STACK, DIRECTOR OF PUBLIC WORKS/CITY ENGINEER SUBJECT: ADOPT RESOLUTION NO. 20-36 TO ACCEPT IMPROVEMENTS FOR THE MEDIAN LANDSCAPE REHABILITATION PROJECT, CIP NO. 10074, AND AUTHORIZE THE CITY ENGINEER TO FILE A NOTICE OF COMPLETION SUMMARY Construction of the Median Landscape Rehabilitation Project, CIP No. 10074, has been completed to the satisfaction of the City Engineer and is now ready for City Council acceptance. RECOMMENDATION It is recommended that the City Council take the following actions: 1. Adopt Resolution No. 20-36 accepting the construction of the Median Landscape Rehabilitation Project, CIP No. 10074; and 2. Authorize the City Engineer to execute and file the Notice of Completion with the Orange County Recorder's Office. FISCAL IMPACT The final construction cost for the Median Landscape Rehabilitation Project, CIP No. 10074, is $2,835,391.85, which includes authorized contract change orders in the amount of $145,840.61 that the City and contractor negotiated and mutually agreed upon. The City was not able to reach an amicable resolution of some extra work items with the contractor and therefore to facilitate project acceptance and closeout, the City issued a final change order unilaterally to the contractor in the amount of $39,445.65, paying the contractor the reasonable value for undisputed extra work performed on the project. In addition, due to the lack of a final formal payment request, a final progress payment was issued unilaterally for $11,623.90, less retention respectively. Sufficient funds were budgeted and appropriated in the Capital Improvement Program. The project is funded through a combination of sources that include Gas Tax (Fund 130), Measure M2 Fair Share (Fund 139), Measure M2 Environmental Cleanup Program Grant (Fund 139), and MCAS Land Sale Proceeds (Fund 189). CORRELATION TO THE STRATEGIC PLAN The project contributes to the fulfillment of the City's Strategic Plan Goal B: Public Safety and Protection of Assets, to ensure Tustin is an attractive, safe, and well-maintained community in which people feel pride. Specifically, the project implements Strategy #3, which among other items, is to ensure continuous maintenance and improvement of public facilities. In compliance with the State of California Governor's Executive Orders B-29-15 and B-37-16, imposing strict water use restrictions to mitigate the effects of severe drought conditions that continued to persist throughout the state at the time, the project removed dead median turf along Irvine Boulevard between the SR-55 Freeway and Old Irvine Boulevard, along First Street between the SR-55 Freeway and Newport Avenue, and along Newport Avenue between Wass Street and McFadden Avenue, and replaced with drought tolerant plant material and water efficient irrigation systems. Also included in the project were removal of existing substandard height median curbs and replacement with full height curbs, installation of median pavers and decorative hardscape, and utility relocations. Location Map S:\City Council Iterns\2020Council Items\0602-2020\NOC-Median 1 andscape Rehab(CIP 10074)\NOC staff report-Medan 1 andsr.ape Rehab(CIP 10074).DOCX DocuSign Envelope ID:017DC25D-E48F-4BC4-930A-CECD4686EE94 RESOLUTION NO. 20-36 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ACCEPTING THE WORKS OF IMPROVEMENT AND AUTHORIZING THE RECORDATION OF THE NOTICE OF COMPLETION FOR THE MEDIAN LANDSCAPE REHABILITATION PROJECT, CIP NO. 10074 WHEREAS, California Landscape & Design, Inc., having a contract with the City of Tustin to construct the hereinafter described public works and improvement; and WHEREAS, the City Engineer has duly certified to the construction and completion of said public improvement hereinafter mentioned in a manner satisfactory to the City Council of the City of Tustin; and WHEREAS, the City Council finds that said contractor has completed said public improvement hereinafter more particularly described in accordance with the provisions of the contract documents and the Notice of Completion, and acceptance of said public works and improvement should be filed and payment of the balance due said contract authorized in accordance with the contract documents; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Tustin that said public works and improvement is found to be complete, and the same is hereby accepted. Said public works and improvement is more particularly described as follows: Median Landscape Rehabilitation Project, CIP NO. 10074 BE IT FURTHER RESOLVED that the City Engineer of the City of Tustin is hereby authorized to execute and file a Notice of Completion for the acceptance of said public works and improvement described herein as required by law.
