The Planning Commission does hereby resolve as follows: I. The Planning Commission finds and determines as follows: A. That the City of Tustin (City)wishes to convey, at a cost to be negotiated, a portion of a City-owned parcel located adjacent to State Route 55, North of Valencia Avenue to Orange County Transportation Authority, (OCTA)for the purpose of the Costa Mesa Freeway (SR-55) Improvement Project between Interstate 405 and Interstate 5 (the Project). B. That Section 65402(a) of Government Code provides that no real property shall be disposed until the location, purpose, and extent of the project has been reported upon by the local planning agency as to the conformity with the adopted general plan. C. The proposed disposition supports several General Plan Land Use Element goals, including the following: 1. Land Use Element Goal 1: Provide for a well-balanced land use pattern that accommodates existing and future needs for housing, commercial, and industrial land, open space and community facilities and services, while maintaining a healthy, diversified economy adequate to provide future City services. 2. Land Use Element Goal 7: Promote expansion of the City's economic base and diversification of economic activity. 3. Land Use Element Goal 11: Provide for an integrated business park environment in the Pacific Center East Area which both capitalizes on market opportunities and is compatible with adjacent developed land uses. D. That Section 65402 (a) of the Government Code authorizes the Planning Commission to determine whether the location, purpose, and extent of the proposed disposition of real property are consistent with the General Plan. E. That the general plan conformity determinations required by Government Code Section 65402(a) are not "projects" requiring environmental review pursuant to the California Environmental Quality Act.
