AGENT(S) TO ACT ON BEHALF OF THE CITY OF TUSTIN IN ALL
MATTERS PERTAINING TO HAZARD MITIGATION PLANNING GRANT

SUMMARY
The Federal Disaster Mitigation Act of 2000 requires the City to complete a Local Hazard
Mitigation Plan. Staff has been notified that the City has received funding approval by the
California Office of Emergency Services (OES) and the Federal Emergency Management
Agency (FEMA), and is required to designate staff authorized to act on the City's behalf.
RECOMMENDATION
Adopt Resolution No. 06-06 designating the City's Authorized Agent (s) for the Local Hazard
Mitigation Planning Grant # PDMC-PL-09-CA-2005-051.
FISCAL IMPACT
Adequate funds have been appropriated in the Public Works Department Operating Budget
for the City's share of this project.
BACKGROUND
The Federal Disaster Mitigation Act of 2000 requires the City to complete a Local Hazard
Mitigation Plan. The plan will include an exhaustive assessment of natural hazards in the
City and the preparation of a mitigation strategy for each identified hazard. Completion of
this project will also make the City eligible for FEMA pre and post disaster mitigation grants.
Staff applied to FEMA for a grant in the amount of $56,250 or 75% of the estimated cost of
this project. Staff estimates the City's share for this project to be $18,750.
Staff has been notified that the project has received funding approval by the OES and FEMA.
The City is required to adopt a resolution designating the City's Authorized Agent (s) to act
on the City's behalf for all reimbursement requests and required reporting.

Staff expects this work to begin this spring and be completed by the end of the year. Staff
plans to retain a consultant for a significant portion of the work. Nevertheless, the project will
still require participation by almost every department and will also require an active public
outreach program and various public hearings. When this project is completed, staff will then
use the information to revise the City's emergency plan.
Staff recommends the City Council adopt Resolution No. 06-06 designating the Public Works
Director and the PW Administrative Services Manager as the Authorized Agent (s) for this
grant program.

RESOLUTION NO. 06-06
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN,
DESIGNATING CERTAIN AUTHORIZED AGENT (S) TO ACT ON BEHALF OF
THE CITY OF TUSTIN IN ALL MATTERS CONCERNING HAZARD
MITIGATION PLANNNING GRANT # PDMC-PL-09-CA-2005-046 WITH THE
GOVERNOR'S OFFICE OF EMERGENCY SERVICES (OES) AND FEDERAL
EMERGENCY MANAGEMENT AGENCY (FEMA)
WHEREAS, the City of Tustin has received notification from the Federal
Emergency Management Agency (FEMA) that the City has been approved for a
subgrant in the amount of $56,250 for assistance in the preparation of the City's Local
Hazard Mitigation Plan;
WHEREAS, in order to receive payment, all subgrantees must have a valid
Authorized Agent(s) designated;
WHEREAS, in order to receive payment, all subgrantees must have an
Authorized Agent Resolution and Grant Assurances form on file;
WHEREAS, the City of Tustin does hereby designate the individuals indicated
below as the Authorized Agent(s) to act on behalf of the City of Tustin in all matters
pertaining to PDMC-PL-09-CA-2005-051 Local Hazard Mitigation Plan requirements;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Tustin that Tim D. Serlet, Director of Public Works/City Engineer and/or Joe Meyers,
Administrative Services Manager are hereby authorized to execute for and in behalf of
the City of Tustin, a public entity established under the laws of the State of California,
this application and to file it in the Office of Emergency Services for the purpose of
obtaining certain federal assistance under P.L. 93-288 as amended by the Robert T.
Stafford Disaster Relief and Emergency Assistance Act of 1988, and/or state financial
assistance under the California Disaster Assistance Act.
FURTHER, THEREFORE, BE IT RESOLVED that the City of Tustin, a public
entity established under the laws of the State of California, hereby authorizes its
agent(s) to provide to the State Office of Emergency Services for all matters pertaining
to such state disaster assistance the assurances and agreements required.
PASSED AND ADOPTED at a regular meeting of the City Council of the City of
Tustin held on the 3rd day of January 2006.
