("Application"), on the forms provided by the Department, for approval of
grant funding for projects that assist in the preparation and adoption of planning documents and
process improvements that accelerate housing production and facilitate compliance to implement
the sixth cycle of the regional housing need assessment; and
WHEREAS, the Department has issued a NOFA and Application on January 27, 2020 in
the amount of$119,040,000 for assistance to all California Jurisdictions;
NOW THEREFORE BE IT RESOLVED, the City Council of the City of Tustin resolves
as follows:
Section 1. The Community Development Director is hereby authorized and directed
to apply for and submit to the Department the Application package;
Section 2. In connection with the LEAP grant, if the Application is approved by the
State Department, the Community Development Director is authorized to submit the
Application, enter into, execute, and deliver on behalf of the City, a State of California
Agreement (Standard Agreement) for the amount of$300,000, and any and all other documents
required or deemed necessary or appropriate to evidence and secure the LEAP grant, the City's
obligations related thereto, and all amendments thereto; and
Section 3. The City shall be subject to the terms and conditions as specified in the
NOFA, and the Standard Agreement provided by the Department after approval. The
Application and any and all accompanying documents are incorporated in full as part of the
Standard Agreement. Any and all activities funded, information provided, and timelines
represented in the Application will be enforceable through the fully executed Standard
Agreement. Pursuant to the NOFA and in conjunction with the terms of the Standard
Agreement, the City hereby agrees to use the funds for eligible uses and allowable expenditures
in the manner presented and specifically identified in the approved Application.

Section 4: The City Clerk shall certify to the adoption of this Resolution and shall
file a copy of said application with the agenda packet of this City Council meeting.
