RECOMMENDATION: That the Planning Commission adopt Resolution No. 4404, determining that the sale of a 2,850 square-foot fee area located at the southwest corner of the vacant parcel located adjacent to State Route 55; north of Valencia Avenue owned by the City of Tustin to the Orange County Transportation Authority, is in conformance with the Tustin General Plan. DocuSign Envelope ID:66B73F00-B503-4C9E-BECC-69BC4783FC2F GPC Determination — Economic Development May 11, 2020 Page 2 APPROVAL AUTHORITY Pursuant to Section 65402(a) of the Government Code, the Planning Commission is authorized to determine whether the location, purpose, and extent of the proposed acquisition or disposition of real property is consistent with the General Plan. BACKGROUND AND DISCUSSION: The Orange County Transportation Authority ("OCTA"), has approached the City about negotiating the purchase of a one (1) partial fee and two (2) temporary construction easements on a portion of a City owned vacant parcel adjacent to State Route 55, North of Valencia Avenue. OCTA in cooperation with the State of California, Department of Transportation ("Caltrans"), is proposing to widen State Route 55 between Interstate Route 405 and Interstate Route 5, the Costa Mesa Freeway (SR-55) Improvement Project ("the Project"). The Project is intended to increase freeway capacity, improve traffic and interchange operations and enhance road safety. "�Y a Area to be conveyed atlts Temporary Cction Easements a. � p _ t7 , f. General Plan Conformity Pursuant to Section 65402(c) of the Government Code, prior to acquisition or disposition of real property by a local agency such as the City, a general plan conformity determination is required. The Planning Commission is authorized to determine whether the location, purpose, and extent of the proposed conveyance are consistent with the General Plan. Land Use Element Goal 1 : Provide for a well-balanced land use pattern that accommodates existing and future needs for housing, commercial, and industrial land, open space and community facilities and services, while maintaining a healthy, diversified economy adequate to provide future City services. 2. Land Use Element Goal 7: Promote expansion of the City's economic base and diversification of economic activity. 3. Land Use Element Goal 11 : Provide for an integrated business park environment in the Pacific Center East Area which both capitalizes on market opportunities and is compatible with adjacent developed land uses. The Planning Commission does hereby resolve as follows: I. The Planning Commission finds and determines as follows: A. That the City of Tustin (City) wishes to convey, at a cost to be negotiated, a portion of a City-owned parcel located adjacent to State Route 55, North of Valencia Avenue to Orange County Transportation Authority, (OCTA) for the purpose of the Costa Mesa Freeway (SR-55) Improvement Project between Interstate 405 and Interstate 5 (the Project). B. That Section 65402(a) of Government Code provides that no real property shall be disposed until the location, purpose, and extent of the project has been reported upon by the local planning agency as to the conformity with the adopted general plan. C. The proposed disposition supports several General Plan Land Use Element goals, including the following: 1. Land Use Element Goal 1: Provide for a well-balanced land use pattern that accommodates existing and future needs for housing, commercial, and industrial land, open space and community facilities and services, while maintaining a healthy, diversified economy adequate to provide future City services. 2. Land Use Element Goal 7: Promote expansion of the City's economic base and diversification of economic activity. 3. Land Use Element Goal 11: Provide for an integrated business park environment in the Pacific Center East Area which both capitalizes on market opportunities and is compatible with adjacent developed land uses. D. That Section 65402 (a) of the Government Code authorizes the Planning Commission to determine whether the location, purpose, and extent of the proposed disposition of real property are consistent with the General Plan. E. That the general plan conformity determinations required by Government Code Section 65402(a) are not "projects" requiring environmental review pursuant to the California Environmental Quality Act. The Planning Commission hereby determines that the location, purpose, and extent of the disposition of the subject parcel to accommodate the proposed widening of State Route 55 is in conformance with the approved General Plan.
