WEST, CITY MANAGER Agenda Item 9 Reviewed: 115W City Manager Finance Director N/A TERMINATION OF LOCAL EMERGENCY DUE TO CIVIL UNREST On May 31, 2020, the City Manager, acting in his capacity as Director of Emergency Services, proclaimed the existence of a local emergency relating civil unrest, in accordance with Government Code Section 8630 and Tustin Municipal Code Sections 5204 and 5205(a)(1). The proclamation was subsequently ratified by the City Council on June 2, 2020. The civil unrest appears to have largely subsided at this time, at least locally, so termination of the local emergency is recommended. RECOMMENDATION: That the City Council proclaim the local emergency declared in response to civil unrest to be terminated, effective immediately. BACKGROUND AND DISCUSSION: On May 31, 2020, the City Manager, acting in his capacity as Director of Emergency Services for the City of Tustin, declared the existence of a local emergency under authority contained in California Government Code Sections 8610 through 8634 and Tustin City Code Sections 5204 and 5205. The state of local emergency arose due to civil unrest which occurred in the aftermath of the tragic death of George Floyd on May 25 in Minneapolis, Minnesota. The City Council ratified the proclamation of local emergency at a June 2, 2020 Special Meeting. Concurrently with the ratification of the local emergency, the City Council adopted its "Tustin Solidarity" proclamation. California Government Code section 8630 authorizes cities to adopt proclamations of local emergencies. That same section also calls for city councils to proclaim local emergencies to be terminated as soon as conditions warrant. Although lawful protests related to the death of George Floyd and others continue to occur in Southern California and nationally, the unlawful conduct and civil unrest which accompanied protests in late May and early June appears to have largely subsided at this time, at least locally. As a result, conditions now warrant, and staff recommends, that the City Council terminate the local emergency related to civil unrest. 1481375.1 DocuSign Envelope ID: 1C9A57ED-E503-4BE9-A039-5CA5DED3CAE3 TERMINATION OF PROCLAMATION OF LOCAL EMERGENCY DUE TO CIVIL UNREST July 7, 2020 Page 2 It should be noted, however, that the recommended termination of local emergency related to civil unrest will not affect the Council's March 20, 2020 ratification of the proclamation of the COVID-19 local emergency which continues to be an emergency situation that poses on- going threats to the health of individuals living and working in Tustin. 1481375.1
