Kendig, City Attorney MINUTES OF THE OF SPECIAL CLOSED SESSION MEETING OF THE TUSTIN CITY COUNCIL 10:30 A.M. CALL TO ORDER at 10:31 a.m. ATTENDANCE— Present- TTENDANCE— Present: Mayor Dr. Allan Bernstein, Mayor Pro Tem Letitia Clark and Council Members Charles E. Puckett, Barry W. Cooper and Austin Lumbard Absent: None Others Present: David E. Kendig, City Attorney; Matthew S. West, City Manager PUBLIC INPUT — 1. Anonymous 1 2. Anonymous 2 CLOSED SESSION UPDATE — City Attorney David E. Kending: The City Attorney noted that the Council received two anonymous written comments criticizing the emergency curfews on June 1 -2, 2020. The Council members each received a copy of the two anonymous written comments. It was noted that bases for the approval of the emergency curfews were included in the findings in the curfew orders themselves, and those orders are available to review on the City's website at https://www.tustinca.org/CivicAlerts.aspx?CID=9. The Council requested that staff develop and circulate on the City's website written guidelines for effective circulation to the public of future emergency orders. The Council convened into closed session at 10:33 a.m. CLOSED SESSION ITEMS - The Brown Act permits legislative bodies to discuss certain matters without members of the public present. The City Council finds, based on advice from the City Attorney, that discussion in open session of the following matters will prejudice the position of the City in existing and anticipated litigation: 1. CONFERENCE WITH LEGAL COUNSEL — ANTICIPATED LITIGATION - Significant exposure to litigation pursuant to Government Code § 54956.9(d)(2): (1 case) 2. THREAT TO PUBLIC SERVICES OR FACILITIES (Government Code § 54957): Consultation with Police Chief and City Attorney Reconvened at 12:17 p.m. CLOSED SESSION REPORT—City Attorney David E. Kendig.
