CONFERENCE WITH LEGAL COUNSEL — ANTICIPATED LITIGATION - Significant exposure to litigation pursuant to Government Code § 54956.9(d)(2): (1 case) eComment: Councilmembers, I am curious to why City Manager West believed there was a "local emergency" in the city when there were no clear signs of any threats to life or property in Tustin. I would like to know how this was determined, with specific language regarding his decision making. I would like him to answer to the public and I encourage you, the City Council, to hold him accountable. I would also like to know why City Attorney Kendig supported the curfew despite it being a clear violation of citizens' First Amendment rights. It is worryingly similar to what might occur in an autocracy. There needs to be public accountability for both of these men for this particular decision. I would like the City to publicly comment on why the curfew was announced on Facebook at 7:15 p.m. on June 1, just 45 minutes before the curfew began. Social media is not an effective nor acceptable broadcast system for local "emergencies." I would expect that these issues be publicly addressed at the next open session.
