ITEM 113 Planning Commission Report Conditional Use Permit 05-038 Page 2 RECOMMENDATION That the Planning Commission adopt Resolution No. 4011 approving Conditional Use Permit 05-038 to authorize the establishment of a master sign plan for temporary project identification signs for the residential communities of Columbus Grove and Columbus Square. BACKGROUND . The Villages of Columbus residential communities are located within the MCAS Tustin Specific Plan. Columbus Square, also known as Tract 16581, comprises Planning Areas 4 and 5 which will account for 1075 dwelling units on 105.5 gross acres. Columbus Grove, also known as Tract 16582 and Planning Area 21, will provide for 465 dwelling units on 86.6 gross acres. The residential products associated with Columbus Grove and Columbus Square are currently in plan check. Rough grading permits for both sites have been issued and building permits are expected to be issued towards the end of January 2006. Section 3.12.1 A of the MCAS Tustin Specific Plan states that all signs within the specific plan shall conform to the provisions contained in the Tustin Sign Code. Pursuant to Section 3.12.1 C of the MCAS Tustin Specific Plan, a master sign plan is required for new development and should include on-premises directional/informational signs to facilitate smooth internal circulation. The purpose of the master sign plan is to encourage coordinated and quality design on sites where large numbers of signs will occur. The applicant is requesting several signs that will deviate from the City of Tustin Sign Code. Section 3.12.1 E of the MCAS Tustin Specific Plan provides that a master sign plan may deviate from the standards upon submittal and approval of a Conditional Use Permit. The proposed master sign plan will permit temporary project identification signs to be utilized during the construction phase and proposes their removal once the project is sold out. The Villages of Columbus communities will be treated as a single development due to the fact that construction and sales of both Columbus Grove and Columbus Square will occur concurrently. Future master sign plans for permanent signs will be established separately for both Columbus Grove and Columbus Square. Site and Location Columbus Square is located in the northwesterly corner of The MCAS Tustin Specific Plan and incorporates Planning Areas 4 and 5 (Attachment A - Location Map). Lower density residential uses are zoned for Planning Area 4 while medium and higher density residential uses are designated for Planning Area 5. The site is currently bounded by Edinger Avenue to the north and future roads of Valencia North Loop Road to the south, Severyns Road to the west, and the Planning Commission Report Conditional Use Permit 05-038 Page 3 West Connector to the east. Surrounding uses within the Specific Plan area include the Koll Business center to the west and the SCRRA/OCT A Railway to the north. Planned surrounding uses include a village services center to the east, a high school to the southeast, an urban regional park to the south, and a community park to the west. Columbus Grove is located within parcels 35 and 36 at the easternmost edge of the MCAS Tustin Specific Plan where the City of Tustin borders the City of Irvine. The site is bounded by Moffett Avenue to the north, Harvard Avenue to the east, Warner Avenue to the south, and the Peters Canyon Channel to the west. Surrounding uses include planned residential uses to the west and existing residential uses to the north, east, and south. PROJECT DESCRIPTION All signage proposed within this master sign plan is temporary and will be conditioned to be removed at the completion of the project when all unit sales have been completed. The expected duration of the proposed master sign plan for temporary project identification signage could involve several years to complete and sell all units. The proposed signs will deviate from the City of Tustin Sign Code in allowable size, height, location, quantity and placement. Pursuant to Section 3.12.1 E of the MCAS Tustin Specific Plan, any applicant requesting deviations from the Tustin Sign Code requires the approval of a Conditional Use Permit. The following summarizes the proposed signage for the Villages of Columbus. Area maps depicting the locations and design of the proposed signs are included as Attachment B. Columbus Square Signs Master Project Identification Siçms . The request is for two (2) master project identification signs to be placed onto the site's perimeter fencing along Edinger Avenue at a minimum distance of one thousand (1000') feet between one another. These proposed signs will be ten (10') feet high by five and a half (5'-6") feet wide. Materials will include an aluminum structure with vinyl copy. Project Identification Siqns . The request is for seven (7) project identification signs to be placed at various locations throughout the project. There are seven (7) different subdivisions within the community that will each have their own project identification sign. Each sign will represent a separate set of model homes. Proposed sign dimensions are nine feet, two inches (9'-2") in Planning Commission Report Conditional Use Permit 05-038 Page 4 height by five and a half (5'-6") feet wide. aluminum structure with vinyl copy. The request is for four (4) primary kiosk signs that will serve as directional indicators for the seven (7) different subdivisions. Primary kiosk signs will have the subdivision's name and a directional arrow pointing towards the subdivision. The proposed signs will be ten (10') feet high by six (6') feet wide. Materials will include an aluminum structure with vinyl copy. Secondary Kiosk Directional SiQns . The request is for six (6) secondary kiosk directional signs that will be located in areas supplemental to the primary kiosk directional signs. These proposed signs will serve the same purpose as the primary kiosk signs in directing clients to the different subdivisions. The dimensions of the proposed signs will be seven (7') feet high by six (6') feet wide. Materials will include an aluminum structure with vinyl copy. Model Home Tour Siqns . The request is for three (3) model home tour signs with the dimensions of seven (7') feet high by six (6') feet wide. Two (2) of the signs will be located along Valencia North Loop Road at a distance of six hundred fifty feet (650') between one another. The third model home tour sign will be located in the interior of the development. Materials will include an aluminum structure with vinyl copy. Master Plan Identification Banners . The request is for six (6) master plan banner flags to be placed along both sides of the primary entrance to Columbus Square located off of Valencia North Loop Road. Each flag will be six (6') feet in height by twenty-eight (28") inches in width and mounted on an eighteen (18') foot high flag pole. The request is for six (6) project identification flags to be located at each subdivision model home complex. This would provide for a total of forty- two (42) flags with the dimensions of seven (7') in height by three (3') feet in width and mounted on an eighteen (18') foot high flag pole. Construction FencinQ . The request is for construction wrap fencing banners that will read "VillagesOfColumbus.com." Banners will be placed on construction fencing along the property lines abutting Edinger Avenue at a distance of two hundred fifty (250') linear feet of one another. The banners will be approximately five and a half (5'-6") feet in height by fifteen (15') feet in length. Columbus Grove Signs Master Project Identification SiQns . The request is for three (3) master project identification signs with the dimensions of ten (10') feet high by five and a half (5'-6") feet wide. Two (2) of the proposed signs will be located along Harvard Avenue at a minimum distance of five hundred (500') feet. The third sign will be placed along Moffet Avenue at a minimum distance of five hundred (500') feet from the next closest master project sign along Harvard Avenue. Materials will include an aluminum structure with vinyl copy. Proiect Identification SiQns . Hei ht In addition, the code requires construction signs to be removed prior to approval for occupancy of the project and all project identification signs must be removed within 180 days from issuance of the first occupancy permit. The applicant is requesting deviations from these prescribed timelines to extend the lifetime of the signs until after the final home sale has been completed, which could take several years. Pursuant to Condition 3.1 of Resolution No. 4011 all temporary signs must be removed prior to release of the grading bonds for Columbus Square and Columbus Grove. FINDINGS In determining whether to approve the Conditional Use Permit for the proposed master sign plan for temporary project identification signs, the Planning Commission must determine whether or not the proposed use will be detrimental to the health, safety, morals, comfort, or general welfare of the persons residing or working in the neighborhood, nor be injurious or detrimental to the property and improvements in the neighborhood of the subject property, or to the general welfare of the City of Tustin. A decision to approve this request may be supported by the following findings: A. Section 3.12.1 A of the MCAS Tustin Specific Plan states that all signs at the site shall conform to the provisions contained in the Tustin Sign Code. Section 3.12.1 C of the MCAS Tustin Specific Plan states that a master sign plan is required for new development within the Specific Plan Area. C. Pursuant to section 3.12.1 E of the MCAS Tustin Specific Plan, a master sign plan may deviate from the standards, upon approval of a Conditional Use Permit. D. Due to the size of the development, a master sign plan for temporary project identification signs will promote coordinated design of signs throughout the development. E. The proposed master sign plan will only address project identification signs that are temporary in nature. F. All proposed signage will be located on private property and shall not encroach into the public right-of-way. G. As proposed, the signs will serve as informational tools for project identification to both pedestrians and motorists. H. The locations of the proposed signs will not obstruct or inhibit sight distance or visibility for motorists. I. The proposed signs are consistent throughout each project site by incorporating common design elements including materials, letter style, colors, sign type, and sign shape. J. Master Project Identification Sil!:ns Code Limitations - One 32 sq. ft., 6' high sign per street frontage. Relief Request: We are requesting two signs along Edinger Ave. Due to the size of the project, there would be more than 1000' between the signs. Also, as a motorist safety issue, since the speed limit is 60 m.p.h., we are requesting larger signs so they may viewed at a glance, requiring less distraction from driving. The sign sizes requested would be 10' tall by 5' - 6" wide. Project Identification Sil!:ns Code Limitations - One 32 sq. ft., 6' high sign per street frontage. With seven new subdivisions within the master plan, we find it necessary to request relief for signs large enough to accommodate all the subdivision names and facilities names within the project, with text large enough to read. Model Home Tour Sif!ns We are requesting three model home tour signs that will be 7' tall x 6' wide. Two ofthe signs will be located on Valencia North Loop Road and will have a distance between them of 650'. Considering this distance we are requesting relief. Secondary Project Kiosk Directionals We are requesting six secondary kiosk signs 7' tall by 6' wide, to be located throughout the project to give adequate directions to the various projects. The signs need to be this size to accommodate the text for all the subdivisions and we hereby request relief. Master Plan Identification Banners We are requesting six 6' tall x 28" wide banner flags on 18' flag poles. These flag poles will be placed on both sides of an unnamed street at the project entry located off Harbor (please see attached map). I' 0 ATTACHMENT C Planning Commission Resolution No" 4011 RESOLUTION NO" 4011 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, APPROVING CONDITIONAL USE PERMIT 05- 038 AUTHORIZING ESTABLISHMENT OF A MASTER SIGN PLAN FOR TEMPORARY PROJECT IDENTIFICATION SIGNS FOR THE VILLAGES OF COLUMBUS RESIDENTIAL COMMUNITIES (TRACTS 16581 AND 16582) LOCATED WITHIN THE MCAS TUSTIN SPECIFIC PLAN" The Planning Commission does hereby resolve as follows: I. The Planning Commission finds and determines as follows: A. A proper application, Conditional Use Permit 05-038, was filed by Outdoor Dimensions on behalf of Moffett Meadows Partners, requesting authorization to establish a master sign plan for temporary project identification signs for the Villages of Columbus residential communities located within the MCAS Tustin Specific Plan. The master sign plan will encompass Columbus Square, also known as Tract 16851 and Planning Areas 4 and 5 and Columbus Grove, also known as Tract 16582 and Planning Area 21. B. The General Plan MCAS Tustin Specific Plan land use designation provides for the use of temporary signs subject to the provisions of the Tustin Sign Code. In addition, the project has been reviewed for consistency with the Air Quality Sub-element of the City of Tustin General Plan and has been determined to be consistent with the Air Quality Sub-element. C. That a public hearing was duly called, noticed, and held for said application on December 12, 2005, by the Planning Commission. That the establishment, maintenance, and operation of the proposed temporary sign use will not, under the circumstances of this case, be detrimental to the health, safety, morals, comfort, or general welfare of the persons residing or working in the neighborhood of such proposed use, nor be injurious or detrimental to the property and improvements in the neighborhood of the subject property, or to the general welfare of the City of Tustin in that: D. 1) Section 3.12.1 A of the MCAS Tustin Specific Plan states that all signs at the site shall conform to the provisions contained in the Tustin Sign Code. 2) Section 3.12,1 C of the MCAS Tustin Specific Plan states that a master sign plan is required for a new development within the Specific Plan Area. Resolution No. 4011 Page 2 3) Pursuant to section 3.12.1 E of the MCAS Tustin Specific Plan, a master sign plan may deviate from the standards upon approval of a Conditional Use Permit. 4) Due to the size of the development, a master sign plan for temporary project identification signs will promote coordinated design of signs throughout the development. 5) The proposed master sign plan will only address project identification signs that are temporary in nature. 6) All proposed signage will be located on private property and shall not encroach into the public right-of-way. 7) As proposed, the signs will serve as informational tools for project identification to both pedestrians and motorists. 8) The locations of the proposed signs will not obstruct or inhibit sight distance or visibility for motorists. 9) The proposed signs are consistent throughout each project site by incorporating common design elements including materials, letter style, colors, sign type, and sign shape. E. 10)The proposed signs are temporary and will be removed once the final home sale has been completed This project is Categorically Exempt pursuant to Section 15311, Class 11 of the California Code of Regulations (Guidelines for the California Environmental Quality Act). II. The Planning Commission hereby approves Conditional Use Permit 05-038 authorizing the establishment of a master sign plan for temporary project identification signs for the residential communities of Columbus Square (Tract 16581) and Columbus Grove (Tract 16582). The Community Development Director may also approve minor modifications to plans during plan check if such modifications are to be consistent with the provisions of the Tustin City Code and other applicable codes. Conditional Use Permit 05-038 approval shall become null and void unless permits are issued within six (6) months of the date of this Exhibit and substantial construction is underway, Time extensions may be granted if a written request is received by the Community Development Department within thirty (30) days prior to expiration. All conditions contained in this Exhibit shall be complied with prior to the issuance of any building permits for the project, subject to review and approval of the Community Development Department. Approval of Conditional Use Permit 05-038 is contingent upon the applicant and property owner signing and returning to the Community Development Department a notarized "Agreement to Conditions Imposed" form and the property owner signing and recording with the County Clerk-Recorder a "Notice of Discretionary Permit Approval and Conditions of Approval" form. The forms shall be established by the Director of Community Development, and evidence of recordation shall be provided to the Community Development Department. Failure to comply with the conditions of approval shall be grounds for revocation of the conditional use permit. The City agrees to promptly notify the applicant of any such claim or action filed against the City and to fully cooperate in the defense of any such action. The City may, at its sole cost and expense, elect to participate in defense of any such action under this condition. Any violation of any of the conditions imposed is subject to the payment of a civil penalty of $100.00 for each violation, or such other amounts as the City Council may establish by ordinance or resolution, and for each day the violation exists, subject to the applicable notice, hearing, and appeal process as established by the City Council by ordinance. The applicant shall be responsible for costs associated with any necessary code enforcement, action, including attorneys fees, subject to the applicable notice, hearing, and appeal process as established by the City Council by ordinance. All signs shall comply with the applicable provisions of the Uniform Building Code, the National Electric Code and the Tustin City Code Section 9404(A)(1) as adopted by the City (including UL approvals). All signs, including any change of copy, requires review and approval by the Community Development Department prior to installation. Permits shall be required for all signs. All signs shall conform to the MCAS Tustin Specific Plan, the City of Tustin Sign Code, and the Villages of Columbus master sign plan for temporary project identification signs, All signs and their supporting structures shall be structurally safe and maintained in good condition. Construction fencing banners shall be permitted at a distance of two hundred fifty (250) feet between one another. Construction fencing banners shall conform to the locations and graphics as prescribed in the master sign plan for the Villages of Columbus temporary project identification signs. DURATION (***) 3"1 Prior to release of the grading bonds for Columbus Square and Columbus Grove, all temporary signs shall be removed from the properties and the vicinity restored. Exhibit A Resolution No. 4011 Page 3 PUBLIC WORKS DEPARTMENT (1 ) 4.1 (1 ) 4.2 (1 ) 4.3 The proposed signs shall be located on private property with adequate sight distance per the City of Tustin's Public Works Standard No. 510. The locations of signs shall also comply with the City of Tustin Guidelines for Determining Sign Location Visual Clearance and Public Safety Areas. At plan check submittal, all signs shall be clearly identified on plans as to the exact locations of the signs that are requested. Any signs in proximity to the public right-of-way that could impact driver sight shall be shown at a larger scale that will be adequate for plan check purposes. Any damage done to existing street improvements and utilities shall be repaired. Prior to any work in the public right-of-way, an Encroachment Permit shall be obtained and applicable fees paid to the Public Works Department. BUILDING DEPARTMENT (5) 5.1 (1 ) 5.2 FEES (1 ) 6.1 (1 ) 6.2 At the time of building permit application, the plans shall comply with the 2001 California Building Code (CBC), 2004 California Electric Code (CEC), California Title 24 Accessibility Regulations, 2005 Title 24 Energy Regulations, City Ordinances, and State and Federal laws and regulations 2005 edition. Building plan check submittal shall include the following: . Four (4) sets of construction plans, including drawings for mechanical, plumbing, and electrical. . Two (2) copies of structural calculations. . Note on plans that no field changes shall be made without prior approval from the Building Official and architect or engineer of record. Prior to issuance of any building permits, all payments shall be made of all applicable fees including the building division and sign permit fees. Payment shall be required based on upon those rates in effect at the time of payment and are subject to change. Within forty-eight (48) hours of approval of the subject project, the applicant shall deliver to the Community Development Department, a cashier's check payable to the COUNTY CLERK in the amount of forty-three dollars ($43.00) to enable the City to file the appropriate environmental documentation for the project. If within such forty-eight (48) hour period that applicant has not Exhibit A Resolution No. 4011 Page 4 delivered to the Community Development Department the above-noted check, the statute of limitations for any interested party to challenge the environmental determination under the provisions of the California Environmental Quality Act could be significantly lengthened.
