REQUEST: TO AUTHORIZE THE DISPLAY AND SALES OF GARDEN CENTER PRODUCTS AND SEASONAL ITEMS. RECOMMENDATION That the Zoning Administrator adopt Zoning Administrator Action 06-001 approving Conditional Use Permit 05-045. Site and Surroundinq Properties The site is located within the Tustin Market Place at the southwest corner of EI Camino Real and West Drive within the Planned Community Mixed-Use (PCMU) zoning district (Attachment A - Location Map). Zoning Administrator Report Conditional Use Permit 05-045 January 23, 2006 Page 2 Project Description The property owner, The Irvine Company, is currently processing Design Review 05-018 to expand the existing Home Depot and garden center, which includes demolition of the Beacon Car Wash (Attachment B - DR 05-018 Submitted Plans); however, The Home Depot is also proposing to establish an outdoor display and sales area to sell garden center related products and seasonal items (Le. Christmas Trees, barbecues, etc.). All sales would be conducted by The Home Depot and consist of products and items typically or seasonally sold by The Home Depot per Condition 2.4 of Zoning Administrator Action 06-001. The proposed garden center products would be located at the northwest corner of the proposed garden center area and located entirely outside of the parking area and on the sidewalk in designated areas per Condition 2.5. The seasonal sales area would be located within the new parking area to be located between EI Camino Real and the garden center (Attachment C - CUP 05-045 Submitted Plan). CUP 05-045 is permitting the area for seasonal sales on the plan; however, the business owner will be limited to one (1) temporary event per calendar quarter of the year and required to obtain a Temporary Use Permit (TUP), prior to each event, from the Community Development Department per the Tustin City Code and Condition 2.6. Typical plans for the perimeter fencing, to be located around the seasonal area, will need to be submitted prior to the first seasonal event per Condition 3.3. Parkinq ReQuirements/Summarv The Tustin City Code does not require additional parking for outdoor display and sales areas; therefore, no additional parking will be required in conjunction with the proposed project. FINDINGS A decision to approve this request may be supported by the finding that the establishment, maintenance, and operation of an outdoor display and sales areas will not be detrimental to the health, safety, morals, comfort, or general welfare of the persons residing or working in the neighborhood, nor be injurious or detrimental to the property and improvements in the neighborhood of the subject property, or to the general welfare of the City of Tustin, in that: a. The proposed use is allowed within the Planned Community Commercial (PC-COM) zoning district, with the approval of a Conditional Use Permit, and is consistent with the Planned Community Commercial/Business land use designation of the City of Tustin General Plan, which provides for a variety of commercial uses. The proposed use would operate in conjunction with an existing retail anchor and would only operate during the hours of operation of the primary business. c. The proposed use would comply with the current parking requirements of the Planned Community Mixed-Use (PCMU) zoning district in that no additional parking is required. d. The proposed use, as conditioned, will not be a detriment to the public health, safety, welfare in that the proposed outdoor display and sales area will be clearly defined, will not obstruct emergency exits or path of travel for disabled person, and will not obstruct vehicular or pedestrian traffic flow. e. The Zoning Administrator finds and determines as follows: A. B. C. That a proper application for Conditional Use Permit 05-045 was filed by Greg George, on behalf of The Home Depot, to authorize the outdoor display and sales of garden center products and seasonal items adjacent to the garden center located at 2782 EI Camino Real. That the proposed use is allowed within the Planned Community Mixed-Use (PCMU) zoning district, with the approval of a Conditional Use Permit, and is consistent with the Community Commercial land use designation of the City of Tustin General Plan, which provides for a variety of commercial uses, including outdoor display and sales areas. That the establishment, maintenance, and operation of outdoor display sales area will not, under the circumstances of this case, be detrimental to the health, safety, morals, comfort, or general welfare of the persons residing or working in the neighborhood of such proposed use nor be a detriment to the property and improvements in the neighborhood of the subject property, nor to the general welfare of the City of Tustin as evidel""'ced by the following findings: a. The proposed use is allowed within the Planned Community Commercial (PC-COM) zoning district, with the approval of a Conditional Use Permit, and is consistent with the Planned Community Commercial/Business land use designation of the City of Tustin General Plan, which provides for a variety of commercial uses. b. The proposed use would operate in conjunction with an existing retail anchor and would only operate during the hours of operation of the primary business. c. The proposed use would comply with the current parking requirements of the Planned Community Mixed-Use (PCMU) zoning district in that no additional parking is required. d. The proposed use, as conditioned, will not be a detriment to the public health, safety, welfare in that the proposed outdoor display and sales area will be clearly defined, will not obstruct emergency exits or path of travel for disabled person, and will not obstruct vehicular or pedestrian traffic flow. The proposed use, as conditioned, will not have a negative effect on the surrounding properties in that the location is within a retail center bounded by other retail buildings, city streets and separated from residential uses by more than 1000 feet. D. This project is Categorically Exempt pursuant to Section 15301, Class 1, Title 14, Chapter 3, of the California Code of Regulations (Guidelines for the California Environmental Quality Act). E. That a public hearing was duly called, noticed, and held on said application on January 23, 2006, by the Zoning Administrator. II. The Zoning Administrator hereby approves Conditional Use Permit No. 05-021 authorizing the outdoor display and sales of garden center products and seasonal items adjacent to the garden center located at 2782 EI Camino Real, subject to the conditions contained within Exhibit A, attached hereto. ELOISE HARRIS Recording Secretary GENERAL (1 ) 1.1 (1 ) 1.2 (1 ) 1.3 (1 ) 1.4 EXHIBIT A ZONING ADMINISTRATOR ACTION 06-001 CONDITIONS OF APPROVAL The proposed project shall substantially conform with the submitted plans for the project date stamped on January 23, 2006, the date of approval, on file with the Community Development Department, as herein modified, or as modified by the Director of Community Development Department in accordance with this Exhibit. Conditional Use Permit approval shall become null and void unless Design Review 05-018 is approved by the Community Development Director and commences within twelve (12) months of the date of this exhibit. Time extensions may be granted by the Community Development Department if a written request is received by the Community Development Department within thirty (30) days prior to expiration. Approval of Conditional Use Permit 05-045 is contingent upon the applicant and property owner signing and returning to the Community Development Department a notarized "Agreement to Conditions Imposed" form and the property owner signing and recording with the County Clerk-Recorder a "Notice of Discretionary Permit Approval and Conditions of Approval" form. The forms shall be established by the Director of Community Development, and evidence of recordation shall be provided to the Community Development Department. Failure to comply with the conditions of approval shall be grounds for revocation of the conditional use permit. As a condition of approval of Conditional Use Permit 05-045, the applicant shall agree, at its sole cost and expense, to defend, indemnify, and hold harmless the City, its officers, employees, agents, and consultants, from any claim, action, or proceeding brought by a third-party against the City, its officers, agents, and employees, which seeks to attack, set aside, challenge, void, or annul an approval of the City Council, the Planning Commission, or any other decision-making body, including staff, concerning this project. The City agrees to promptly notify the applicant of any such claim or action filed against the City and to fully cooperate in the defense of any such action. The City may, at its sole cost and expense, elect to participate in defense of any such action under this condition. The applicant shall be responsible for costs associated with any necessary code enforcement, action, including attorneys fees, subject to the applicable notice, hearing, and appeal process as established by the City Council by ordinance. Business operations shall be conducted in a manner that does not create a public or private nuisance. Any such nuisance must be abated immediately upon notice by the City of Tustin. No outdoor music or public address system shall be permitted. All outdoor sales shall be conducted by The Home Depot and consist of products and items typically or seasonally sold by The Home Depot. The proposed garden center products shall be located entirely outside of the parking area and on the sidewalk in designated areas. The business owner shall be limited to one (1) temporary event per calendar quarter of the year and required to obtain a Temporary Use Permit (TUP), prior to each event, from the Community Development Department per the Tustin City Code. Specify on plans if the fencing shown on plans for Seasonal sales is permanent or seasonal. In either case, path of travel for Handicap and the emergency exit shall not be obstructed, please address the issue. Outdoor display area, including seasonal sales area, shall have aisles of not less than forty-eight (48) inches wide minimum to accommodate handicap accessibility. Exhibit A Zoning Administrator Action 06-001 January 23, 2006 Page 3 (1 ) 3.3 (1 ) 3.4 (1 ) 3.5 FEES (C) 4.1 At the time of building permit application, the plans shall comply with the 2001 California Building Code (CBC), 2001 California Plumbing Codes (CPC), 2004 California Electrical Code (CEC), California Title 24 Accessibility Regulations, 2005 Title 24 Energy Regulations, City Ordinances, and State and Federal laws and regulations 2005 Edition. Building plan check submittal shall include the following: . Four (4) sets of construction plans, including drawings for electrical. . Two (2) copies of Title 24 energy calculations (for outdoor lighting). . Elevations that include all proposed wall, fences, and gates materials, colors, finish. . A note shall be provided on the plans that "All parking areas shall be illuminated with a minimum of one (1) foot-candle of light, and lighting shall not produce light, glare, or have a negative impact on adjacent properties," Vehicle parking, primary entrance to the building, exit doors, the primary paths of travel, cashier space, sanitary facilities, drinking fountain, and public telephones shall be accessible to persons with disabilities and shall be shown on the plans. Within forty-eight (48) hours of approval of the subject project, the applicant shall deliver to the Community Development Department, a cashier's check payable to the COUNTY CLERK in the amount of forty-three dollars ($43.00) to enable the City to file the appropriate environmental documentation for the project. If within such forty-eight (48) hour period that applicant has not delivered to the Community Development Department the above-noted check, the statute of limitations for any interested party to challenge the environmental determination under the provisions of the California Environmental Quality Act could be significantly lengthened.
